Petitioner seeks a Development Standards Variance of Section 14.04.02(2) in order to
construct a building addition with a thirty-foot (30') front yard building setback along
Bauer Drive East.

At the Monday, November 25, 2003, meeting, the Board tabled this Item to the January
27,2003, agenda to give the Plan Commission the opportunity to consider the Development Plan
Amendment for this site. The Public Hearing has been closed, and this Item should have been
placed under Old Business.
The Plan Commission is currently considering Docket No. 140-02 DP Amend/ADLS
Amend for this site. At the Tuesday, November 19, 2002, meeting of the Plan Commission, the
Item was referred to the Tuesday, December 3, 2002, meeting of the Special Study Committee.
The Special Study Conunittee continued the petition to the Tuesday, January 7, 2003, meeting,
where the revisions received a Favorable Recommendation with Conditions to the full Plan
Commission. At the Tuesday, January 21, 2003, meeting, the Plan Commission approved the
Development Plan Amendment and forwarded the ADLS Amendment back to the Tuesday,
Febmary 4,2003, meeting of the Special Study Committee.
The Department recommends favorable consideration of Docket No. V-181-02 with the
following Conditions:
1. That the 75-foot half right-of-way for East 96th Street will be dedicated in
accordance with the Thoroughfare Plan prior to the issuance of an Improvement
Location Permit for the building addition, and
2. That all Technical Advisory Committee issues will be resolved satisfactorily prior
to the issuance of an Improvement Location Permit.

Motorcycles of Indianapolis (Amended Development Plan)
The site is located at 4146 East 9qtlr Street. The site is zoned B-3IBusiness.

Bill Keller passed around the room prints of the front of the building. The site is on the north side of the street
adjacent to the Honda Dealership. At one time it was the Dellell aIds and Mercury Dealerships. It is at 96th Sb:eet
and Bauer Drive across from Precedent Office Park in Marion County. The existing building is approximately
22,400 SF and was built in 1996. It will be a show room and service facility for motorcycles. The project we are
completing this time is:
1) we would like to change the front canopy of the building to something a little more stylish. We would like to
build a new canopy on the west side of the building fora cover over the motorcycles. One of the problems
presently, is the service area is small enough that once the motorcycle is fmished,there is no place to put it. They
have to leave it outside. \-Vhen an ovmer comes in to pay a "$1,000" service bill, they don't want to see their
possession left in inclement conditions. Mr. Dellen would like to build a canopy of about 3,000 SF on the west side
of the building for the convenience of the customer.
2) The next portion of the proJectis a small office addition to the building on the east side. This would be between
Bauer Drive East and the building itself The Dellens operated their automotive group out of an office in the Honda
Dealership. They still 0\V11 the building but lease it all out to Honda. They would like to be at their facility and
operate in their main headquarters. It will consist of approximately 2400 SF. This' will be a one-story office for a
few executives and support staff. The flavor of the building is going to change a little because ofthe canopy. The
canopies are going to be arched, curved, and a little higher in elevation than the existing canopies. No change in the
sign on the building. There is one street sign out front. The architecture for the office addition (the building is a
split face masonry block) will be consistent with the windows to matCh the existing facade. We bounced around a
bit with the colors. They have decided to stay the same. Essentially, the building is a dark brown painted block. It
might be a shade lighter. The canopies will bea bronze color. No new parking. When the dealership was sold, the
buildings were retained. They built a masonry wall around the west and north sides of the "motorcycle property".
They built the wall for leasing purposes. The masomy wall is 8' high and separates the two facilities. We will be
losing five parking spaces on the east side with the addition of the office and eight spaces on the south side with the
revised canopy. We have some parking we did not use before; thus, we still meet the requirements for parking
spaces. There are no new drainage structures. The landscaping is in place except for some low lying planting along
96th Street and a small amount along Bauer Drive which was planted but did not survive when stTeet was widen the
last time. Wilen snow gets plowed, the area sits under the "snirt". They are more than willing to put those back in
ahd they will match the landscaping around the building.

