Dear Board Members:
11r. James E. Shinaver of Nelson & Frankenberger, representing the Saint Elizabeth Ann Seton Parish, has
requested the Board sign the Dedication of Public Right of Way documents presented for approval. These
documents dedicate right of way on 106m Street and on Haverstick Road, contiguous to Church property.
These dedications ",ill result in a total 45-foot north half right of way dedication on l06th Street and a total
40-foot east half right of way dedication on Haverstick Road.
On behalf of the City of Cannel, I would like to thank "Mr. Shin aver, the Saint Elizabeth Ann Seton Parish
and the Roman Catholic Diocese of Lafayette-In-Indiana, Inc. for these Dedications of Right of Way. I
recommend the Board accept and sign these documents.

Soils Information:
Miami silt loam, 2-6 percent slopes- this soil is light colored, silty in texture and on sloping
uplands. It is deep and well drained with moderate permeability. It has moderate available water
for plant growth and a medium organic matter content. It has compact till starting at a depth
between 20- 40 inches, The main soil features that adversely affect urban development uses are
moderate potential frost action, moderate shrinJ.;.-swell potential, moderately slow permeability,
low strength and erosion during construction.
Additional infonnation about soils is available in the "Soil Survey of Hamilton County". The engineer and/or
developer should consider the need for an onsite soi Is investigation.

for distribution at the 6/20 T.A.C meeting. We apologize for the delay in completing ,lild distributing our
written comments.

2. Board ofPl.lblic Works and Safety Approval Requirements:
.. Commercial Curb Cut on 106th Street - The request to the Board for approval of this curb cut
should include a reproducible exhibit showing a) tlle proposed drive and accel/decellanes; b)
opposing drive and its alignment with tlle proposed drive; c) all appropriate dimensions including
proposed drive width, accel/deccl lengths and widtJlS, radii, etc.
. Right of Way Dedication - AdditionallOGth Street right of way commitments will require formal
dedication through the Board.
3. Acceleration/Dcceleration L<mes:
106th Street, in this area, is classified as a Secondary Arterial Thoroughfare. City of Cannel Standards

9, Seems to be an excessive length of drive before inlets (check inlet spacing/capacities). Also looks like
much of grassed area drains to road, but it could be Olat it is intended to go into an inlet. There is no
swale indicated on the West Side of drive
10. Are there provisions to drain the football field?

11. It appears that the left turn lanes on the proposed drive and on Breckenridge Drive align as requested.
12. It also appears that there is construction in Flood Zone B. Have appropriate permits been applied for?
The above comments are based upon the Engineering Dcpartment's initial review, Please provide our
office with a follow-up letter and revised plans indicating all revisions. Second and subsequent reviews
will focus only on revised items. It is critical that our office be made aware of all modifications made on
Ole plans being resubmitted for revicw, particularly if any such changes arc considered "new" or fall
outside of our initial review.

St. EI jzabeth Ann Setoll is bui Id ing a residence for their priests 011 the northeast corner of their site
located in the northeast corner of Haverstick and I 061h Street. YOll previous Iy rev iewed ollr plans; however,
in order to provide greater buffering for the Carolina Commons subdivision to the nOl1h, the rectory was
shifted 30 to 40 feel to the sonth. The revised site plan is enclosed. Please note, however, that the previously
subm itted plans for tree clearing, tree mitigation, and landscaping do. correspond to the enclosed site plan,
with this exception - because of the change in grade, the drive connecting to the circular drive was slightly
extended westward. This may result in some additional tree clearing, with some corresponding savings. In
any event, in order to address the possibi lity that there are some add itional T AC comments, we wi II review
these plans with YOll on July 17,2002. In the interim, however, in order for liS to avoid delay in obtaining
a building permit, it would be mLlch appreciated if you did the following:

Dear Stephen:
As you know, a residence for the priests will be constructed in the nOliheast comer of S1. Elizabeth Ann
Seton located Oil the nOliheast corner of 106111 and Haverstick, at the common address of 10655 Haverstick
Road. The purpose of this letter is simply to confirm, in writing, that the Church will purchase and plant, at a
location reasonably selected by you and intended to provide visual buffering, $3,000.00 worth of long-lived
pine trees. The Church will also cooperate with you in selecting the size and species of pine tree. As you know,
(i) iflarger, more expensive pine trees are selected, then there will be fewer pine trees, and (ii) if smaller and
less expensive pine trees are selected, then there will be more pine trees. In any event, the allowance is
$3,000.00, and the Church will endeavor to obtain the best price.
I think this letter accurately describes the Church's commitment to you. It is what I will file with the
Department and what I will relay to the Board of Zoning Appeals tonight.
