Hamilton County Senior Services (V-52-02; V-53-02) Petitioner seeks approval of the following Developmental Standards Variances: V-52-02 927.3.2 forego parking lot curbing . V-53-02 927.5 reduced number of parking spaces The site is located at 1078 Third Avenue Southwest. The site is zoned I-lllndustrial. Docket No. V-52-02; the petition to forego parking lot curbing: In deciding whether or not the applicant' has presented sufficient proof to permit' the granting of a variance of development standards, the Board shall determine in writing that: 1. The approval will not be injurious to the public health, safety, morals and general welfare of the community; The lack of parking lot perimeter curbing on this site will not be injurious to the public health, safety, morals and general welfare of the community because site drainage control is being accomplished by alternative means. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner; and It is the Department's opinion that the use and value of the area adjacent'to the property will not be affected in a substantially adverse manner by the lack of parking lot perimeter curbing. 3. The strict application of the terms of the Zoning Ordinance will result in practical difficulties in use of the property. The site is now and has been for several years occupied by a church and utilized for religious purposes. The site would continue to function in this manner if perimeter curbing were required to be installed. The Department recommends favorable consideration of Docket No. V-52-02. the petition to forego parking lot curbing, with the following Conditions: 1) That the aesthetic impact be mitigated by a row of low shrubs along the parking lot perimeter. 2) That a Landscape Plan showing these plantings be submitted to the Department of Community Services no later than Monday, June 17, 2002, for review and administrative approval.
