The following are the sections of code in violation: (1) §6-222 (a) 4 Vacant structures and land. All vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure, healthful and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety or violate the provisions of this Code. (2) §6-222 (b) 1 Sanitation. All exterior property and premises shall be maintained in a clean, safe and sanitary condition. The owner or occupant shall keep that part of the exterior property, which such occupant occupies or controls in a clean and sanitary condition. (3) §6-222 (c) 1 General. The exterior of a structure shall be maintained in good repair, structurally sound and sanitary so as not to pose a threat to the public health, safety or welfare. (4) §6-222 (c) 2 Protective treatment. All exterior surfaces, including but not limited to, doors, door and window frames, cornices, porches, trim, balconies, decks and fences shall be maintained in good condition. Exterior wood surfaces, other than decay resistant woods, shall be protected from the elements and decay by painting or other protective covering or treatment. Peeling, flaking and chipped paint shall be eliminated and surfaces repainted. All siding and masonry joints as well as those between the building envelope and the perimeter of windows, doors, and skylights shall be maintained weather resistant and water tight. All metal surfaces subject to rust or corrosion shall be coated to inhibit such rust and corrosion. Oxidation stains shall be removed. All exterior surfaces shall be of uniform colors and materials to ensure compatibility with adjoining properties. (5) §6-222 (c) 5 Exterior walls. All exterior walls shall be free from holes, breaks, and loose or rotting materials; and maintained weatherproof and properly surface -coated where required to prevent deterioration. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and down spouts shall be maintained in good repair and free from obstructions. Roof Drain discharges shall be discharged as a Legal Connection or a Legal Discharge. Inappropriate or temporary roofing coverings including but not limited to tarps shall be deemed inadequate protection and not uniform and as such shall be prohibited for a period exceeding seven (7) consecutive days. (7) §6-222 (d) 1 Accumulation of Rubbish or Garbage. All exterior property and premises, and the interior of every structure, shall be free from any accumulation of rubbish or garbage. Prohibited property conditions include those conditions defined by Chapter 6, Article 5, Division I Public Nuisances of the Carmel City Code. (8) §6-222 (c) 12 Window, skylight and doorframes. Every window, skylight door and frame shall be kept in sound condition and in good repair. (9) §6-222 (g) 3 Interior Surfaces. Floors, walls (including windows and doors), ceilings and other interior surfaces shall be maintained in good, clean and sanitary condition. Peeling paint, cracked or loose plaster, decayed wood and other defective surface conditions, including mold spores, shall be eliminated. (10) §6-222 (g) 6 Free from Dampness. In every building and all portions of the building including, but not limited to, basements and crawl spaces shall be maintained to prevent conditions conducive to mold formation, decay or deterioration of the structure. §6-88(c) Requirement to cut. All owners of real property ("property") located within the City shall cut and remove weeds and other rank vegetation growing thereon that exceeds an average height of six inches, and shall keep their property clear of debris. §6-77(k) Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, machinery, dead trees, or parts thereof, upon any premises in a residential area. Please make the required corrections and/or repairs to the structure by July 31, 2007. Failure to comply will result in further enforcement action. Another full month has passed and your only tangible accomplishment to date is sending a kid to haphazardly knock down some weeds and tall grass. Congratulations. Your property in Williams Ridge Estates is a disaster, a danger to my children, a blight on an otherwise beautiful neighborhood, and is harming my property value. The neighborhood wants the problem resolved. The City of Carmel wants the problem resolved. Any caring person would want the problem resolved. It seems the only person that does not want the problem resolved is you, as evidenced by your blatant disregard of the Carmel Code Enforcement Officer's letter of 6/27/2007. KNOCK THE HOUSE DOWN AND CLEAR THE LOT NOW. I do not profess to speak for the other families in the neighborhood. In the unlikely event that you give a rat's ass about anyone beyond the end of your own nose, I suggest you poll them directly. While this may just be `business" to you, realize that your inaction is negatively impacting other people's lives. Be a man and do the right thing. Neighbors are frustrated that the blackened and boarded remains are still standing, in The home at 11640 Carriage Lane, just north of 116th Street between Keystone Avenue and Gray Road, was being built by SLM Homes LLC in October when fire damaged the structure beyond repair. Brennan said the next step could be to issue citations for each code violation, which carry a fine of $270 each. Or he could require the property owners to appear in City Court. Brennan said he would like to talk to the Weisses before deciding which route to take, adding he's had "zero success" in reaching the owners. In a letter to the Weisses, neighbor Kurt J. Ridder strongly encouraged the property owners to take immediate action. Williams Ridge Estates is a one -street neighborhood with a cul-de-sac that includes four other occupied homes. Ridder said nine children under the age of 10 five on Carriage Lane. "This truly has been a disaster," Ridder said. "We're concerned about safety of our kids, because this poses a tremendous hazard to them. It's a huge temptation for them, but so far they've been realty good about listening to Mommy and Daddy and staying away from there." v The Weisses could not be reached for comment, but they did respond to Riddees letter in June. They apologized for "any delays or inconveniences as a result of the fire." "We have worked together very diligently to gel this resolved and move forward," read 't the letter dated June 29. Neighbors have contacted John Accetturo, a Republican who was elected to a City I t'l Council seat in May. He said it shouldn't have taken complaints from neighbors to spur the city into action. 'This is a safety hazard for the children in this neighborhood, and it shouldn't be the residents' job to try and enforce the code and get the place cleaned up," Accetturo said. Brennan said his job is reactionary and he depends on residents and city officials to notify him about problems. He learned of the Weisses' home in June. "This is seriously unusual," he said. As you can imagine, the present state of your home site has become quite the topic of discussion among the four families currently living in Williams Ridge Estates. It's been nearly nine months since fire destroyed your house under constriction on lot #2, yet the lot and structure remain untouched. Between our four families in Williams Ridge Estates, NNv have nine young children: 1. Alain - age 3 2. Hope - age 3 3. Isabella - age 4 4. Kate - age 5 5. John - age 5 6. Marcus - age 7 7. Erica - age 8 8. Francesca - age 8 9. Grant -age 10 The condition of your home site poses a tremendous hazard to our children and the children in the adjacent neighborhoods. It is also a huge temptation to them. The home site draws considerable "looky-loo" traffic on our otherwise quiet cul-de-sac, creating further danger to our children. It's also been a nine -month eye -sore for our families and would negatively impact the value of our homes in the event any of us were to list one for sale. In discussion with Steve Moed, we have learned that the insurance company has settled your claim and that you have yet to accept payment and move forward with demolition and rebuilding. That, quite frankly, is unacceptable and the time has come for you to take immediate action. The four families living in Williams Ridge Estates respectfully request that you take immediate action to have the structure demolished and the lot cleared. We apologize for any delays or inconveniences as a result of the fire. Steps have been taken to clean up Lot 1 and the work on Lot 2 will begin shortly. This has been a difficult matter for everyone involved. There are several complex issues which we have had to address which have created delays through no fault of the parties. We have worked together very diligently to get this resolved and move forward. We have just resolved all of the issues. The insurance proceeds have not been received, but we are hopeful that this will occur very soon.
