We offer the following comments: GENERALINFORMA TION 1. These comments represent the Department of Engineering's first review of the construction plans for this project. We reserve the right to provide additional review comments as detailed construction drawing are developed for this project. 2. We request that all responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly ifany such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans including all revisions. Please notifY us of any changes and specifically state any changes, including changes resulting from Plan Commission. BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review a]] drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. .5. Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. Digital submissions have been received. f. All fees paid. 6. The Departmentreserves the right to provide additional comments based upon subsequent reviews. 7. An approved Storm Water Man.agement Permit is required prior to commencing any earth disturbing activity. 8. An approved right-of-way permit is required prior to commencing any work in the public right-of-way. 9. If it will be necessary to relocate existing utilities, the costs for such relocations are to be borne by the developer. Ifnecessary to relocate existing utility poles, they must be moved to within one foot of the proposed right-of-way. 10. Typically, developers provide a commitment equal to the value to construct these improvements for deposit into the City's non-reverting. thoroughfare fund. Credit is typically given towards this commitment for any widening, milling and resurfacing of the perimeter streets. 11. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way - City of Carmel (Pennsylvania Street) c. Water - City of Carmel Utilities d. Sanitary Sewers - City of Carmel Utilities e. Storm Sewers/Drainage - City of Carmel. f. Legal Drains - Hamilton County Surveyor's Office. 13. Drawings submitted for approval: a. The design engineer must certifY all drawings submitted for [mal approval. b. This office will require a minimum of 3-sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer. The Owner will receive I-set which must be maintained on the construction site at all times. If additional approved sets are desired, we will approve a maximum of 2-additional sets. However, the additional sets must be submitted with the required minimum 3-sets. 14. Water and Sanitary Sewer Fees BOARD OF PUBLIC WORKS AND SAFETY 17. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda deadlines for your use. Please use the Engineering Department deadlines for submissions to the Board. 18. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission andlor the Board of Zoning Appeals (if applicable) and completion of review by the Technical Advisory Committee. All written requests to be placed on the Board's agenda must include the appropriate Docket Number and tbe date (or dates) of approval by the Plan Commission and/or the Board of Zoning Appeals (if applicable). If an irrigation system is planned for this development, approval for additional Water Availability must be obtained from the Board. 20. Commercial Curb Cut Approval- This approval will require a Mitten request from the developer or the developer's engineer. The request must include 81h x 11 exhibits of the curb cut or cuts with all pertinent data included such as radii, width, opposing existing curb cuts, etc. Approval on November 30, 2006 voided approval of cut at current location. Approval must be sought. Department win support approval of the current cut location. 21. Temporary Construction Entrance approval if the location is at a site other than the location of the proposed permanent entrance to the development. 22. The installation of any permanent, privately owned andlor maintained improvement (signs, decorative street signs, walls, streedights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve irrigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of Way if not platted. Appropriate d.~dica!ion.docwn:ents ate available . upon request. :). I '.;. 25. Any open pavement cuts of Pennsylvania Street. 26. Any lane restrictions of Pennsylvania Street. BONDING REQUIREMENTS 27. Upon initial review, it appears performance guarantees shall be provided for the following: a. Pennsylvania Street Right of Way Improvements and Curb Cut Modifications. This could include demolition, extension of the'} 0' asphalt path south to the new property line, new concrete sidewalk north of the modified northern curb cut and aU construction associated with the modified north curb cut (including thermoplastic striping if required). lfthe existing performance bond for work associated with Phase 1 included aU of the current items in the right-of-way and it has not expired, it may be applied for this work. b. Erosion and Sediment Control and Stonn Water Quality; Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. 28. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. 29. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required (see Street Sign comments above). The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for aU other improvements. 30. