Between the owner of this lot and Pools of Fun, I hardly know my n~e. Is it not correct..that they will have to obtain a
Consent to Encroach Agreement in addition to BZA approval for the ~at,@n-ce?T~j~tciJked to the owner, Melinda
Endicott, for over 10m inutes trying to explain the procedure to no avail. I'had-faxed information to Pools of Fun
outlining the information I need on a drawing to be supplied by Pools of Fun which would be used as an exhibit for the
Agreement I explained to Pools of Fun that if they could get the drawing to me quickly, I could get the Agreement
prepared and thru legal and be ready for the first available BPW meeting after the BZA approval to Jessen the time
frame between BZA and BPW for the owners. I didn't seem to make Mrs_ Endicott understand and I never received a
reply from Pools of Fun. It now appears that I can not get the Agreement ready until the May 15 BPW and the owners
are upset. Any comments or suggestions?

meeting.
What will you require for this installation? Will this require a variance? If so, should I wait until this has been
determined before submitting the Agreement to the Board?

Our office has reviewed the Developmental Standards Variance petition filed by you on
behalf of Thomas A. and Melinda Endicott for Sma key Ridge, Section 3, Lot 63, at 13719 Sma key
Ridge Overlook. The following are comments that need to be addressed:
Application:
· The Developmental Standards Variance Application form is not complete as filed. Item 7
on Sheet 1 and Item 8 on Sheet 2 have not been completed. Section 25.9: Drainage may be
cited as the Section from which relief is sought.
a Please remember to provide fully filled out Findings-of-Fact sheets for the Special Use
Amendment and each Developmental Standards Variance the night of the meeting for the
Board's use. Also remember to fill out the Docket No. and date on each Ballot Sheet for the

Dear Mr. Colon:
This office reviewed the plans submitted for the Dcvelopmenta1 Standards Variance for the proposed
rcsidentia I swimming pool at 13719 Smokey Ridge Overlook in hmc of 2001. This revic\v was in
anticipation of the project being on the June 20, 2001 Tec1ullcal Advisory ConuniUee agend3. Since the
item was pulled [rom the agenda, our review '.vas not submitted. We offcr the following comments
regarding this project with tilC assumption that the current conditions are identical to those submitted in
hme of2001:
111is installation has been reviewed by our Public Works inspector and by the City Engineer. Additionally,
our Public Works inspector has made an onsite inspection of the proposed installation area. Our initial
concern involved the fact that t11isinstallation would encroach upon a drainage and utility easement.
Additional concerns were raised because there is a detention area in the easements behind Lots 63, 64,65
and 66. The concern was ti13t if this installation was to occur in the detention area, it could negatively
inlp,'lct the capacity of the detention area and its ability to Junction 3S originally designed.
The location of tile pool and dCGK 1,W~ h'" ,)dified to the satisfaction of our Public Works Inspector and
City Engineer. The impact of tile modified location on the e3sement appears to be minimal.
In reviewing tile plan for tills lot, \ve notice there is another encroaclullent. Because the house has a side
load garage, the driveway to access this garage encroaches upon the 10' D&UE along the east boundary of
the lot. If you will notice on the construction plan submillcd, tilere is 3 storm sewer stnwhlre (#620) and
IS-inch underground storm sewer pipe running under and parallel to the cast boundary of Ute lot. Although
tIle driveway issue is not related to tile pool issue, the Owner should be made aware ohhe encroachment
and the proximity to this undergrowld pipe by the driveway, and be advised I1k1.t 111is encroachment mnst be
included in the Consent to Encroach Agreement.
This office is prepared to approve and draft a Consent to Encroach Agreement beh'icen I1le City of Cannel
and l1le Owners of the property for the pool, pool deek and dJiveway encroacluncnt. 'T'he Consenllo
Encroach Agreement requires the review and approval of our City Attorney ;md approval by our Board of
Public Works and Safely. We will require the following information to prepare this document:
o Letter requesting a Consent to Encroach Agreement
o Names of the Owners of the propcrty as they appear on I1leir deed.
\) We cannot guarantee a date of approval. Once we receive your request ancl cX]libit, the tinting of
approval depends upon review and approval by the City Attorney and placement upon tile Board of

RE: Smokey Ridge, Section 3, Lot 63/Projcct Review #1
Dear Mr. Colon:
TIus office reviewed the plans sLlbmitted for the Developmental Standards Variance for the proposed
residential swimming pool at 13719 Smokey Ridge Overlook in June of 2001. This review was in
anticipation of the project being on the June 20, 2001 Technical Advisory Committee agenda. Since the
item was pulled from the agenda, our review was not submitted. We offer the following comments
regarding this project with the assumption that the current conclitions are identical to those submitted in
June of 200]:
This installation has been revjc-wed by our Public Works inspector and by the City Engineer. Additionally,
our Public Works inspector has made all onsite inspection of the proposed installation area, Our initial
concern involved the fact that this installation would encroach upon a drainage and utility casement.
Additional concerns were raised because there is a detention area in the easements behind Lots 63, 64, 65
and 66. The concern ,vas that if this instilllation was to occur in the detention area, it could neg,'ltively
;act the capacity of the detention area and its ability to function as originally designed.
The location of the pool and deck has been modified to the satisfaction of our I'ublic Works Inspector and
City Engineer. The impact of the modified location on the easement appears to be minimal.
In reviewing the plan for this lot, we notice there is anotller encroachment. Because the house has a side
load garage, the driveway to access this garage encroaches upon tlle 10' D&UE along the east boundary of
the lot. If you willllotice on the construction plan submitted, there is a stann sewer stmcture (#620) and
IS-inch underground storm sewer pipe mIllling lU1der and parallel to the east boundary of the lot. Although
the driveway iSSlle is not related to the pool issue, the Owner should be made aware of the eneroaclunent
and the proximity to thjs undergrOlmd pipe by the driveway, and be advised tlmt tJ1is encroachment must be
included in the Consent to EncrQach Agreement.
This office is prepared to approve and draft a Consent to Encroach Agreement between tJle City of Carmel
and the Owners oHhe property for t11(; pool, pool deck and driveway encroaclunent. The Consent to
Encroach Agreement requires the review and approval of om City Attol1ley and approval by our Board of
Public Works <md Safety. We \vill require the following infonnation to prepare this document:

., Names of the Owners of the property as they appear on their deed
., We cannot guamntee a date of approval. Once we receive yom request and exhibit, the timing of
