Petitioner seeks approval of the following Developmental Standards Vmiances:
V-50-02 f25. 7. 02-11 (d)(i) 10' center identification height
V-51-02 f25.7.02-11(g)(i) center identification copy
The site is located on the southeast corner of City Center Drive and South Range Line
Road. The site is zoned B-7/Business.
Docket No. V-50-02; the petition for a ten-foot tall center identification sign:
In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety, morals and
general welfare of the community;
A ten-foot tall center identification sign on this site will not be injurious to the
public health, safety, morals and general welfare of the community because the
sign will be located outside the Vision Clearance Triangle.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adyerse manner; and
It is the Department's opinion that the use and value of the area adj acent to the
property will not be affected in a substantially adverse manner by a ten-foot tall
center identification sign.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property.
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. The only site available for a center identification sign
at Mohawk Landing is in the depressed area at the comer of Mohawk Drive and
South Range Line Road. Furthermore, the fence located adj acent to the sidewalk
rises an additional forty-four inches above sidewalk grade. This fence is often
covered by various banners placed for public events of various types, making
visibility of a lower sign nearly impossible.
The Department recommends favorable consideration of Docket No. V-50-02. the
petition for a ten-foot tall center identification sign.

Docket No. V-51-02; the petition to allow tenant copy on a center identification sign:
In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall detennine in writing
that:
1. The approval will not be injurious to the public health, safety, morals and
general welfare of the community;
Tenant copy 011 a center identification sign on this site will not be injurious to the
public health, safety, morals and general welfare of the community because it will
be limited to those tenants that do not have fayade space available to them.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adj acent to the
property will not be affected in a substantially adverse manner by tenant copy on
the center identification sign for this site.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property. .
The strict application of the Zoning Ordinance will result in practical difficulties
in the use of the property. The tenants located at the angle of the building do not
currently have a readily apparent signage option available to them.
The Department recommends favorable consideration of Docket No. V-51-02, the
petition to allow tenant copy on the center identification sign for this site, with the [allowing
Conditions:
1)
That the tenant signage be limited to those tenants that do not have fa9ade space
available to them.
That the ground sign currently located on site be removed.

Docket No. V-53-02; the petition for a reduced number of parking spaces:
In deciding whether or not the applicant has presented sufficient proof to permit the
granting of a variance of development standards, the Board shall determine in writing
that:
1. The approval will not be injurious to the public health, safety, morals and
general welfare of the community;
The reduction in the number of parking spaces on this site will not be injurious to
the public health, safety, morals and general welfare of the community because a
shared parking agreement has been reached with the Carmel Ice Skadium to the
south.
2. The use and value of the area adjacent to the property included in the
variance will not be affected in a substantially adverse manner; and
It is the Department's opinion that the use and value of the area adj acent to the
property will not be affected in a substantially adverse.manner by the reduction in
the number of parking spaces on this site.
3. The strict application of the terms of the Zoning Ordinance will result in
practical difficulties in use of the property.
The strict application of the Zoning Ordinance will not result in practical
difficulties in the use of the property. The site could be used for any number of
industrial or manufacturing uses that have lesser parking requirements.
The Department recommends favorable consideration of Docket No. V-53-02, the
petition for a reduction in the number ofrequired parking spaces, with the following Conditions:
1) That the parking plan be revised to show parking spaces of adequate dimensions
to meet the requirements of the Cannel/Clay Zoning Ordinance.