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 31. Please reference the Engineering Requirements documents for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 32. Any work in the dedicated right of way of Pennsylvania Street will require an approved Right of Way Permit and a License & Permit Bond. 33. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work ofa required Ms. Sherri Wilson October 2, 2007 RE: Opus North Building #1 Parking Improvements Rev. #1 Page 4 of6 and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of Way Permit. 34. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way pennitting and bonding. The Department requires that a new right-of-way permit be obtained for the work in the right-of-way. AVAILABILITY AND CONNECTION FEES 35. The Availability and Connections Fees are current as ofthis date but are subject to future revisions. 36. Availability (acreage) Fees must be paid after all other Engineering Department requirements have been satisfied and prior to approval and start of construction activities. Availability Fees are based upon total platted acreage or Legal description acreage for the development'at the current rate of$I,OlO.OO per acre for Water Availability and $1,365.00 per acre for Sanitary Sewers. Based upon the legal description on the site plan, the preliminary Availability Fees are: Water- 1.737A'" @ $l,OlO.OO/A = $ 1,754.37 Sanitary Sewer- 1.737A "'@ $1.365.00/A = $ 2.371.01 Total 1.737A* @ $2,375.00/A =$ 4,125.38 "'8.788 acres (Building 1 Land Description current plans) less 7.051 acres (Previously Approved Building 1 Land Description) = 1.737 additional Building # 1 acreage subject to Water and Sanitary Sewer Availability (acreage) Fees. On July 2,2007, a Development Application Review Fee of $300.00 became effective. This fee is based upon developments with more than one customer requiring a water connection. This will not be applicable to this project since there are no new or revised water facilities. 37. Connection Fees are paid with individual buildings after theinfnistructure has been completed, satisfactory test results obtained and the development has been released for buildingpennits. Connection Fees are based upon,the'proposecUinal us~ of the building. Since there are no new or revised water or sanitary sewer fa.cilities .ililit are affected by this development, Connection Fees will not be applicabLe. Connection Fees are based upon EDDs and should not be confused with Water Availability Fees, which are acreage based. 38. Ifan irrigation system is planned for this development, additional Water Availability Fees and Water Connection Fees will be assessed based upon the size and usage of the systemand upon the recommendations of the Director of Carmel Utilities. CONSTRUCTION PLAN REVIEW COMMENTS 39. General Comments a. This project is subject to the City's Storm Water Management and Storm Water Quality Ordinances. b. The City has adopted a new paving and curbing policy. Please revise any notes, specifications, and details to accommodate these policies. The language of these policies must be added to a specification sheet on the fmal construction plans. c. Please provide the requisite storm water/drainage information required by Section 100 of the Storm Water Technical Standards Manual on the plan sheets. d. Please contact Amanda Foley to review storm water quality/treatment requirements. e. Be advised that the Department of Engineering does not have approval authority of Landscaping and Lighting. Please do not include these items in future construction plans submitted for review and/or approvaL. 40. Please develop a maintenance of traffic plan for work in the right-of-way. The plan shall conform to the INDOT Work Zone Safety Manual. 41. Please add the following note to all sheets: "NO EARTH DISTURBING ACTIVITY MAY COMMENCE WITHOUT AN APPROVED STORM WATER MANAGEMENT PERMIT." 42. Keynote indicates removal and relocation of existing trees by others. Who will do this and will they have this plan? c. Revise keynote 6 to indicate sawcut at nearest joint past required removal limits. d. What part of the existing entrance is north of the property line? Is this being demolished? This is subject to review and approval by the City. Restoration ofright~of.way shall be to the satisfaction of the City. 43. Sheet C20l a. Please add the following note: All paving within the existing and proposed City right-of- way shall conform to the requirements of the Department of Engineering. Contractor shall contact the Department of Engineering to schedule a pre-construction meeting to review the Department's construction requirements,' staff notification requirements," ,. required inspections for certain stages of the work and to review the authority of the Department as it relates to work within the existing and proposed City right-of-way. b. Please indicate with hatching and a keynote City standard pavement section for the portion of the entrance in the right-of-way. c. The Department requires City standard ADA ramps in the right.of~way. Please add keynote 20 that specifies the appropriate details to be added and revise the 2 keynote "5" references to the ramps in the right-of-way. . d. Please extend and enlarge the pork chop out to the travel lanes. The pork chop is too small to be effective. e. Please indicate removal and replacement of the existing path from the south line of the proposed drive to 10 feet south of removal limits for gas c~rmection. f. Please indicate curb end tapers where crosswalk crosses pork chop. Are curb end tapers necessary for ADA ramp or do the ramp details address this? City standard depressed curb shall be indicated for the ramps and the pork chop crossing. 