Petitioner seeks approval of a Developmental Standards Variance of Section 26.4..5(c) in
order to reduce the side perimeter bufferyards on the north and south property lines to
zero (0) feet.
The site is located at 530 South Range Line Road. The site is zoned I-1/Industrial.
In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety, moraIs and
general welfare of the community;
The lack of side bufferyards on this site will not be injurious to the public health,
safety, morals and general welfare of the community because their absence on this
site in the past has never proven to be injurious to the public health, safety, morals
and general welfare of the community.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adjacent to the

site modifications to exclude side bufferyards.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property.

in the use of the property. At present the site is one hundred (100) feet wide, and
utilizes drives on the north and south. The distance between the existing structure
and the north retaining wall is twenty (20) feet at the narrowest. The distance
between the existing building and the south property line is 18.7 feet at the
narrowest. In order to accommodate the necessary bufferyards and still maintain
adequate site circulation would require the razing of the existing structure and the
reconfiguring of the entire site.
The Department recommends favorable consideration 0[th1s petition.
