V-188-02; V-189-02; V-190-02 Dear Laurence: I have reviewed the Letter of Grant that you issued for the above-mentioned variance petitions and thought that I should get clarification with regard to one item. In the letter you included a paragraph pertaining to Section 30.5.5. You state that, "approvals are valid for one (1) year." Actually, Section 30.5.5 states that any permanent variance "shall be effected or shall be part of a project on which continuous construction has commenced within one (1) year from the date of the granting of said variance or it shall become null and void" (emphasis added). Our understanding is that our variance approvals will be "effected" by the issuance of an Improvement Location Permit for at least one of the signs approved by the variances. As long as said sign is constructed and ;nstalled, our variances become valid and permanent, thus allowing us to install signs and replace signs over the coming years as long as they are in compliance with the variances and the ADLS Sign Program approved by the Commission and the appropriate permits are obtained. I would appreciate it if you would confirm in writing that our understanding is correct and also whether or not you would consider the i1Hylant Group" sign to be the sign/permit that "effected" our variances.
