Reports, Announcements, Legal Counsel Report and Staff Concerns: J. Public Hearing: 8-10j. Clay Terrace PUD (V-185-02; V-186-02; V-187-02) Petitioner seeks the following Development Standards Variances: V-185-02 §25.7.03-03(c)(2)(ii) 128-square-foot real estate sign V-186-02 §25.7.03-03(d)(2) ten-foot tall real estate sign V-187-02 §25.7.03-03(h) illuminated real estate sign The site is located southwest of East 146th Street and US 31. The site is zoned PUD/Planned Unit Development. 25.07.03-03 Real Estate Signs. c) MAXIMUM SIGN AREA: 2) Business and Manufacturing Zones - maximum sign face area (both faces, if applicable): ii) for a lot greater than five (5) acres in area shall be Thirty-two (32) square feet. d) MAXIMUM HEIGHT OF GROUND SIGN: 2) Lot size five (5) acres and over: Eight (8) feet. h) ILLUMINATION: Not permitted. Section 25.07.03: Temporary Signs states, “Temporary sign permits can be issued for no more than one (1) year's duration, but may be renewed, unless otherwise prohibited.” Given the size of the proposed sign (10 feet tall, 128 square feet in area - four times the area allowed), the Department recommends that the Board establish a five-year limit on the renewal of the Temporary Sign Permit, and require that the petitioner return to the Board at that time (no later than the November 2007 meeting of the BZA) if they wish to extend the approval. The Department recommends favorable consideration of Docket Nos. V-185-02; V-186- Carmel/Clay Advisory Board of Zoning Appeals November 25, 2002 Page 2 of 2 Page 2 02; and V-187-02 with the following Condition: 1. that the approval is granted for a period of five years, and the petitioner shall return to the BZA no later than the November 2007 meeting if they wish to renew.
