Eric Seidensticker ORDINANCE D-1888-08 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA, ADDING CHAPTER 8, ARTICLE 5, SECTION 8-48 (a) (4) TO THE CARMEL CITY CODE WHEREAS, the City of Carmel, Indiana (`City") has the authority to establish parking regulations within its corporate boundaries: and WHEREAS, the City now finds it necessary and appropriate to amend City Code Section 8-48 by adding subsection (a)(4) thereto, so as to allow Carmel Arts and Design District merchant vehicle parking in the parking lot located behind the Lion's. Club building located at 141 East Main Street Carmel, Indiana. NOW, THEREFORE; IT IS AGREED AND ORDAINED, by the Common Council of the Citv of Carmel, Indiana, as follows: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. Section 8-48 (a) (4) is hereby added to the City Code and shall read as follows: "(4) The parking lot located behind the Lions Club building located at 141 East Main Street, Carmel, Indiana, the same being roughly east of 1s' Avenue S.E., south of East Main Street, west of Bryn Mawr Lane and north of 2nd Avenue S.E. A three-hour parking limitation shall apply to this lot between the hours of 6:00 a.m. EST to 6:00 p.m. EST daily. However, notwithstanding the above, parking may be further restricted in this lot during certain Lion's Club meetings and events, at which times the public parking signs located in the lot shall be masked in a manner approved by the Carmel Police Department for the duration of the meeting or event only." Section 3. The Street Department is directed to promptly install appropriate signage consistent with this ordinance. Section 4. All other current provisions of City Code Section 8-48 shall remain in full force and effect and are not affected by this Ordinance. Section 5. All prior ordinances or parts thereof inconsistent with any provision of this Ordinance are hereby repealed, to the extent of such inconsistency only, as of the effective date of this Ordinance. However, the repeal or amendment by this Ordinance of any other ordinance does not affect any rights or liabilities accrued, penalties incurred or proceedings begun prior to the effective date of this Ordinance. Those rights, liabilities and proceedings are continued and penalties shall be imposed and enforced under such repealed or amended ordinance as if this Ordinance had not been adopted. Section 6. If any portion of this Ordinance is for any reason declared to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this Ordinance so long as enforcement of same can be given the same effect.
