Water Availability (acreage) and Connection Fees will be due for this phase. BPWS
approval for Water Availability (EOD) has not been granted. Connection Fees would be
based upon square footage. If the building is 41,000 sq. ft. as indicated on the drawing,
the calculation would be 41.000 sq. ft. @ 0.5 EOUs/Ioo0 sq. ft. ~ 20.5 EODs @
$.1,396. aO/EDU ~ $26,618.00. In order to calculate Water Availability (acreage) fees, we
will need a le.gal description for the southern half of the property, basically south from
a line extended from property line to property line and aligned with the outside of the
south wall of the existing building. If there are questions regarding these fees, the
engineer or developer should contact John Duffy of Carmel Utilities.

I have reviewed status of the project based on our conversation today.
1. Drainage Approval was obtained on December 27, 2007.
2. Amanda is prepared to approve the Storm Water Management permit 3. Provided the Utility
Department has no requirements for seeking approval for additional availability, the only
BPW approval is dedication of right-of-way. While typically required prior to release of
construction drawings, Engineering would be willing to allow formal Right-of-Way
dedication to be a condition of rough-in inspection or the final Certificate of Occupancy
provided that Kite indicates that they agree to this condition in writing or via email.
4. Performance Bonds are only needed for path construction in the right-of-way and Erosion
and Sediment Control and any Storm Water Quality Measures. I suggest a certified estimate
be prepared by EMH&T and bonds equal to 100% of this value be provided. Please provide an
estimated time for delivery of these bonds. If these bonds are not able to be delivered
until after the desired start of construction, we can place a hold on a rough-in
inspection if not delivered by that date.
5. Based on our conversation today, Items 44, 45, 46, 48, 49, 52, 54, 55, 57, 61, 62, 64,
69, 72, 73, 74, 75, 77, 79, 80 need to be incorporated into the drawings. I will review
when plans are re-submitted. I can sit down with EMH&T to review point by point if needed.
6. As we discussed, unless Kite is entirely against the request per Item 83, I will
contact DOCS to ask about how best to proceed with this issue, I am certain that we could
find the support needed for a variance of the parking count versus the location of the
path and make obtaining this variance as easy as possible as well as allowing the project
to move forward without having this variance obtained.
7. Items 59, 60, 63, 65, 66, 68, 70, 71, 76, 78, 84 require clarification and hopefully no
plan edits. Email response followed by a formal written response is acceptable.
8. Items 50 and 67 will not be applicable if there are no swales proposed.
9. Items 38, 39, 40, 41, 42, 43, 47, 51, 53, 56, 58, 81, 82 no longer appear to be
applicable.
10. If the Utility Department indicates that no additional fees are required, then the
comments related to these fees will be satisfied.
11. The contractor needs to come in as soon as possible to complete the right-of-way
permit. A $2,000 bond will be required. This can typically be turned in around in the same
day or the day after the permit paperwork is submitted. The document is available on the
Engineering web site.

With all that said, here is how we should proceed:
1. Revise the drawings as quickly as possible and submit for re-review. I will commit to
reviewing these the same day they are submitted. If the platis are found to be in order,
the Department will issue the Storm Water Management permit so that the Nor may be
submitted IDEM. Earth disturbing activity could then take place within 48-hours I believe.
2. Make any edits to the right-Of-way dedication documents if, per Item 6 above, Kite does
not oppose dedicating the additional right-Of-way to shift the path away from the road and
submit these documents so that these may be presented at the first meeting in February.
Engineering would be willing to allow formal Right-of-Way dedication to be a condition of
rough-in inspection or the final Certificate of Occupancy provided that Kite indicates
that they agree to this condition in writing or via email. This will allow construction to
start of having this formalized with the BPW.
3. Provide the Performance Bonds or an estimated time to deliver the bonds. Engineering
would be willing to allow provision of these bonds to be a condition of rough-in
inspection in the event that these bonds are not able to be delivered until after the
desired start of construction, provided that Kite indicates that they agree to this
condition in writing or via email. This will allow construction to start without having
these bonds.
4. I will contact DOCS concerning the path/parking space issue to see if construction can
start while this is being resolved.

