The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the siqn will be located 5 feet behind the line of the 96th Street riqht-of-wav line extended. which would exclude the unused riqht-of-wav which was taken for the relocation of 96th Street under 1-465. a proiect that is no lonqer planned. A Consent to Encroach has been approved by the Carmel Board of Public Works and Safety 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the sign is small of size and small of heiqht and is architecturallv compatible with the USTA buildinq, 3, The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the tenants of the buildinq need identification on 96th Street for visitors who have identified their presence from 1-465. This qround siqn is necessary to quide the travellinq public to the correct buildinq access point on 96th Street in a safe manner. (Petitioner or his representative to sign). 109694Bv1 Page 8 of 8 - z:\5hared\form5\BZA applications\ Development Standards Variance Application rev. 01/1 112008 U D D U U U [j STATEMENT OF VARIANCE The proposed monument sign location is situated in front of the multi-tenant office building owned by Midwest Youth Tennis Association (the "Petitioner") and located at 1310 E. 96th Street. The real estate on which the sign is proposed to be located, along with nearly an acre of additional real estate, was dedicated for right-of-way in 1995 for the possible relocation of 96th Street under 1-465. This relocation option is less probable because of the construction of the Monon Trail. Because the real estate is considered public right-of-way, the site on which the sign is proposed to be located is not zoned. Therefore, there are no specific sign standards applicable to this proposed sign. The Petitioner and the Staff of the Department of Community Services have determined and agreed that two development standards variances are required for the proposed monument sign: (1) a variance of Section 25.07.01-04(i)to allow a sign to be located in the street right-of-way; and (2) a variance of Section 25.07.01-04(1) to allow a sign to be located off-premises. ~1 U U u 11. U D D o o [J D D D o o o o o U D D D D U o U o U o [J D U STATEMENT OF SUPPORT Midwest Youth Tennis Association (the "Petitioner") developed and constructed a multi- tenant office building on property purchased from Five Seasons Sports Country Club. Prior to the sale of the site to Petitioner, Five Seasons conveyed a large tract of land immediately adjacent to the then abandoned Monon railroad for right-of-way to accommodate a possible relocation of 96th Street under 1-465. Consequently, Petitioner was unable to acquire frontage immediately adjacent to 96th Street to locate a monument sign to identify the tenants in its multi-tenant office building. With the establishment off the Monon Trail, the relocation of 96th Street under 1-465 and over the Manon Trail is extremely remote. There are three tenants in the Petitioner's office building located at 1310 E. 96th Street: UST A Midwest Section, First Merchants and Raymond James. Only UST A Midwest has a wall sign facing 96th Street but due to the configuration and layout of the building, it is oriented to the southwest, which causes limited viewability for west bound traffic on 96th Street. First Merchant's and Raymond James do not have any signage visible from 96th Street to direct customers to their offices. The proposed ground sign will give all three tenants some modest identification along 96th Street so that visitors to these businesses will be more readily able to identify which building along 96th Street they are located in and will increase traffic safety along this section of 96th Street as these potential visitors to the building attempt to find their destination. Owner acknowledges that this Agreement does not imply nor constitute the approval of any existing or future improvements not indicated by Owner on Exhibit "B"; and WHEREAS, the location of the Improvement, as indicated by the Owner on Exhibit "B" should not materially interfere with the City's use ofthe Right of Way; NOW, THEREFORE, for and in consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the sufficiency and receipt of which are hereby acknowledged, the parties mutually promise, agree and covenant as follows: 1. The foregoing preambles, recitations and definitions are made a part hereof as though they were fully set forth herein. 2. The City consents to the Encroachment for only so long as: (i) the Encroac1U11ent exists; and (ii) Owner complies with all ofthe terms and conditions of this Agreement. 3. qwner covenants and agrees not to extend, increase, modify, alter, reconfigure or otherwise change the Encroachment Area and/or the location of the Improvement from what is depicted on Exhibit "B". 4. Owner agrees to reimburse City or Third Party for any and all costs and expenses incurred by City or Third Party for any and all costs and expenses reasonably incuned by or on behalf of City or a Third Party to replace, repair or cure any damage to any or all of the Right of Way and/or to any improvements located therein caused in whole or in part by the installation, construction, maintenance, il U U o o u u u removal, repair and/or operation of the Improvement. 9. Owner agrees to record this Agreement in the Office of the Recorder of Hamilton County and to provide to City with a recorded copy of same within ten (l0) business days from the effective date of this Agreement. In the event this Agreement is 110t timely recorded by Owner, Owner agrees and consents to City recording same, at Owner's sale expense. 10. The parties hereto agree that the terms of this Agreement shall be binding upon and inure to the benefit of their respective successors and assigns. '~1 U U o U 11.
