Mail & Facsimile (317/915-2201) Dear Mr. Kutz, At the meeting held Monday, August 26, 2002, the Cannel/Clay Advisory Board of Zoning Appeals took the following action regarding the Special Use petition filed by you for property located at 13174 Roma Bend: APPROVED with Conditions: Docket No. SU-147-02, petition for a Special Use per Section 5.02 in order to establish an Amenity Area. The Board voted five (4) in favor, zero (0) opposed, one (1) abstaining, thereby approving the petition with the following Conditions of Approval: L That the Secondary Plat for the Lakes at Hayden Run, Section One (Plan Commission Docket No. 28-02 SP), be recorded and one mylar and three paper copies of the recorded plat returned to the Department of Community Services prior to an Improvement Location Permit being issued for this project; .2. That all outstanding Technical Advisory Conunittee issues be resolved prior to the issuance of an Improvement Location Permit for this project; 3. That Landscape Plan approval be delegated to the Urban Forester, and that such approval be granted prior to the issuance of an Improvement Location Pennit for this project; 4_ That the pool be a minimum of seventy-five (75) feet in length; 5. That the pool be a minimum if thirty-two (32) feet wide (thirty-six (36) feet preferred); and 6. That the pool be a minimum of three feet, six inches (3' 6") in depth throughout ONE CIVIC SQUARE C'\RlvfEL, INDIANA 46032 317/571-2417 o o Page 2 Docket No. SU-147-02 Please be advised that per Section 21.02.07: Time Limit of the Zoning Ordinance, the aforementioned Special Use approval is valid for one (1) year. By that time, either continuous construction of site improvements must be underway, or a written request for a one-time, six- month extension of the approval must have been received and approval granted by this Department.