Dear Mr. O'Toole:
The City has received your construction plans submitted for review at the October 17, 2007 Teclmical
Advisory Committee meeting. We offer the following comments:
GENERAL INFORMA nON
I. These comments represent the Department of Engineering's frrst review of the construction
plans for this project. We reserve the right to provide additional review comments as the
project moves forward.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notifY us of
any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off-site easements necessary to install utilities to serve the development are secured.
e. Fees have been paid.
f. Digital file submissions have been made.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.
8. An approved right-of-way permit is required prior to commencing any work in the public
right-of-way.
9. If it will be necessary to relocate existing utilities, the cost for such relocations shall be borne
by the developer. If utility poles must be relocated, they must be relocated to within one foot
of the proposed right-of-way.
10. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development. This

shall apply to the lUinois Street frontage. Typically, developers provide a commibnent equal
to the value to construct these improvements for deposit into the City's non-reverting
thoroughfare fund. Credit is typically given towards this commitment for construction of the
improvements prescribed by the 20- Y ear Thoroughfare Plan and any milling and resurfacing
of the perimeter streets. Since this is the second phase of a previously approved development
plan, the Department is not requesting this commitment.
I ] . The Department requires that the construction drawings be developed in accordance with the
City of Carmel digital submission standards and that all required submittals for primary plat,
secondary plat, and construction drawings be made. The digital files must be submitted to
the Department of Engineering prior to the approval of the construction plans. Please contact
the City GIS Department for the requirements.
12. Jurisdictions:
a. The project site is located within current City of Carmel Corporate Limits.
b. Streets and Right of Way - City of Carmel (Illinois Street)
c. Water - City of Carmel Utilities
d. Sanitary Sewers - Clay Township Regional Waste District
e. Storm SewerslDrainage - City of Carmel.
f. Legal Drains - Hamilton County Surveyor's Office.
13. Drawings submitted for approval:
a. The design engineer must certifY all drawings submitted for final approval.
b. This office will require a minimum of 5 sets of drawings for approval after all issues have
been resolved. The drawings will be stamped as approved and signed by the City
Engineer and by Cannel Utilities. The Owner will receive I set which must be
maintained on the construction site at all times. If additional approved sets are desired,
we will approve a maximum of2 additional sets. However, the additional sets must be
submitted with the required minimum 5 sets.
14. Cannel Utilities will provide separate reviews of this project for water issues. Please assure
that copies of all drawings are sent to:

BOARD OF PUBLIC WORKS AND SAFETY
17. J am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda
deadlines for your use. Please use the Engineering Department deadlines for submissions to
the Board.
] 8. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission and/or the Board of Zoning Appeals (if applicable) and completion of

review by the Technical Advisory Committee. All written requests to be placed on the
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission and/or tbe Board of Zoning Appeals (if applicable).
19. Water Availability (EDU) approval from the Board is based upon the usage ofthe proposed
building within the development. Reference item #34-37 below for a more detailed
explanation. Iran irrigation system is planned for this development, approval for additional
Water Availability must be obtained from the Board.
20. Commercial Curb Cut Approval- This approval will require a written request from the
developer or the developer's engineer for each curb cut. The request must include 8'i2 x II
exhibits of the curb cut or cuts with all pertinent data included such as radii, width, opposing
existing curb cuts, etc. If there are no changes planned for the southernmost existing
entrance, Board curb cut approval is not required. However, the proposed median cut will
require Board approval.
21. Temporary Construction Entrance approval if the location is at a site other than the location
of the proposed permanent entrance to the development.
22. The instaJlation ofany permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) or outdoor seating or other areas within
dedicated right of way or dedicated easements requires the execution of a Consent to
Encroach Agreement between the Owner and the City of Carmel. Such agreements are
executed by the Board of Public Works and Safety. The City Engineer may approve
irrigation system agreements.
23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of secondary plats for Board ofPubHc Works and Safety approval.
24. Dedication of Right of Way if not platted. Appropriate dedication documents are available
upon request.
25. Open pavement cuts of Illinois Street.
BONDING REQUIREMENTS
26. Upon initial review, it appears performance guarantees shaH be provided for the following:
a. Illinois Street Right of Way Improvements. This could include improvements such as
acceleration & deceleration lanes, passing blister, pavement widening, milling,
resurfacing, thermoplastic striping, stone shoulders, curbs, existing curb cut
modifications, median cut, etc.
b. Water Mains.
c. Perimeter 10' Asphalt Path. It is assumed that this path will be constructed along the
entire Illinois Street perimeter of the development, not just Phase 2. Please confum.
d. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley,
Engineering Department Stormwater Administrator, for details regarding engineer's
estimates/perfonnance guarantee requirements for these items.
27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc.
28. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon
15% of the Performance amount for Streets and Curbs and 10% of the Performance.amount
for all other improvements.
29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of
Credit.
30. Please reference the enclosures for more detailed explanation of our procedures.

