This is our response to your comments sent in an email dated, January 24, 2008. I believe the comments from
the July 30, 2007 email were addressed with this last submittal and the additional waivers.
I will make sure the following is submitted as per the filing schedule. The notarized affidavit of notice of pUblic
hearing, public hearing form, notarized affidavit of public notice sign placement and a copy of the adjacent
property owners from the Hamilton County Auditor's Office.
We will get the packet information together as required along with the findings of facts form for the PC Members,
as well as include the written and/or photographic architectural commitments. The architectural commitments
draft has been forwarded to our clients.
There was a "soil erosion control plan" filed as part of the SWPP (Stormwater Prevention Plan). If it is missing,
please let me know and I will get one to you.
The landscape plan is being worked on with Scott Brewer by the landscape architect. We will make sure you
have a copy ASAP.
The gate criteria has been forwarded to our clients.
The western lot line of Lot 5 has been better delineated.
The cul-de-sac street location has been changed from the September 2006 layout, in order to maintain the
existing vegetation and to help facilitate the drainage, as well as esthetically pleasing to the client.
The copies of the transmittals to the T AC members are included with this leUer.

The Claridge Farm Homeowners Association respectfully submits this
Remonstrance to the Carmel Plan Comtnission as well as the attached Petition regarding
the effects ofthe planneddevdopment of Lakeland Subdivision in Carmel, Indiana.
Claridge Farm is a community of 218 homes located at ] 26th Street and Clay Center Road
and adjacent to the South property line of the property owned by Browning Investments
which is to be developed as LakeIand Subdivision.
The projected 10 acre development is currently and has been during the 15 years
since establishing Claridge Farm been a single dwelling residence and farm. The
property contains one major area of old growth deciduous forestation which incorporates
the Claridge Farm property line and approximately 100 feet of buffer zone.
The Lakeland Avenue Street is planned to dissect that old growth and destroy
many trees in the process. We as homeowners purchased, our homes and properties
adjacent to these acres paying premium values for the beauty and quiet provided by this
lo-cation. In fact, the estate homes of Claridge Farm are positioned, as with most
subdivisions, at the entrance to the neighborhood which are adjacent to this development.
The propertyvalues within Claridge Farm are set with these estate homes as the leaders.
We simply petition for and request that the planned street which is parallel
to our property lines be placed a minimum of 42 feet from the property line and be
lined with evergreen trees to presen'e our property values, decrease the
consequential noise of a street, avoid the creation of double frontage lots with these
estate homes, and reduce the effects of runoff created by the street and elimination
of so many trees.
If the street is placed any closer to the Claridge Farm property line without the
addition of evergreen trees, the estate homes would become double frontage lots with a
, -
vis.ible street on both sides of the homes. Such placement would decrease our property
values significantly. We cannot plant evergreens on our properties due to the taller
deciduous trees along the property line which would stifle any younger tree grO\\-1h and
due to the wet soi I from the upgradient run off.
Although the storm water from the site is to be engineered to the Northeast sector
of the site, there will be storm water run off from the effects of the street and the
elimination of many trees. This area already experiences the effects of storm water run
off do to the natural topo1:,rraphy of the middle section of the 10 acres, with the run off to
the South and onto Claridge Farm properties. We are concerned that the nm off will only
increase and cause a wetland area within Claridge Farm if the street is placed any closer
or without the addition of evergreen trees. It is essential that the street be placed a
minimum of 42 feet from the Claridge Farm property line and that evergreen trees be
planted along the street where it lies parallel thereto.
On July 30, 2007, Mark and Mary Ann Saggese, Claridge Farm homeowners and
President of the Homeowners Association Board of Directors, met \\lith Michael Bush,
Christian Browning, and Mike DeBoy of DeBoy Land Development to discuss the
planned development. During that meeting, Mr. Bush and Mr. Browning agreed to set
the street back a minimum of 42 feet off the property line, to preserve the trees up to the
street and to install evergreen trees along the. street as a year-round buffer between the
properties.
It should be recognized that the LakelandSubdivision is a development for only
four to five residences on 10 acres and that the minimum setback in no way encumbers
the usefulness or positioning of those residences. The preservation of the old growth
forestation on the middle section of the 10 acres will in fact enhance the beauty and value
of these 10 acres. There is truly no logical, practical or engineering argument to SUppOlt
any reduction oftbis agreed upon s~tback of42 feet.
We request that the agreement ofthese parties be given the full support ofthe
Commission and imposed as a legal r~quirement for the development of Lakeland
Subdivision. Specifically, the planned.street edge must be required to be setback a
minimum of 42 feet from the property line between Claridge Farm and the Lakeland
Subdivision, the trees up to the street must be preserved, and evergreen trees must be
placed along the street where it parallels: the Claridge Farm property line to establish a
year-round buffer between these properties.

