FINDINGS OF FACT - AMENDMENT TO SPECIAL USE
I. The Special Use in Flood Plain District, Ordinance Z-160, Section 21.6 as amended Does/does
not apply and all prerequisites have been met by Petitioner as verified by the Techn ical Adv isorv Comm ittee.
2. The Special Use will be consistent with the Character and Perm itted Land Use of the zoning
district and Carmel/Clay Comprehensive Plan because a church is a permitted special use under the 8-1
Residential District and is presumed to be an appropriate use. This amendment to special use request is
merelva requestto permit a residence in a residence district.
3. The Special Use is physically suitable for the land in question because a church is a permitted
special use under the S-I Residential District. and presumed to be an appropriate use. This amendment to
special use request is merely to permit a residence in a residential district.
4. The Special Use will not injuriously or adversely affect the adjacent land or property values
because a church is a permitted special use under the S-l Residential District, and is presumed to be an
appropriate use. This amendll1ent to special use request is merely to permit a residence in a residential
district.
S. The Special Use wi II not adversely affect veh icular or pedestrian traffic flow, nor the adequate
avai labi I ity of water, sewage, or storm drainage faci I ities, or pol ice or fire protection because such services
are alreadv available to the real estate and a chun;h is a permitted special use under the S-I Residential
District and is presumed to be an appropriate use. This amendment to special use request is merely a request
to permit a residence in a residential district.
6. The Board has reviewed therequirements of Ordinance Z-] 60, Section 21.4 (1-25) as they relate
to this Special Use, and does not find that those criteria prevent the granting of the Special Use. True.
DECISION
IT 1S THEREFORE, the decision of the Carmel/Clay Board of Zoning Appeals that Special Use Docket No.
SUA-91-02 is granted, subject to any conditions stated in the minutes ofth is Board, which are incorporated
herein by reference and made a part hereof
