My residence is 10 acres bordering to the North of the above proposed development. I plan to be at the next meeting when the Plan Commission entertains this proposal on January 22, 2008. However, I may have a connict and am writing to you so that the ideas may be considered. Safety: There is a large (60,000 gal) swimming pool on my property adjacent to the North of Mr. Browning's. There is a livestock fence between our properties. I have talked with Mr. Mlke DeBoy and gather [rarIl him that Mr. Browning's development will be very elegant. The livestock fence may not be consistent with the development and may be taken down. That would expose my pool to children. My concern is for the safety of the residents of the proposed deve.!opment. The question is; If the existing fence were to be removed, what would be the replacement and who's responsibility would it be? Frontage and access; The entrance to the development will be very nice with a deceleration lane and proposed fountain. It may be close to the North border or Mr. Browning's property line. If possible, an easement from that entrance to the property just North wou.!d eliminate another access road off Clay Center Road when and if the 10 acres North of Mr. Browning's property were developed. This would be a safety factor by e1iminating another entrance/exit from Clay Center Road. Rear Access; A cuI de sac eXlts from Claridge Farms on the South West of Mr. Browning's property. This would allow easy access to the property but would require trattic through Claridge Farms. The ell.! de sac is very dose to the property line. Environmental; A pair of nesting GreatHorned Owls reside in the tall trees of the 20 acres including Mr. Browning's and my property. They live in the tall trees adjacent to the creek that is cornman to the properties. This land is the last reasonable size area [or wildlife in the vicinity. Mr. Browning has 10 acres (Mr. Harvey Kirby's), we have 10 acres, Dr. Beardsley (to my North) has 8 acres, and Mr. Roller to the North of Dr. Beardsley has 12 acres. On this property live beaver, heron, hawks, owls, deer, Canada geese( nest on Dr. Beardsley's pond), muskrat, ducks, and many other wildlife. I do not know what the DNR's policy is, but would feel that they may have some interest in the area. I hope to make the meeting on January 22. It is my, and the engineering department's, opinion that DOCS should not support these requests and require the sidewalks to be implemented wherever required. The city has made it a goal to provide its citizens the best network of walkable/bikeable infrastructure possible. By allowing subdivisions to develop without sidewalks on each side of their internal streets, we would be supporting just the opposite. Furthermore after these subdivisions have been fully developed and their residents request that sidewalks be implemented where they lack, it will be the city's full responsibility to implement them. Therefore by not granting these waivers the city's new developments will be fully connected and any possible safety or convenience concerns related to these potential sidewalks can be avoided.
