Petitioner seeks Special Use approval in order to establish a middle seho'ol on 159.823:1:

The site is located on the southeast comer of West 126t Street and Shelborne Road. The
site is zoned S-l/ResidencelEstate.
The Department recommends favorable consideration of Docket No. 8U-38-02. the
petition for a new middle school with the following Conditlon:
1) That the petitioner comply with all requirements set out by the Carmel/Clay
Technical Advisory Committee.

Docket No. V-39-02 - 95.4.1: Maximum Height - petition to erect a 45' 4" middle school:
In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety,. morals and
general welfare of the community;
A 45' 4" middle school on this site will not be injurious to the public health,
safety, morals and general welfare of the community because the size of the site
makes the scale of the building less apparent.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adjacent to the
property will not be affected in a substantially adverse m31U1er by allowing the
school to be 45' 4", The site is unusually large, and the surrounding land is as yet
undeveloped, so homeowners coming into the area will take possession of new
homes with the school already in existence. Furthermore, the convenience of the
proximity of the school to residential properties should have a positive influence
011 property values.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in llse of the property.
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. Schools are a necessary element in the success of the
community. School uses include indoor activities that require substantially higher
ceiling heights than typical residential uses.
The Department recommends favorable consideration of this petition.

In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety, morals and
general welfare of the community;
The establishment of the three oversize traffic directional signs on this site "vill
not be injurious to the public health, safety, morals and general welfare of the
community because the signs will be so widely spaced on the 160-acre tract.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse maimer; and
It is the Department's opinion that the use and value of the area adjacent to the
property will not be affected in a substantially adverse manner by allowing three
oversize traffic directional signs to be established.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property. '
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. Educational institutions are often visited by people
who need additional guidance to efficiently navigate the sites because they are
unfamiliar with the site and building layouts.
The Department reconunends.that the Board suspend the Rules of Procedure in order to
vote on these six petitions simultaneously.
The Department recommends favorable consideration of these petitions.

In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety~ morals and
general welfare .of the community;
The establishment of three in~titutional signs on this site will not be injurious to
the public health, safety, morals and general welfare of the community because
the signs will be so widely spaced on the 160-acre tract.
2. The use and value of the area adjacent to the property included in the
variance will Dot be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adjacent to the
property will not be affected in a substantially adverse manner by allowing three
institutional signs to be established.
3. The strict application of th~ terms of the Zoning Ordinance will result in
practical difficulties in use of the property.
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. An educational institution on a site this large will need
to be identified from several different vantages.
The Department recommends favorable consideration of this petitioll.

In deciding whether or not the applicant has presented sufficient proof to pennit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety, morals and
general welfare of the community;
The establishment of a 93 .O-square-foot wall institutional sign on this site will not
be injurious to the public health, safety, morals and general welfare of the
community because the signs will be oriented to the southeast, in toward the site.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adjacent to the
property will not be affected in a substantially adverse manner by allowing a 93.0-
square- foot waU institutional sign to be established oriented to the southeast, in
toward the site.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property.
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. An educational institution on a site this large will need
to be identified from several different vantages.
The Department recommends favorable consideration oftrus petition.

In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety~ morals and
general welfare of the community; .
The establishment of a 24-square-foot changeable copy sign on this site will not
be injurious to the public health, safety, morals and general welfare of the
community because the signs will provide valuable public information.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adj acent to the
property will not be affected in a substantially adverse manner by allowing a 24-
square-foot changeable copy sign to be established.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property. .
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. An educational institution on a site this large will need
to provide information about activities to passersby.
The Department recognizes that there is a unique need at educational facilities to provide
parents and other visitors information regarding the variety of functions that may be held. The
Department recommends favorable consideration of this petition.

community because the incorporated signs will provide valuable public
information.

variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adjacent to the
property will not be affected in a substantially adverse manner by allowing a 6' 2"
institutional ground sign to be established.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property.
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. An educational institution on a site this large will need
to provide information about activities to passersby.
