listed below. THIS IS NOT A BUILDING PERMIT. All required local permits and licenses must be obtained priorto beginning construction work. All
construction work must be in full compliance with all applicable State rules. Any changes in the released plans and/or specifications must be filed with
and released by this Office before ary work is altered. This release may be suspended or revoked if it is determined to be issued in error. in violation
of any rules of the Commission or if it is based on incorrect or insufficient information. This release shall expire by limitation, and become null and
void, if the work authorized is not commenced within one (1) year from the above date.
CONDITIONS:
Note (A1A & Al 6). In accordance with the affidavit sworn under penalties of perjury in the application for construction design release the plans
and specifications filed in conjunction with this project shall comply with all of the applicable rules and laws of Fire Prevention and Building Safety
Commission. Providing false information constitutes an act of perjury, which is a Class D felony punishable by a prison term and a fine up to $10,000_
In accordance with Section 19 of the General Administrative Rules (675 IAC 12-8-19) a complete set of plans and specifications that conform
exactly to the design that was released by the office of the state building commissioner shall be maintained on the construction, jobsite as well as a
copy of the design release.
3113111.2 Buildings shall be accessible to persons with disabilities in accordance with Section 1.2 (1 through
5) and (2), Part 1, Chapter 11, IBC (675 IAC 13-2.4),
3CO501A Buildings that are heated or mechanically cooled shall be constructed so as to provide the required
thermal performance of the various components in accordance with Section 501.1, IECC (675 IAC
19-3-1).
3BO602 Exterior walls shall have fire-resistance ratings in accordance with Table 602, IBC (675 IAC 13-2.4)_
9P0412A Except in dwelling units, a floor drain shall be installed in a toilet room containing two or more water
closets or a combination of one water closet and one urinal in accordance with Section 412, ]PC
(675 IAC 16-1.3)_
Corridors shall comply with Section 1004.3.2, IBC (675 IAC 13-2.4).
Please be advised that if an administrative review of this action is desired, a written petition for review must be filed at the above address with the
Fire Prevention and Building Safety Commission identifying the matter for which a review is sought no later than eighteen (18) days from the above -
stated date, unless the eighteenth day falls on a Saturday, a Sunday, a legal hoiiday under State statute, or a day in which the Department of Fire
and Building Services is closed during normal business hours. In the latter case, the filing deadline will be the 5Tst working day thereafter. If you
choose to petition; and the before-mentioned procedures are followed, your petition for review will be granted, and an administrative proceeding will
be conducted by an administrative law judge of the Fire Prevention and Building Safety Commission. If a petition for review is not filed, this Order will
be final, and you must comply with its requirements.

7. DESCRIPTION OF THE VARIANCE

The office area of 6,967 square feet will be designed without fire-rated corridors. Based upon a calculated occupant load of over
50, a I-hour corridor is required.
The building is classified as B Occupancy and Type VB Construction.
8. DEMONSTRATION THAT PUBLIC HEALTH SAFETY AND WELFARE WILL BE PROTECTED

Applicant will undertake alternative actions in lieu of compliance with the rule to ensure that granting of the variance will not be adverse to public
health, safety or we! fare- Explain why alternative actions would be adequate (be specific).
Facts demonstrating that the statement selected above is true:
1. The tenant area will he divided in half with a I-hour fire partition, and 20-minute doors. Each half will comply with
exceptions for a single tenant space without a fire-rated corridor - the south half h as an occupant load of less than 50 and a
maximum common path of egress travel of less than 75, and the north half has an occupant load of less than 30 and a maximum
common path of egress travel of less than 100.
2. The means of egress for each half is directly to the exterior, and is not required to pass through the other half. The spaces
function as independent tenant areas for egress purposes (If the spaces were separate tenant areas, a variance would not he
required). The 1-hour fire partition exceeds minimum code requirements for a tenant separation between tenants of the same
occupancy group.
3. The maximum travel distance to an exit is approximately 85 feet - code permits up to 204 feet for R Occupancy.
4. Fire-rated corridors are not required within a Business Occupancy space occupied by a single tenant per Sec. 38.3.6.1,
exception 2, NFPA 101, Life Safety Code. 2006 Edition. The Appendix states that "the concept is that people under the same
employ working the same hours would likely be familiar with their entire tenant space".
9. DEMONSTRATION OF UNDUE HARDSHIP OR HISTORICALLY SIGNIFICANT STRUCTURE

The hardship is that fire-rated corridor construction would require complete enclosure of spaces from the corridor, thus
reducing visibility and communication of spaces. Additionally, the hardship is maintenance of door closers on office doors.
