PERMANENT SUBDIVISON SIGNS
Background:
The Lakes at Hazel Dell is a 280 lot, single-family residential development, consisting of three (3)
subdivisions on approximately 147.8 acres in Carmel, Indiana. It is located south of 126th Street, west of
the Plum Creek development and east of the Waterstone development Hazel Dell Parkway bisects the
development (see attached Area Map).
Petition:
Applicant requests Variances of Developmcnt Standards to permit a permanent subdivision ground signs
at one of the entrances into The Lakes at Hazel Dell development
An Application for ADLS Approval has been filed contemporaneously with this Application to obtain
Plan Commission approval of the permanent subdivision ground signs.
In October, 2000, The Carmel/Clay Board of Zoning Appeals granted Variances of Development
Standards for the location of a permanent suspended subdivision sign at one orthe entrances into The
Lakes of Hazel Dell development:
V-139-00 - Dellifield Boulevard East and Hazel Dell Parkway/Section 1, Common Area 7.
Variances were required to permit suspended signs which are not a permitted sign type within the
s- ] /Residence District.
Petitioner desires to locate a permanent subdivision ground sign on the existing brick wall at the
entrance to The Lakes of Hazel Dell development noted above. The existing brick wall is
illuminated by spot lights. Sections 25.7.02-1(b) and (c) of the Zoning Ordinance for Carmel
and Clay Township specify the following requirements forpermanent subdivision signs:

One (1) sign per entrance; matching signs which border either side of one entrance into a
subdivision shall be treated as one (1) sign; however, both sign faces shall be used to
calculate the total sign area.

1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the
community because:
(a) The permanent ground sign requested does not encroach into either the rights-of-way or clear vision
areas, and therefore does not obstruct the view of "an intersection of a street";
(b) The permanent ground sign features a design which is aesthetically pleasing and enhances the
general welfare of the community; and
(c) The illumination of the existing brick wall (which wall illuminates the permanent ground sign) is
directed so that there is no glare or light spill associated with the sign's illumination.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
(a) the permanent ground sign requested is designed and scaled to compliment the existing brick wall,
and will enhance the aesthetics and value of the surrounding area;
(b) the permanent ground sign requested is well designed in order to not detract from the use and value
of the subdivision, and those who have purchased property within it; and
(c) the permanent ground sign does not encroach into either the rights-of-way or clear vision areas, and
therefore does not obstruct the view of "an intersection of a street.".
3. The strict application ofthe terms of the Zoning Ordinance to the property will result in practical difficulties in
the use of the property because:
(a) the lack of the permanent ground sign will result in a practical difficulty for the public in identifying and
locating the subdivision
