DREWRY SIMMONS VORNEHl\II, LLP 8888 Keystone Crossing, Suite 1200 Indianapolis, Indiana 46240 RE: Springmill Medical Office Building ("Project") SW Comer of 103Td Street and TIlinois Street; Carmel, Indiana Dear Mark: I have reviewed the relevant Sections of the Carmel Zoning Ordinance ("Ordinance") and have determined that the developmental standards variance, filed as Docket No. V -88-02 ("Variance"), granted for the increased height of the second phase of the medical office building is in compliance with the one-year limitation contained in Section 30.05.05 of the Ordinance. Considering there has been some continuous construction on Phase Two of the Project including landscape installation, parking modifications, and H\1 AC system replacement, the provision requiring the re-filing of a variance after a year will not apply at the time a building permit is acquired for construction of Phase Two of the Project. As a result, the Variance approval does not need to be renewed or reapproved by the Carmel Board of Zoning Appeals. Also, to confirm my conversation with Paul Reis of your office, the development standards contained in the U.S. 31 Overlay Zone Ordinance do not apply to this particular piece of real estate that includes Phase One and Phase Two of the Springmill Medical Office Building. As a result, the two-year limitation on ADLS approvals does not apply to this Project. We will deliver the modified site plans to Jon today and will copy you. Based upon these changes, I believe the only necessary variance that will be required is for the building height (in excess of 35'). After your review of the revised drawings; please confirm this to be the case. Also, please confirm that the previously issued docket number will be retained and that the fee is $630.00..
