The Burton accessory building petition will not be~Iqntr~~month. The petitioner has
requested that the Item be tabled indefinitely so that ~~~can work with the neighboring
homeowners regarding covenants that may apply to the property.

The Department has not yet taken a position on the matter, because we are still waiting to
receive several items of information that were requested when this petition went to TAC.

Laurence,
I have been contacted by some residents in Brentwood who are concerned
about a petition for a height variance for an accessory building that is
on the board's agenda next Monday. I would appreciate if you would let
me know the staff's position on the petition, and if I could get a copy
of the staff report when it is ready so that I can forward it to my
clients. I will be in the office on Monday, August 19, and then will be
at a land use law seminar in San Francisco the rest of the week. In
addition to e-mail, I can be reached by cell phone at 317-341-0179.

To the Carmel/Clay Board of Zoning Appeals:
With regard to Docket No. V-92-02 presented by Mr. and Mrs. Scott Burton to be heard
at the meeting on August 26, 2002.
The Brentwood Neighborhood Association and its residents are in opposition of this
request. We are concerned that the structure that the Burtons are proposing to build which
would not comply with the standards of the building code would have a profound
negative impact on the property values of the homeowners in Brentwood. Also, we are
concerned about the impact on the esthetics of our neighborhood.
We do not believe that the Burtons desire for an indoor basketball goaL warrants granting
a variance to the building code that would have a negative financial impact on our
properties, Therefore, we are signing this petition requesting that the Carmel/CLay Board
of Zoning Appeals denies the Burton's request.