Dick sent a letter to Bill. I could not tell the scope of the project but now you have explained it. Normally we need
more than is shown on the plans. We should have a civil drawing. We have a survey now and more is canTIng. I
should have a full report to you next week. There is a slight change in the drainage. Everything is paved; we are not
adding any paving. We will do the calculations. The only change would be to take a little drainage on the southeast
corner of that addition to get it out to the parking lot.
Steve, I will defer to Jon my question regarding the right-of-way on 96th Street. In my letter to you are the
thoroughfare requirements.
Bill, I am aware that the survey picked up the actual line and we have not updated this drawing. It will be on the
civil drawing. There is a comer jog for the right-of-way but we have the correct line now. The line shown on the
east side is the 75' line from the center. It is 144' from the right-of-way line to the front of the canopy.

Steve, the only other issue on drainage is the asphalt path. I understand the swale is no longer there and is closing
off. There is sidewalk along this area.
Jon, we might ask for an additional right-of-way at the corner. We need to get the information before you go before
the Board of Zoning Appeals. This would be parallel to road and a corner cut at the intersection. This would not get
into your improvements. Be sure to get with engineering and let them know you will be looking for a response. The
petition you will have in front of the Plan Commission in. November will be on the ADLS Amendment. The
variance on the setbacks at Bauer Drive to the building will be at the BZA meeting in November.
Scott would like a set of revised plans. We ad:. YOllto restore what landscaping has been lost over time.
John South, due to the small area of construction, erosion control is not a major issue.
Gary faxed a letter requesting a Knox Box.
Bill Keller has a Knox Box there now on the ~ast side of the building, If you want it relocated, please let us know
what location would be best. Gary confmns it can be left in its current location.

Jon, the need for the. civil drawing to identify the setbacks . and the potential for the dedication of right~of-way at the
comer should be submitted soon. Other than that you have described some of conditions adequately. You will need
to submit plans or renderings of the building elevation with the proposed colors to the Plan Commiss'ionon this
ADLS Amendment.
Bill Keller questions Jon about the q.epartment letter:. you state the publication should be in the Indianapolis Star
only and it is only for the Variance request. Jon notes this is correct.

The applicant seeks Amended Development Plan and ADLS approval to construct building
additions. The site.is located at 4146 East 96th Street. The site is zoned B-3 (Business).

Bill Keller ofKES Consuitants, 740 East 52nd Street, Indianapolis, appeared before the Conunission representing the
applicant. The petitioner is proposiiig a revision to a portion of the building as well as two additions. A canopy is
proposed to the southern portion of the building and revisions to the existing canopies. The site is sunounded by
96th Street to the south, Bauer Drive, and Lakeshore Drive to the east and west.
The building complises approximately 22,000 square feet with large windows on the south and portions of the east
and west elevations and will be used for sales and service of motorcycles and smaller, all-terrain vehicles.
Formerly, the Dellen Automotive Group had their offices in the building presently occupied by Honda. The plan is
to relocate the business office to the east side of the building. The offices would accommodate 4 executives and a
small secretarial staff. The windows on the offices will match the existing. The large canopy on the west side of the
building offers protection for motorcycles that have been serviced and awaiting pick-up. Mr. DeIlen would like to
change the existing canopy to the front to a curved canopy to match the canopy planned for the west side. The
canopy will project approximately 15 feet from the building. The color of the buildingviill be essentially the same;
the color of the canopies will also be the same. The metal finish is a standing seam fascia.
Parking on the site is currently adequate and will accommodate the expansion and comply with the Ordinance. The
drainage issues have been addressed-there is no change in the drainage pattern. Neither lighting nor signage will
be changed at this time.
The landscaping to the front of the site was destroyed by street widening, and tIns will be replaced in kind. The
landscaping will match the existing planting area around the offices.
Members of the public were invited to speak in favor or opposition to this petition; no. one appeared and the public
hearing was closed.
Jon Dobosiewicz reported for the Department. In addition to approval being sought for ADLS and DP Amend, the
petitioner has filed and wiIl be appearing before the Board of Zoning Appeals requesting a variance for the setback
of the proposed building addition. The Department is in favor of the petitioner's request, but asks that the Plan
Commission consider approving the Development Plan Amendment portion of tius petition and forwarding the
ADLS portion to the Special Study Conuruttee for consideration on December 3rd
Ron Houck asked about the petitioner's commitment to replace the landscaping destroyed by the widening of the
street, but there were no details included in the information packets. Is there a landscape plan in existence? Also, in
the information provided, there is a reference to incorporating the building design into ground sign design. Will this
be addressed under the ADLS review?
Jon Dobosiewicz responded that the landscape plan WaS not as detailed as it could have been, but it did indicate the
replacement of shrubs taken out along the 96th Street frontage. It is preferable to have the Committee explore a
concept that would tie the existing ground sign into the building design. No permit has been issued for a sign;
currently, the copy has been changed on the sign without a permit.
Mr. Keller said he has recently been made aware of the sign situation. The dealership has severed the relationship
with the companies listed on the sign and their names have been removed.
Wayne Wilson refened to the canopy and asked ifthere were outside storage for motorcycles.