RIGHT OF WAY PERMIT AND BONDING
31. Any work in the dedicated right of way of Illinois Street, including the use of the existing
entrance for construction traffic, will require an approved Right of Way Permit and a License
& Permit Bond.
32. The bond amount is determined by the nwnber of instances of work in the right of way at
$2,000.00 per instance. However, if the work is included in the scope of work of a required
and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the
bond requirements of the Right of Way Permit.
33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting
and bonding.
AVAILABILITY AND CONNECTION FEIES
34. The Availability and Connections Fees are current as of this date but are subject to future
revisions.
35. Availability (acreage) Fees must be paid after ail other Engineering Department requirements
have been satisfied and prior to approval and start of construction activities. Availability Fees
are based upon total platted acreage or legal description acreage for the development at the
current rate of $1,010.00 per acre for Water Availability. When Phase 2 was constructed, the
building was served by Indianapolis Water and was subject to their requirements. Since
Cannel Water now serves this area, Phase 2 construction will be subject to Water Availability
(acreage) Fees. Please provide a legal description that encompasses the acreage of the site
south and southwest of a line established on the south wall of the existing building extending
from the east property line to the west property line. Additionally, as of July 2, 2007, a
Development Application Review Fee will be assessed. This Fee is $150.00 for
developments with one customer requiring a water connection and $300.00 for developments
with more than one customer requiring a water connection. This fee is to be paid with the
Availability Fees.
36. Connection Fees are paid with individual buildings after the infrastructure has been
completed, satisfactory test results obtained and the development has been released for
building permits. Connection Fees are based upon the proposed final use of the building.
Reference our Utility Equivalent User Contribution Multiplier tables. A listing of proposed
building uses will eventually be required to determine the Water Availability request to the
Board of Public Works and Safety. This request is based upon edus and should not be
confused with Water Availability Fees, which are acreage based.
a. The current Water Connection Fee is $1,396.00. per EDU.
"'Including a Tap Inspection Fee of$86.00/EDU effective July 2,2007.
37. Ifan irrigation system is planned for this development, additional Water Availability Fees
and Water Connection Fees will be assessed based upon the size and usage of the system and
upon the recommendations of the Director of Carmel Utilities.
CONSTRUCTION PLAN REVIEW COMMENTS
38. General Comments
a. This project is subject to the City's Storm Water Manangement and Storm Water Quality
Ordinances. The Department acknowledges that storm water management was
previously master planned and that detention is provided off-site. Thank you for
considering the capacity of the downstream piping system and for providing on-site
detention.
b. The City has adopted a new curbing and paving policy. Please revise any notes,
specifications, and details to accommodate these policies. The language of these policies
must be added to a specification sheet on the final construction plans. The paving policy

