City of Cannel I OR T, A DEPARTMENT OF COI?1MUNITY SERVICES JNQIAWk Division of Building and Code Services January 9, 2008 Brian Solomon and Joe Dodson 4042 71 s; Street Suite B ° (OPY Indianapolis, Indiana 46268 PRE RE: CITY CODE VIOLATION - TRASH DUMPSTER Dear Sir or Madam This letter is being provided to inform you that there is some concern regarding the trash dumpster at 644 Marana Drive in the City of Carmel, a property listed under your ownership. As per Chapter 25.05 Use Regulations of the Carmel/ Clay Zoning Ordinance, "trash, garbage and all solid wastes shall not be stored outside of any building for a period of longer than seven (7) days, except when construction is in progress". Our records indicate that there is not an open building permit for this property, so the exception provided does not apply. There are regulations that require businesses and multi-family uses to maintain dumpster enclosures, however in a single-family neighborhood, dumpsters are considered to be a temporary use, and thus are limited to seven (7) days. Obviously, to allow a dumpster to remain longer than seven (7) consecutive days would greatly impact the safety, security, and sanitation of any residential neighborhood. The initial complaint received by this department indicated that this dumpster has been there for several months. Please immediately remove the dumpster from the property. Failure to remove the dumpster from the property by January 25, 2008 will result in further enforcement action by the City of Carmel.