44. Sheet C202 a. Please add City standard depressed curb detail, City standard ADA ramp details and City standard right-of-way pavement section to detail PV-36A. b. Ifdetail PY-25 does not meet or exceed City standards, City standard walk detail shall be added for walk in right-of-way and a specific keynote shall be provided on site plan referencing this detail. 45. Sheet C301 a. Is a swale needed to direct water into stIUctures 705 and 706? 46. Sheet C401 a. Please indicate location of construction entrance. A right-of-way permit is required for use of existing entrance for construction traffic. 47. Sheet C501 a. Please add to keynote 2 that the storm water cormection is subject to inspection and approval by City and that 48-hours notice shall be provided to right.of-way inspector prior to plarmed work. b. City backfill standards shall apply for trench backfill in the right.of-way. No equipment or materials for this work shall be staged in the right-of-way, excepting that equipement needed to do the work. c. Please confirm that the new parking area was part of the previously approved building phase 2. Please verify our understanding of the overall plan to maintain to the best extent possible the basin lines of the master plan and to acknowledge that phase 1 and phase 2 were previously approved without post-construction BMP's, that phase 3 would be designed to the Storm Water Management Ordinance, and that any portion of phase 2 directed into the south pond would be treated per e-mail dated February I, 2007 from Paula Gartner. Formal approval must be sought again for the current proposed cut location. 2. Provided that the previously submitted performance bond covered all of the current work (pork chop, storm sewer, inlet, path work, ramps) in the right-of-way and is still in effect, it may be used for this work. 4. If the remainder of the Penn St. LO.W., from the Building #1 dedication to Carolel Drive is to be dedicated with Building #2, T don'l think we would have an issue. Ditto for the Penn 81. Asphalt Path. Again, I will defer to Gary Duncan. However, regarding Item #3, the legal description for Bui]ding #1 on the Building #2 plans indicates a total of 8.788 acres. When Phase J. \vas approved by this office, the legal description was for 7.187 acres which excluded the area of the Building # 1 Parking Improvements. Availability (acreage) Fees were paid on 7.19 acres leaving L 737 acres (which is the area of the Building #1 Parking Improvement Project). However, here is our response to the comments. 1. There is a history behind the North Curb Cut that everyone needs to be made aware of. The North Curb Cut was originally designed and approved by the BPWS as we. have it shown on the proposed plans today. After it was approved the first time, the City Engineers office asked OPUS to change it to be shared with the Hilton Gardens Hotel. This was started. However, tile work was halted because the new owner of the building did not want this shared driveway because of their parking needs. OPUS went back to the City Engineer's office and explained this situation. An agreement was reached to return the drive entrance back to its original design, which was approved by the BPWS. 2. A performance bond is already in place for this work, which was left unfinished. We just need to finish it now. 3. Water and Sewer Fees - Not Applicable 4. A portion of the Pennsylvania Street Right-of-Way has already been dedicated for the Building #1 project. We recently submitted plans (Landmark at Meridian Building #2) for the remaining development of the site to T AC on August 31 sf These plans show the proposed Pennsylvania Street Right-at-Way, which will be dedicated as part of that project. 5. Right-at-way permits are already in place from the Building 1 Project. The work in the right-of-way just needs to be completed. Thank-you, Graham M. Do not remove (any) the existing trees located in the ROW (right-ot-way). They were required to be preserved during the Indiana DOT procedure. This existing plant material needs to be shown on the plan (and planted around), as well as the ROW lines and where the tree protection fencing is going to be located. If all you are doing at this time is a parking lot addition, and there are no structures involved, we do not issue a building permit for parking lots only. However, as far as I know-you would need to verify through Angie Conn and Scott Brewer that there are no issues relating to amending the site without getting prior approval. Additionally, you need to contact the City Engineer's office, regarding any site plans/requirements they may need. or need to approve, prior to you beginning your work. I have cc'd the three members of that department in this email-SD that they are aware of the question, as well as Scott and Angie. If you get to the point where you are looking for a building/structure permit. please feel free to contact me with any questions.