PETITION FOR PRESERVATION
OF CLARIDGE FARM PROPERTY VALUES
We the lmdersigned residents of Claridge Farm located West of the Clay Center
and 126th Street intersection in Carmel, Indiana, do hereby petition to preserve the
individual property values within Claridge Farm by requiring the setback of the planned
Lakeland Avenue within the planned development of Lakeland subdivision such that the
curb is positioned a minimum of 42 feet from the Claridge Farm property line. This
minimum setback requirement will preserve the property values of all homes within
Claridge Farm by not diminishing the property values of the homes adj aeent to the
planned Lakeiand subdivision. We wish to prevent the creation of double frontage lots
with the homes that set the upper property values for Claridge Farm. The minimum
setback of 42 feet has been established upon the agreement of Christian Browning and
Michael Bush, principals of Browning Investments, the owner of the property, with Mr.
and Mrs. Mark Saggese of Claridge Farri1 on July 30, 2007. Browning Investments has
further agreed'to place evergreen trees along Lakeland Avenue for year-round buffering
between Claridge Farm and Lakeland. We further petition to the Carmel Plan
Commission to honor these agreelnents by imposing the agreements, previously made
and set forth above, for evergreen trees and a 42 feet setback as legal requirements for the
development of Lakeland subdivision.

I wanted to fallaw-up with you on our meeting this afternoon.
This is my understanding:

We are able to get a building permit for the one lot and get the house under construction and then finish with platting
issues.
Lakeland Subdivision:
We will meet with engineering to discuss road issue regarding the geometries and any revised drainage issues.
We will file for a subdivision waiver for the geometries of the street (Section 6.03 of the Zoning ordinance). We will get
revised plans to the TAC members to stay on the current schedule.
Will be setting a meeting with Scott Brewer to discuss landscaping and tree preservation.
Please let me know if I have miss stated any of this information.

The following letter represents commcnts for this projcct specifically addressing the area of alternative transportation.
I have reviewed the drawings submitted tor the August 15,2007 Technical Advisory COllUTIittee meeting and offer the
following comments:
AL TERNA TlVE TRANSPORTATlON REVIEW COMMENTS
1) The Alternative Transportation Plan requires the construction ofa 10' as[lhalt [lath along Clay Center Road.
This path should connect to all adjacent sidewalks. Please revise the plans to include and label this path.
2) The Subdivision Contro'l Ordinance and the Alternative Transportation Plan requires a 5' sidewalk on each
side of internal streets. Please revise your plans to include this change.
3) Please indicate ADA compliant handicap ramps at all crosswalks.
We request that all responses to our comments be provIded in writing. Failure to provide written responses may result
in delay of Ihe review process.
II is critical that this office be made aware of all modifIcation made on the plans being re-submitted, particularly ifany
such changes arc considered "new" or fall outside of our previous reviews. Please provide revised plans indicating all
revisions. Please notify l1S of any changes and specifically state any changes, including changes rcsulling from Plan
Commission, Spccial Studies or other committee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
revIews.

In preliminarily reviewing the proposed primary plat of 4 lots, the following concerns are listed below:
1. Sidewalks on both sides of the cul-de-sac will be required per sca 8.09 .
2. a stub street to the north parcel is required per sca 6.03.03 and 6.03.04
3. the cul-de-sac length is over 600-ft - per sea 6.03.07
4. show the floodplain boundaries
5. the barn size is larger than the primary structure - a variance from the BZA is required
6. houses must face a collector road or be buffered, see sea 6.03.1"9 and 6.05.07
7. shift the cul-de-sac north, so allow for buffer plantings along the south property line . 4

Please advise your client that Carmel Clay Schools will not provide bus service in the cul-de-
sac. Student pick-up and drop-off will occur at the development entrance at Clay Center
Road. We do acknowledge the planned sidewalk as it will provide school students a safe path
of travel to the bus stop location.
