Board of Zoning Appeals on July 23, 2002, Docket Number SU 140-02, concerning the 20.68
parcel of Real Estate located North and West of the intersection of West 106lh Street and
Shelboume Road, please find enclosed the Dedication of Right-of-Way, executed by Pilgrim
Lutheran Church, Inc. I am requesting your assistance in presenting it to the County
Commissioners for acceptance, and upon acceptance recordation with the Recorder of Hamilton

(Hereinafter the "Grantor"), hereby gives and dedicates to the Hamilton County Board of
Conunissioners (hereinafter "Grantee"), for public right-of-way purposes only, the real estate
situated in Hamilton County, Indiana, and described in Exhibit "An, attached hereto and made a
part hereof. (hereinafter "Dedication").
This Dedication is made subject to all existing easements and right-of-ways.

Dedication is hereinabove set forth:

Mr. Nelson,
After discussing the right of way dedication with Mr. Mike Howard, Hamilton County Attorney, be indicated tbat the dedication
done with the Brandywine Plat for Sections 3 and 4 was vacated along with the rest of tbe plat. Documents 8729849 and 8729850
indicate that the right of way was vacated at this time. Therefore, we are requesting that the description for the new right of way
include all of tbe property that was thought to have been in place from the Brandywine Plat. Urou have questions, feel free to

This letter serves to acknowledge receipt of a transmittal received 06/04/02 containing the plans
for the above-mentioned project. After reviewing the plans the Highway Department has the
following comments:
1. When construction plans are submitted an Application for Project Review will be neede<l
and the appropriate review fees for a Construction Plan paid, before any approvals will be
granted from this office.
2. In accordance with the Hamilton County Thoroughfare Plan, additional rj~ht of way is
required at the intersection of 106111 Street and Shelborne Road, On 106 Street, the right of
way from the intersection to a point 500' to the west is a 65' half. From that point to the
western property line the right of way is a 50' half. A 50' triangular cut is alsa needed at the
entrance intersections, connecting the right of way for the perimeter streets.
3. Road improvements will need to be made at the entrances and along the entire frontage of
the property. Right and left tum lanes will be required at both entrances. Exact locations and
dimensions will be determined at the time of construction planning.
4. The pavement section for the road improvements will consist of a 14" stone base, 5" HAC
binder and 1" HAC surface.

Therefore, an Outlet Permit is required for tpis project.
2. This watershed has an allowable release rate of 0.25 cfs per acre. This needs to be
addressed in the drainage calculations.
3. There are a couple of existing drainage ways on this site that need to be accomodated.
The drainage for upstream areas will need to be passed through the site.
4. There is an open ditch that is in need of some improvements. Further specifics can
be discussed with future submittals.

Urban Forestry Notes for Carmel/Clay TAC June 19th, 2002
Laura Vista Subdivision (PP)
Open Space Plan: It appears that Open Spaces "A" and "B" have areas 55' by
70' cut at a diagonal along Laura Drive that will be cleared for "landscaping",
These areas should be left natural with the large trees preserved, or the open
space plan should be revised to show those areas as "designed" open space.
The extended driveway and its 24' access easement should be subtracted from
the open space areas. Due to the wildlife in this area, connectivity of the
common areas should be a priority.
Tree Preservation Plan: The 24' wide extended driveway easement should be
moved to the south toward lot 36, so that it does not have to impact the southern
edge of the large woodlands. This would allow an undisturbed corridor of trees
to remain along the southern edge of lot 37 all the way to Vista Drive. If
woodlands are to be preserved along the south side of lots 19,20,21,22,23,24,
and 25, tree preservation easements/covenants should be platted on those lots
and separated from the drainage easements. A preservation easement should
also be considered for lot 18 to connect common area "B" to the existing woods
in common area "A". The type of tree preservation fencing needs to be specified
and should be installed before earthmoving and tree removal begins.
Construction contractors and personnel should receive copies and review the
tree preservation plans prior to the beginning of construction.
Primary Plat: "DU&SE" easements must be separated from common areas and
tree preservation easements. Preserving 20' of trees behind a building limit and
then cutting a 10' drainage swale behind that along the rear lot lines does not
seem to make sense. Cutting the swale injures trees roots and changes the
drainage. It would be better to cut any drainage swales in on the house side of
the tree lines. "Street" tree planting is encouraged, but must be planted outside
the right-of-ways. A landscape plan must be submitted that details landscaping
around monument signs, subdivision entrances, detention pond landscaping, and
any street trees.
Windsor Grove Subdivision (PP/SP Replat)
I have not received plans for this submission yet. Does this extra lot put the
subdivision over the 1 lot per acre average? Will the amenity area be moved or
eliminated?
Keystone Office Park (DP)
Recently large existing trees were removed on the West side of this complex
along Keystone in the 421 Highway Overlay greenbelt without notification to this
office. This issue should be resolved before approval is given to this project.
Existing vegetation to the East side of thiS project should be protected with "tree"
preservation fencing and plan. What is the purpose of the 25' access easement
along the East side of the building?

