Well, we'll withdraw only after we get the letter from Mike that we need - the draft of which should go to him this afternoon.

Dear Mr. Nicely:
The purpose of this letter is to confirm that the existing heliport located in
the Conseco office complex received Special Use approval from the Carmel/Clay
Board of Zoning Appeals on October 26, 1992 under Docket No. SU31-92.

It is confirmed that the approval for the heliport runs with the land and
allows the owner, subsequent owner(s) of the real estate and other persons
acquiring an interest therein, to use the heliport facilities within the parameters of
the approval of SU31-92 without the need for any new or additional approvals,
applications, permits, reviews, etc.
In particular, it IS confirmed that the heliport facilities may be used by the
owner(s) and employees of the Indianapolis Colts, Inc. and for private use,
including, but not limited to, James and Margaret Irsay.

Dear Mr. Nicely,
The purpose of this letter is to confirm that the existing heliport located in the Conseco
office complex received Special Use approval from the Cannel/Clay Board of Zoning Appeals
on October 26, 1992, under Docket No. SU-3l-92.
The aforementioned Special Use approval for the heliport runs with the land and allows
the owner, subsequent owner(s) of the real estate and other persons acquiring an interest therein,
to use the heliport facilities within the parameters of the approval of SU-31-92 without the need
for any new or additional approvals, applications, pemlits, reviews, etc.
The question of who may use the facility is at the discretion of the owner to answer.
There was no commitment made by the petitioner, nor condition of approval attached by the
Board of Zoning Appeals to the approval of Docket No. SU-31-92 that would prohibit entities
other than the owner from entering into a contractual agreement with the owner for use of the
heliport facility. There is also no distinction in the Carmel/Clay Zoning Ordinance between
private and commercial heliports and their use.
