Use Variance Application u u Petitioner: Carmel Clay Historical Society FINDINGS OF FACT - USE VARIANCE 1. . The purpose of the Society's present facility at 211 First St. SW is to document, preserve, interpret and present the local history of Carmel and Clay Township, which activity the Society has been engaged in since 1980 without any complaint by adjacent or otherwise nearby property owners, 2. The Society's facilities (structures, grounds), programs and activities provide an essential cultural attraction for Carmel and Clay Township residents and visitors to Carmel and Clay Township. 3. The presence of the Society's facilities and activities reflect and in some manner continue activity that has occurred for over a century at the site; current adjoining propeliy owners have taken that into consideration without complaint in owning their properties, as have previolls OVv11ers of adjoining properties. ;;; 4. The positioning of the plmmed new structure is necessary because of the specitlc nature of its pImmed use (1) in relation to the existil~~g structure used as an office and archives facility, and, (2) so as not to restrict the use or appearance of the historic Depot Museum. , ~. 1 '\, 5. The planned new structure is an enhancement of the multifaceted services which the Carmel Clay Historical Society provides to the Carmel and Clay Township community. u u Statementilf Use Variance As regarding ZO 8.1, request permission to construct a 648 square foot public museum expansion in an R.1 District. Statement of Support The proposed structure would be located on the present property of the Carmel Clay Historical Society (CCHS) which has maintained three structures (the Monon Depot Museum, an administrative facility, and a small storage barn) and professionally designed flower gardclls on the site since 1980, sincc then surrounded on three sides by residences, and since then open to the public. During the period 1980 to present, no objection has come to the attention of the CCHS regarding the presence ofthe Society's facilities or programs involving Society staff, volunteers or visitors. The proposed structure will permit the Society essential, conservation-oriented storage space for a growing collection of rare manuscripts, photos and other paper and book materials, antique clothing and small artifacts. The variances requested will assure the continuance of the Carmel Clay Historical Society's service to the Carmel Clay community by allowing for more secure and conservational1y correct storage area for the Society's growing collections of manuscripts, photographs, artifacts and other items of historical value. The Society has been engaged in such work since its occupancy of the Monon Depot Museum in 1980 without any complaint by adjoining or adjacent property owners or occupants. 2. The immediate area surrounding the Society's property, which include a museum, archives, office and public meeting facility, will not be affected adversely but rather enhanced by the cultural benefits of the Society's ongoing work which will be conducted in the new structure for which this variance is requested. The proper upkeep of the Society's property, including three season flo\ver gardens overseen by the organization GreenSpace, and the architectural uniqueness of the Society's structures are all important presence in the neighborhood. The present activity on the Society's grounds continue 3 century of similar activity (the maintenance of a pubIic facility formerly for railroad passengers and customers) by presenting for the public a museum of local history with several varied educational programs. 3. The strict application of the terms of the Zoning Ordinance to the Society's property will result in practical difficulties because the new building planned must be located as indicated on the attached site plan so that it can be used in close conj unction to the existing structure used now as the Society's office and present archives. Professionally proper conservation of historical materials such as the Society's collections require that such materials be in close proximity to both supervision, when used for research, and that transp0l1 of such materials be under protective conditions, hence the necessity of having the new building very close to the CCHS office. Furthermore, location of the new building elsewhere on the Society's grounds would (1) endanger a mature shade tree, (2) come in conDict with the placement of electric lines (pole) to the property, and (3) obscure the front of the Depot Museum which faces east (although the street address IS based on location on the street (First St. SW) on the north side of the museum). ... u u Statement of Developmental Standards Variance As regarding ZO 8.4.3(A), permission to decrease the size of the five (5) foot side yard requirement. Statement of Support The positioning of the planned structure according to the best and intended use of the structure results in less than a five (5) foot side yard, but the side yard area which would be occupied by the new structure is along side the Manon Trail Greenway and is, in fact, several feet west of the fence which the Carmel Parks Department has installed to mark public access to the walking trail. Statement of Support Parking space on the Society's groiInds is limited due, in p81t, to the unique access (by way of a shared driveway) to the property. Parking on the property has been limited to staff and volunteers and consists of, at most, tluee spaces. This will continue in regard to the planned new structure. Parking for the general public is available at the adjoiping Manon Trail Greenway trallhead which occupies part of the area used by the Society for parking before the Trail was constructed. The trailhead parking facility adjoins the Society's property and the Depot Museum walkway intersects with the Trail.