Plantlngs should be included along the South side of the South parking lot.
Trees in the South parking lot island should be large maturing shade trees, not
ornamental trees. Planting detail1-C6 should say "PLACE ROOT FLARE 1 "-2"
HIGHER THAN FINISH GRADE" instead of "ROOT BALL". General Notes # 6
should cite 1996 edition. General Notes # 14 should include the statement that
all stakes and wires must be removed within one year after installation.
Species comments: an alternative shade tree should be chosen for Acer rubrum
'Autumn Flame', also for the conifer Pinus nigra (Austrian Pine) and Crataegus
crus-gall 'Inermis' (Cockspur Hawthorn) due to over-planting in this area and
disease and insect pest problems.
Carey Lake Subdivision (PP)
Open Space Plan has not been submitted yet. Planting details should require
'Root Flare' planted at grade level instead of 'Root Ball". General Notes # 6
should site the 1996 edition. General Notes # 8 should require that all stakes
and wires be removed within one year of installation. Plant species are
acceptable. This subdivision must meet the landscape buffer requirements in
Chapter 26, and details of tree preservation must be induded in the landscaping
plan. D&U and tree preS8Nation easements cannot share the same space.
Trees cannot be preserved in areas that will be graded (Le. retention pond). The
retention pond can serve as open space equal the percentage it is not bordered
by lots, and it must be landscaped. "Street" trees are encouraged, but must be
planted outside the right-at-ways.
Brandywine Section 3, Lot 35/36 - Church of Jesus Christ of Latter Day
Saints (Parking lot Expansion)
This submission should meet the buffering requirements found in Chapter 26.
Existing landscaping can be used to help meet these requirements. A disease
resistant alternative to Malus 'Indian MagIc' should be chosen from the Indiana
Urban Forestry Council's list of recommended crabapples or chose another
species of ornamental tree. Planting non-disease resistant varieties of
crabapples next to junipers promotes the tungal disease "rust" in both species.
Planting details for shade trees and evergreens should say "PLACE ROOT
FLARE 1 "-2" HIGHER THAN GRADE" rather than "ROOT BALL." Planting Note
# 6 should reference 1996 edition. In the large connected parking lot island, I
would recommend against installation of sod or grass seed. I would recommend
mulching, and possibly installation of small shrubs, or ornamental grasses, or
appropriate ground cover. It will lessen maintenance requirements, and improve
the health of the plant material that is installed.

Pilgrim Lutheran Church (SE conceptual plan)
"Conceptual" plans are difficult to review for landscape requirements. This facility
must meet the landscape buffering requirements found in Chapter 26 of the
Carmel/Clay Zoning Ordinance. There should be more landscaping including
shade trees within the parking lots. Pathways and sidewalks should be
landscaped with shade trees. Any wetlands or riparian corridors and their
vegetation should be retained or mitigated. As more detailed plans are
developed they can be reviewed. A detailed landscape plan including a plant
schedule, planting specifications, planting notes, and showing the minimum
bufferyard requirements must be submitted before Special Use approval.

support services for the District in~house. One of Andy's responsibilities will be
regional coordination with TAC committees such as Carmel's so please be sure to add his

Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the June 19th TAC meeting. Please feel free to copy and distribute this email or

Common Area #4, Windsor Grove Subdivision (Primary Plat Amendment & Secondary Plat -

The developer needs to submit current plans to the District for review. If this replat has
any effect on the existing sewers, then the developer needs to contact the District and
provide plans to review. Building permits should NOT be issued unless the District has
issued connection permits.

Soils Information:
Bmokston silty clay loam- this soil is dark coLored, siLty in texture and on depressional uplands.
It is deep and very poorly drained with moderate permeability. It has high available water for
plant growth and high organic matter content. It has compact till starting at a depth of 40 to 60
inches. The main soil features that affect the urban development uses are seasonal high water
tabLe, high potential frost action, moderate shrink-swell potential, moderate permeability and
ponded surface water.
Crosby silt loam, 0-3 percent slopes- tlus soil is light coLored, silty in texture and on sloping
uplands. It is deep and somewhat poorly drained with slow permeability. It has high available
water for plant growth and medium organic matter content. The soil has compact till starting at a
depth between 20 -40 inches. The main soil features that affect urban deveLopment uses are
seasonal high water table, moderate shrink-swell potential, high potential frost action and slow
permeability.
Additiona.l information about soils is available in the "Soil Survey of Hamilton County".
The engineer and/or developer should consider the need for an onsite soils investigation.
1 have reviewed the plans for this project and have the following comments:
. Future demolition work should include properly capping any existing wells.
. The existing channel south of 106\h S1. is in poor repair. On site storm water detention
and/or reconstruction of the offsite drainage channel should be considered.
