'" (J u Carmel/Clay Board of Zoning Appeals One Civic Square Carmel, IN 46032 31 f-:l/ i:'ll.,> "'-'-", -~ ~ '~;~\\ Rt.crNt.\l jl\\\ ~1 1~\l~ U\)c~ January 27, 2003 Members of the Zoning Board: I write this letter as a representative of the Mohawk Crossing Neighborhood and in response to the request by the Carmel Clay Schools for zoning variances for the new additions and building of Clay Junior High School, located at 5151 East 1261h Street in Carmel. The variance in question is the request for the height variance of Section 5.4.1. that states the allowable height is 25 feet for buildings on this property. This request for variance was originally presented to the Board at your September 2002 meeting and spoken passionately in opposition by several members of the neighborhood. Recently the school board invited some neighbors of the neighborhood to a meeting to discuss the project. Many attended with the hope that the school had understood our issues around the height of the bullding and were offering new solutions. Unfortunately, the meeting turned out to be a justification of their original proposal with no identified changes. To summarize the issues that we have as a neighborhood: 1) The height of the building will become a large visible structure, changing from a current height of 25' to 45'. With the additional slope of the property, it will appear more likely as a 47' building from the view of our homes. This in itself will negatively affect property values. 2) In addition to the height, this building will move from being over 270' from our properties to 128'. Not only will the building be large in perspective to surround buildings, but will tower over us. 3) Both the height and the new distance create a third and much larger issue. Today, the Carmel/Clay school system's bus maintenance and parking facility rests right next to our neighborhood properties. The access road that the buses use, tracks along the property line to 126th street. The encroaching noise from the buses is incredible. The noise begins at 6:00 a.m. until approximately 8:30 a.m. and begins again 2:00 p.m. and ends approximately 5:00 p.m. It may be difficult for you to appreciate the magnitude of this daily intrusion, especially on a very quiet morning, but needless to say is not an attractive feature to prospective home buyers. We have invited members of the school board, and also invite you to come witness the noise level to understand what decision you make may mean. With the additional height and closeness to the homes the noise level generated by the buses and traffic will be captured even more and rebounded even more loudly to those of us who live nearby. ......'-.-- ,.-.... l.j u Solutions we have asked the school board to consider seem to fall on deaf ears. These requests have varied from a) moving the new structure to the back of the building, where the structure will be further from our homes, with a natural slope to accommodate some of the height and less a trap for noise, b) move the structure to the front/middle of the building where new space is slated to be added. This space, for administration and library would move to the space requested for the auditorium, c) build a cafetorium, similar to those used in the HSE school district, in the existing space which provides the necessary for programming needs. The reasoning the school gives us for not wanting these options, always seem to boil down to three issues: 1) they want a "gathering" space for the auditorium 2) they want the parking lot right next the entrance - this is so that those attending a performance will not be encumbered to walk 150-200ft down a hall to the performance area, and 3) it is not conducive to educational programming - which when questioned - means that it is not an ideal solution that kids have to walk the band instruments down the hall for practice performances. There are only 5-6 perfomances a year. The rest of the practice will be done in the existing band practice room. We realize there are no "ideal" solutions. There is not enough space. We ask the Zoning Board of Appeals not to encumber our neighborhood. We expect these requested changes to effect home pricing. Realtors have told us that negative pricing in one area of the neighborhood will ultimately affect the entire neighborhood value. Although it seems "reasonable" for the school to want the best for the children - we believe they are doing so with disregard to their neighbors. The suggestions we have asked them to consider does not affect educational value. We on the other hand get to live with these choices 365 days a year - not for 5-6 performances a year. As we have stated before, Mohawk Crossing is a wonderful neighborhood full of families. We are an attractive neighborhood for many reasons, including our proximity to the schools and the way the homeowners maintain their properties. For years we have peacefully co-existed with the school will only minor issues which have been able to be resolved. The zoning regulation is designed to protect the environment of a neighborhood and its property values. Subsequent to that meeting, Carmel Clay Schools has conducted informal discussions with neighboring property owners to reconfirm their concerns regarding the auditorium wall height. As a result of these discussions, revised drawings, which more clearly illustrate all aspects of this Project, including building design, proposed landscaping, and area lighting, were prepared. These materials were reviewed at a meeting held in the cafeteria of Clay Junior High on January 13, 2003. All adjacent property owners were invited to this meeting. The presentation included a chronology of public meetings and design discussion conducted by Carmel Clay Schools starting in December 2000. Adjacent property owners and the community at large have been advised