St. Peter's United Church of Christ (V-28-02) Petitioner seeks approval of a Developmental Standards Variance of Section 27.3.2 in order to forego the installation of perimeter parking lot curbing. The site is located at 3106 East Cannel Drive. The site is zoned R-l/Residence within the State Highway 431/Keystone Avenue Overlay Zone. / / In deciding whether or not the applicant has presented sufficient proof to permit the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; The lack ofparking lot perimeter curbing on this site will not be injurious to the public health, safety, morals and general welfare of the community because site drainage control is being accomplished by alternative means, and the aesthetic impact will be mitigated by a row of low shrubs along the parking lot perimeter. 2. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. The site is now and has been for several years occupied by a church and utilized for religious purposes. The site would continue to function in this ma1ll1er if perimeter curbing were required to be installed. The Plan Commission has approved an ADLS Amendment (Docket No. 53-02 ADLS Amend) for this site with the condition that the drive alignment be revised to the satisfaction of the Department of Engineering and the Department of Community Services. The Department recommends favor,able consideration of this petition with the following condition: 1) That the petitioner revise the drive alignment such that an opposing left turn movement is established with Waterford Lane. The petitioner will need to re-describe the two existing Tax Parcels into a single property. before coming forward with a petition for the expansion onhe Special Use.