Mr. Keller reiterated that there is no provision for outside storage after hours. The canopy is merely to provide
coverage for those motorcycles that have been serviced and awaiting pick-up in daytime hours only.
Nick Kestner asked the pUl:pbse for the canopy'20 feet beyond the building and whether or not it would be used for
additional showroom display. Mr. Kestner also asked the petitioner to submit "3-D" building elevations at the
Committee level---it is now difficult to visualize.
Mr. Keller said the space is not used for vehicles. There are times when rallies are organize.d 'and. iUs a gathering
place that provides shade.
There was discussion as to whether or not the Development Plan should be approved this evening Without tying it
into the ADLS package. It was detemlined that the ar,Ghitectural design of the canopies and building should be
frniher reviewed by the Special Study Committee.
Docket No. 140-02 DP Amend/ADLS Amend, MoJorcycles of Indianapolis, was referred to the Special Study
Committee for further review on December 3, 2002 at 7: 00 PM in the Caucus Rooms of City Hall.

The 2300 square foot office addition will be on the east side of the building and will reduce the side yard depth to 30
foot. The additional office space will be used for corporate offices and will match architecturally with the rest of the
building. Neighbors are all commercial, therefore no detTUnent to the neighborhood.
Members of the public were invited to speak in favor of or opposition to the petition. No one appeared and the
public hearing was closed.
Mr. Lillig gave the Department Report. The Plan Commission is considering Docket 140-02 DP/ADLS Amend. At
the Tuesday, November 19 meeting the Plan Commission referred the item to the December 3 meeting of the
Special Study Connnittee. Since this petition affects the site plan rather than an aspect of the ADLS, the Depaltment
has placed it on tonight's agenda. The Department IS recommending favorable consideration of Docket V-181-02
with two conditions. First, that the right~of-way for East 96tb Street will be dedicated in accordance with the
Thoroughfare Plan prior to the issuance of an lmprovement Location Permit for the building addition. Second, that
all Technical Advisory Committee issues will be resolved satisfactorily prior to the issuance of an Improvement
Location Permit.
Mr. Keller stated they have no objections to the conditions. He believed the right-of-way had already been dedicated
to meet the thoroughfarerequiremerits. The site plan has been altered afi;er doingxesearch ob the records:
Mrs. Rice stated th.at the Plan Commission did not separate out the two becailse the site plan and the ADLS would
affect each other.
Mr. LiHig stated this Board would essentially be giving the Plan Comrrtission the room to work with the petitioner
within that additional 30 feet of front yard along Bauer Drive East. It doesn't affect the Plan Commission's ability to
affect the ADLS because they stll1 have DeviHopmemPlan control over this site. They would still have the authority,
lmder the Development Plan, to decide something between 30 and 60 feet as being appropriate for this fi-ont yard,
Mrs. Rice stated that it s.eemed like tbls Board was being asked to do something that the Plan Commission wouldn't
consider until they had seen the whole plan.
Mi-, Lillig stated that the Department bad recommended that the Plan Commission consider the ADLS and the
Development Plan aspect be considered separately, which wOilld put things in the normal course. If the Board is
uncomfortable with this' variance, it could be tabled until the Plan Commission has rendered its decision.
Mr. Weinkauf felt the ADLS concerns. needed to be taken care of before this Board voted on this petition.
Mr. Weinkauf moved to table V481.;oi Bailer Commercial Park - Motorcycles of Indianapolis until all ADLS
concerns are met The motion was seconded by Mrs. Rice.
Discussion followed about the right-of-way dedication and approval of this variance. This variance would put
everything in place for when and. if the Plan Commission approved the Development Plan.
The motion to table V~181-02 was APPROVED 3-1, with My. Dierckmancasting the opposing vote.
