The~pplicant seeks primary plat approval for 9 lots on 11.58 acres. Also, subdivision waivers
requested are:

The site is located on 106'11 St east of Towne Rd. and is zoned S-1!Residence.

The petitioner seeks plimary plat and subdivision waiver approval requests for a residential subdivision of
9 lots 011 11.58 acres, which is a density of 0.78 units per acre. This subdivision is exempt from the
requirements of the Open Space Ordinance within Chapter 7 of the Subdivision Control Ordinance, since
its density is less than 0.85 u/ac.
This subdivision is proposed to be gated, and meets all of the gate cliteria presented in the Subdivision
Control Ordinance Chapter 6.03 .26, except the requirement to provide a school bus pick-up area.
However, the gated entry docs utilize a turn around area. The petitioner states that this development will
most likely be an empty-nester community where children will not be living or using a school bus.
Since the subdivision is proposed to be gated, the petitioner has requested a subdivision waiver to have
private streets.
This subdivision will have one entry and will have a cuI-de-sac of 1,220 feet in length. The ordinance
requires a cuI-dc-sac length of 600-ft or less. Since this subdi vision utilizes a cul-de-sac, it does not fulfill
the requirement of providing stub streets to adjacent parcels, and so another subdivision waiver approval
request is being sought. The layot.ll of Windemere 5ubdi vision to the east of this site does not allow for a
street connection. However, some discussion occulTed about future potential connections to parcels to the
west
On November 26, two development standruds variances were approved by the Boru'd of Zoning Appeals
for the following: a 30' front yard setback was approved, and a 20' Aggregate side yard was approved.
At the February 5 committee meeting, some concern as to the number of waivers requested was made, but
ultimately these petition items were forwarded to the full Plan ConnnissiOl1 with a 3-0 positive
recommendation. Some changes are:

Exhibit C will reflect that building plans will be stamped by an architect
the covenants and table of contents wi II be coordinated, and lypO'l corrected
DOCS concerns/comments:
I. The Forestry Dept needs an updated landscape plan that renecls the Counly Surveyor's Office
comments about not planting below top of bank in the drainage easement.
2. All other city and county departments are okay with the plans.
The Dept of Community Services recommends the Commission approve these items, after all
concerns and questions are addressed.