of the proposed project and the design as it has evolved through public board meetings, newsletters mailed to adjacent property owners, and a website which has been on-line since December 2001. Drawings presented at this meeting more fully represented all of the proposed landscaping materials that were a part of the original BZA submission, but were not discussed at the hearing. In addition, an expansion of the storm detention pond (nature lab) at the east side of the facility with accompanying landscaping was presented. The latter was found acceptable with the proviSion that some additional trees would be added on the east side of the pond to provide a visual buffer and that the existing tree line would be maintained if at all possible. A row of Sunset Maples is proposed at the west side of the auditorium and the building elevations include two brick colors to help break up the mass. In addition, new lighting, which was proposed for the west side of the access road has now been eliminated. The elimination of the lighting was seen as a favorable adjustment by most participants and several participants commented favorably upon the massing of the auditorium. Three residents, whose homes immediately abut the west property line and are directly west of the proposed auditorium, were the most vocal in suggesting that the proposed plan does not go far enough in buffering the mass of the auditorium and mitigate what they consider to be a noise problem when busses pass on the access road. Steve Dillon, Principal for Clay Junior High School, explained that the entire staff of Clay Junior High School has spent a great deal of time in investigating the most appropriate design approach for Carmel Clay Schools' middle school students. This analysis includes optimum locations and adjacencies for all functions, both within the building as well as outside. Building additions have been carefully integrated with the existing facility to complement existing educational programs while not over-loading any particular portion of the building site with new construction. The currently proposed auditorium location is the best location to serve Clay Junior High School's educational needs now and in the future. Relocation to the North or South of the building would cause significant additional cost ($200,000 to $400,000), difficulty in maintaining building security for after school events, and possibly requiring relocation of parking areas to the west side of the building. After much discussion one of the neighboring residents suggested that the addition of earth mounding and a greater density of landscaping materials might provide a more effective barrier to the wall and noise. Carmel Clay Schools offered to relocate the access drive at the three affected properties to the east and provide an earth mound with a densely planted, staggered row of spruce trees, that would ultimately grow into a dense visual and acoustical barrier. This compromise was received favorably by two of the three residents directly affected. Carmel Clay Schools promised to develop additional information regarding this compromise proposal and present this option at the January 23, 2003 Board of Zoning Appeals meeting. Carmel Clay Schools believes that this is a reasonable compromise which effectively mitigates the concerns of the three adjacent residents with complaints while maintaining the best educational facility design response for Clay Junior High School students. We have included revised drawings to illustrate this compromise and look forward to presenting this information at the January 27, 2003 BZA meeting. The highest point on the building is approximately 48 feet. 8. State reasons supporting the Developmental Standards Variance: A. The proposed size of the building identification and changeable copy sign is required to provide space appropriate to announce and inform patrons of events scheduled at the school. The proposed size will allow the announcements to be legible by vehicles coming to or passing the project site. The proposed size of 36 square feet is within the total allowable area for both changeable copy and institutional signage of 46 square feet. The changeable copy area of 24 square feet exceeds the allowable of 16 square feet. Due to the height needed for the lettering, the overall height of the proposed sign of 6'-2" exceeds the allowable height of 5'-0" The overages noted are very close to the ordinance requirements, and would not negatively impact the area, while providing legible copy for patrons. B. The size of the directional traffic signage is required to provide legible information to direct patrons, visitors, buses and service vehicles to the appropriate drives, parking areas and building access points. C, A full-service 6-8 Middle School includes gymnasiums, an auditorium, and other spaces, which require volumes in excess of 25 feet to meet program requirements. u u n '. We suggest that the Carmel Clay Schools look for and present alternatives to this Board for this school expansion. Some ideas that we suggest: 1) The NE portion of the school is already a two story structure of classrooms. The natural drop off of the land at this portion would provide the type of height needed for an auditorium. Place the auditorium in this portion of the school and relocate these classrooms to a new structure to be built on the property west of the current cafeteria, but within the 25 feet height regulations. 2) Dig down to minimize the height variance. This may come as an additional expense, but the school is trying to create a large building outside the zoning regulation at the expense of our home and personal values. 3) If Carmel Clay Schools is insistent upon a 45 feet building for an auditorium, locate this to the north size of the current building and east of the current tennis courts.