will only need to be added ifmedian work for the full access for the existing curb cut is
approved.
c. Please contact Amanda Foley to review storm water quality/treatment requirements.
d. Be advised that the Department of Engineering does not have approval authority of
Landscaping. Please do not include these items in future construction plans submitted for
review andlor approval. Please remove the Landscape Plan title from the Sheet Index on
the Cover Sheet.
43. The drawing does not appear to indicate a water service line connection. Is the 8' water main
shown on the drawings an existing main? If so, will the main be extended to serve the proposed
building addition?
44. The Illinois Street path shall be indicated one foot off the back edge of the 60' half right-of-way.
45. It appears that portions of the asphalt path are proposed to be constructed outside of the right of
way line.
46. Has bicycle parking been provided?
47. A maintenance of traffic plan shall be provided for all work in the right.of.way, iffull access for
the existing cut is approved and the proposed work to the existing median is required. The plan
shall conform to the INDOT Work Zone Safety Manual.
48. Please include City standard ADA ramp details for ramps in the right-of-way.
49. Please add the following note to the drawings if full access for the existing cut is approved and the
proposed work to the existing median is required: "All paving within the existing and proposed
City right-of-way shall conform to the requirements of the Department of Engineering. Contractor
shall contact the Department of Engineering to schedule a pre-construction meeting to review the
Department's construction requirements, staff notification requirements, required inspections for
certain stages of the work and to review the authority of the Department as it relates to work
within the existing and proposed City right-of-way."
50. All proposed swales shall have a subsurface drain. Please verify if any swales are proposed. The
City's standard subsurface drain detail, requiring double wall Hancor Hi-Q or equivalent pipe shall
be added to the plans.
51. If full access for the existing curb cut is approved and the median is modified as proposed, please
indicate removal of the existing curb to the nearest joint past required limits for the left turn taper
and lane in the median. CUrb shall be sawcut at this joint.
52. Please add an Asphalt Path Detail that requires I inch HMA # II surface on 2 inches HMA #8
binder on 5 inches #53 stone.
53. If full access for the existing cut is approved and the proposed work to the existing median is
required, please add the following note to the construction drawings: "All paving is to be
completed within the same paving season."
54. The City standard trench detail for RCP shall be added to the plans for the pipe run 706-707-XIII
and referenced with a unique plan note or keynote on the utility plan or development plan.
55. Please indicate City standard ADA ramps where the Illinois Street path crosses each minois Street
entrance with a unique plan note or keynote referencing the City's ADA details.
56. If full access for the existing cut is approved and the proposed work to the existing median is
required, please add a note to the site plan that all existing pavement shall be sawcut to a clean
edge where new pavement (for widening or for auxiliary lanes) is to be installed adjacent to
existing pavement.
57. Please add a note to all appropriate sheets that no earth disturbing activity may commence without
an approved storm water management permit.
58. If the full access for the existing cut is approved and the proposed work for the median is required,
a striping plan for the median taper and lane shall be provided. All striping shall be thermoplastic.
59. Please verifY that all existing fire hydrants within 300 feet of the development are indicated.
60. Please verify that all existing underground utility vaults, overhead and underground utility lines
are indicated on the plans.

6]. Please indicate why the A TP path is not extended to the north property line.
62. North arrows are incorrectly rotated on some sheets.
63. Please verify that all existing storm piping, bridges, culverts, etc. in the vicinity of the site are
indicated on the plans and include top casting, top curb, and invert elevations, pipe sizes, pipe
type, and direction offlow.
64. Please include the requisite information per Section 100 of the Storm Water Technical Standards
Manual to the plans.
65. Is a N.A.E. provided across the frontage?
66. Please verifY that turning radii on site are adequate for emergency vehicles and all vehicles
expected to regularly access the site.
67. Please indicate any subsurface drains on site including ones required for swales and any proposed
in parking areas.
68. Please verifY if the Urban Forester will require structural soils on site.
69. Project data on the cover sheet is not complete.
70. Please verify ifthere is an increase in the portion of the site draining to the west. Please verify
that the grading along the western property line will essentially be the same between the proposed
curb line and the property line. It would be desired by this Department to reduce the on-site
watershed draining to structure 74.
71. Please verify that the slope from the right-of-way into the existing site is essentially staying the
same.
72. Please clearly indicate the construction limits on all streets.
73. Please update details CUI, CU2, CU3 with the most current details on the City's website.
74. Please revise detail W-7 to indicate maximum expansion joint spacing of 50 feet and a maximum
controVcontractionjoint spacing of 10 feet/5' maximum on radii.
75. Please add a note to the plans that all work shall be limited to the hours of7 am to 7 pm.
76. Please verify with DOCS the need for pedestrian connectivity from the site to the perimeter path.
77. Please indicate the maximum cross slope of the perimeter path on the plans.
78. Please verify that storm piping is allowed in the existing buffer zone.
79. Please revise the profile on sheet C5.0 to indicate RCP for pipe runs 706-707 and 707.XI II.
80. The work in the right-of-way for the storm connection is subject to inspection by the City. 48-
hour notice is required to the City prior to the work being completed. The connection must be
core drilled. Restoration of the right-of-way shall be as stipulated in the right-of-way permit and
in accordance with applicable City code.
81. If the full access for the existing cut is approved and the proposed median work is required,
hatching delineating the City's right-of-way pavement section with a keynote or plan note
referencing PA-] shall be added to the plans for the pavement in the median. Also, the right-of-
way pavement section noted in detail PA-! will need to be revised to conform to the City's
perimeter road pavement section.
82. As previously indicated, the Department will not support the proposed access. The Department
will only support a right in/right out access at the proposed location. Full access for this cut
requires approval from the Board of Public Works and Safety.
83. The Department desires to have the path offset from the back of curb across the entire frontage a
minimum distance of 5 feet. This would require the right-of-way for the roundabout to be a 180'
radius. This would allow a 5-foot mow strip from curb to path. The resulting 5' yard would only
affect 2 parking spaces. The City would consider allowing an encroachment in this instance.
84. Are anyon-site easements necessary or planned? Are there any proposed easements that contlict
with existing landscaping or tree preservation easements? Are there any existing utility or other
easements that croSs the property that require permission for encroachment within the easements
for the proposed improvements? Any planned drainage easements must conform with Section
306.02 oftbe Stonn Water Technical Standards Manual. Any easements to be vacated?

