Docket No. 08030001 OA: Qualifying Subdivision Exemptions Amendment, Part n
The applicant seeks to Amend the Subdivision Control Ordinance, Chapter 7:0pen Space
RequirementsJor Major Subdivisions, in order to delete exemptions from the lot area and lot
standards in qualifying subdivisions consistent with Council Ordinance Z-508-07.
Filed by the Carmel Department of Community Services on behalf of the Carmel Plan
Commission.
Last fall the Plan Commission unanimously recommended and the Carmel City Council adopted
Z-508-07, which eliminated the exemptions from the minimum lot area and setback requirements
for lots in Qualifying Subdivisions (ROSO). It has come to the Department's attention that there
is a corresponding section in the Subdivision Control Ordinance which should also have been
deleted; it reads as follows:
7.00.01 Major Subdivisions with community water and community sewer that
meets the Standard Open Space Requirement (SOSR) set forth in Section 7.01
shall be exempt from the area, yard, width, and coverage standards set forth in
Sections 5.04.02, 5.04.03, 6.04.02, 6.04.03, 7.04.02, 7.04.03, 8.04.02, 8.04.03,
9.04.02, 9.04.03, 10.05.02, and 10.05.03 of the Zoning Ordinance, however, the
minimum distance between dwellings shall be six (6) feet.

7 An Ordinance deleting the exemptions for lots in Qualifying Subdivisions from Minimum Lot
8 Standards in the Cannel Subdivision Control Ordinance
9
10 WHEREAS, pursuant to the Advisory Planning Law of the State of Indiana (contained in
II IC 36-7-4), each unit of local government that wishes to adopt land use and zoning ordinances
12 must first approve by resolution a comprehensive plan for the geographic arca over which it has
L3 jurisdiction; and
14 WHEREAS, the 2020 Vision Comprehensive Plan (the "Comprehensive Plan") Docket
15 No. 16-96 CP was given a favorable recommendation by the Carmel/Clay Advisory Plan
16 Commission on August 20, 1996, and duly approved by Resolution No. CC-09-03-96-03 of the
L 7 Common Council on September 24, 1996, and is therefore the official Comprehensive Plan of
18 the City of Carmel and Clay Township; and
19 WHEREAS, the City wishes to maintain an orderly, consistent and streamlined Zoning
20 and Subdivision Control Ordinances; and
21 WHEREAS, pursuant to Indiana Code 36-7-4-701 the Common Council is authorized to
22 amend the. text of the zoning and subdivision control ordinances; and
23 WHEREAS, pursuant to Resolution No. CC-06-18-07-03 the Common Council has
24 determined that certain of the Exemptions to specific regulations are no longer in the best interest
25 of the City and of the public health, safety and welfare; and
26 WHEREAS, pursuant to Indiana Code 36-7-4-610 and City of Carmel Ordinance No. 0-
27 1600-02, the Carmel Zoning and Subdivision Control Ordinances are incorporated by reference
28 into the Carmel City Code;
29 NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of
30 Carmel, Indiana, that, pursuant to IC 36-7-4-600 and IC 36-7-7-700 et seq. and after Docket No.
31 08080001 OA having received a recommendation from the Cannel Advisory Plan
32 Commission on Tuesday, , 2008, it hereby adopts this Ordinance to amend the
33 Carmel Subdivision Control Ordinance (Ordinance No. 2-160, as amended), as amended, as
34 follows:
