FINDINGS OF FACT-DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
(a) The permanent ground sign requested does not encroach into either the rights-of-way or clear vision
areas, and therefore does not obstruct the view of "an intersection of a street";
(b) The permanent groiJnd sign features a design which is aesthetically pleasing and enhances the
general welfare of the community; and
(c) The illumination of the existing brick wall (which wall illuminates the permanent ground sign) is
directed so that there is no glare or light spill associated with the sign's illumination.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
(a) the permanent ground sign requested is designed and scaled to compliment the existing brick wall,
and will enhance the aesthetics and value of the surrounding area;
(b) the permanent ground sign requested is well designed in order to not detract from the use and value
of the subdivision, and those who have purchased property within it; and
(c) the permanent ground sign does not encroach into either the rights-of-way or clear vision areas, and
therefore does not obstruct the view of "an intersection of a street".
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in
the use of the property because:
(a) the lack of the permanent ground sign will result in a practical difficulty for the public in identifying and
locating the subdivision
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that the Developmental Standards
Variance Docket No. is granted, subject to any conditions stated in the minutes of this
Board, which are incorporated herein by reference and made a part hereof.
