Project Narrative
The Petitioner seeks a variance of development standards to allow for construction and
expansion of an existing office building to a height in excess of the maximum height established
under Section 14.4.1 of the Carmel/Clay Zoning Ordinance for the B-3/Business District. In
1998, the Carmel/Clay Board of Zoning Appeals approved a variance to allow for the
construction of the atrium portion of the building to exceed the applicable thirty-five feet (35')
standard (Docket No. V-24-98 ~ approval of maximum height of 46 feet). Petitioner is expanding
the current building to add a second wing to the south side of the atrium. In connection with this
expansion and the renovation of the existing building to allow for medical office use, Petitioner
seeks approval to construct two metal panel screen walls to conceal new roof-top mounted
mechanical equipment to a height of forty feet (40'). The existing office building is utilizing
HVAC mechanical equipment, which is ground mounted at the rear of the building. In
consideration of the residential neighborhood to the west, Petitioner is proposing to add the
additional mechanical equipment on the roof of the existing building and on the proposed
expansion wing. Without this variance, Petitioner would be forced to add the additional
equipment at ground level.

FINDINGS OF FACT. DEVELOPMENTAL STANDARDS VARIANCE
1. The approval of this variance will not be injurious to the pUblic health, safety, morals and general welfare of the
community because:
The existing office building located on the site exceeds the maximum
allowable height per zoning requirements as approved under previously
granted var ianc'e.
2. The use and value of the area adjacent to the property included in the variance will not be affected in a
substantially adverse manner because:
Building expansion will substantially conform to, and mirror, the architectural
qualities of the existing structure. Property will remain under zoning
classification B-3.
3. The strict application of the terms of the Zon'lng Ordinance to the property will result in practical difficulties in the
use of the property because:
An inability to conform to and mirror the architectural style of the
existinq structure would be imposed. Also, it is necessary to place
the additional mechanical equipment on the roof so the sound
from the equipment will be contained.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Develo'pmental Standards Variance
Docket No. V-88-02 is granted, subject to any conditions stated in the minutes ofthis
Board, which are incorporated herein by reference and made a part hereof.