transportation. I have reviewed the re"ised drawings submitted on December 6, 2007 and offer the
following commellts:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) Please see the City of Carmel's Parking Ordinance in order to determine appropriate locations,
specifications and constnlction details for the above. Section 27.06.03-H of the City of Cannel's
Ordinance requires that bicycle racks must be installed a minimum of 24 inches form all walls or
obstructions. Please revise your plans to amend this change.
We request that all responses to our comments be provided in writing. Failure to provlde written responses
may result in delay of tIle review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted,
particularly if any such changes are considered "new" or fall outside of our previous reviews. Please
provide revised plans indicating all revisions. Please notify us of any changes and specifically state any
changes, including changes resulting from Plan Commission, Special Studies or other committee meetings.

Th is email is to inform you of changes to the design of the 1 03rd Street Medical Building - Phase 2 project. The following
changes are reflected on the included plan sheets:
The loading area and dumpster at the southwest corner of the proposed building have been removed and a drop-off loop
and canopy have been added to the west building entrance. The median cut at the entrance on Illinois Street has also
been removed. Utilities and drainage patterns. are uneffected by these changes.
Revised building elevations are included on sheets PG1, PG2, and PG3
A revised Site Plan is included, see sheet 20071927.C200.Rev2.120407

The Department has reviewed the request for a full access from Illinois Street for the
second phase of the project. The Department can only support a right-injright-out access.
The site has a full access to the north and the roundabout coupled with the right-in
access allows access for northbound Illinois Street traffic without an undue
inconvenience. The existing full access just to the south is located in accordance with
City Access Management policy and will likely be the first full access provided
considering possible future improvements to the 103rd Stree't and Illinois Street
intersection and expected traffic increases on Illinois Street.

I met with Mr. O'Toole on September 21 on site, and went over the trees that were still there and
could remain. One large tree that was scheduled to be preserved looks as if will not survive the
construction process, so it will probably be taken down, but the soil volume preserved in almost
the same place, and 4-5 trees planted in its place. They still need to get me revised plans
though.

Dear Daniel:
I reviewed the revised plans today, and here are my comments.
1. On the graphic planting detail, there are two notes Ihat lalk about planting. The one that says
"Plant tree 6" Higher than Grade" should be eliminated.
2. Thornless Cockspur Hawthorn is a species that has a lot of problems wilh pests and disease.
I would caution against using it. The serviceberry would be a better species, or yellowwood, or
tri-color beech.
3. Amur maple is an ornamental tree, but is shown as a shade tree. Please change the species
to a large maturing shade tree such as Kentucky coffee tree, London plane tree, or ginkgo.
4. The three serviceberry in the new jsland (to replace the existing elm) should be shade trees 10
provide shade and intercept stormwater over the pavement, rather than small ornamental trees.
Please make them large maturing shade trees as are there now, such as Kentucky coffee tree,
London plane tree, or ginkgo.
5. Please add another red oak or zelkova to the large parking lot island in the middle of the lot.
