Docket No. 07110025 .PP: Dapper Estates The applicant seeks primary plat approval for 2 lots on 0.984 acres. One subdivision waiver requested is: Docket No. 07110026 SW SCO 6.05.01 lot with no street frontage The site is located at 1340 Rohrer Rd. and is zoned R-l/Residence. Filed by Matt Skelton of Baker & Daniels, LLP for Robert Dapper. The petitioner proposes to plat 2 lots on 0.984 acres. Currently, there are two existing homes on the parcel. This plat would clear up any legal nonconformity regarding zoning. This plat is a density of2.03 units per acre, which is a permitted density in the R-I/Residence zoning classification where the maximum density is 4.3 u/ac and the minimum density I ulac. The minimum lot size permitted in R-l is 10,000 sq ft. This plat is exempt from the requirements of the Open Space Ordinance, since it is less than 5 acres in size and it is less than 5 lots. The subdivision waiver request is for Lot #2 to not have lot frontage on Rohrer Rd, and have an access easement through lot one, instead. This request is acceptable by the department, since the second house already exists behind the 1irst existing house. DOCS comments/concerns: 1. The Forestry Dept. needs a conceptual landscape plan and/or a tree preservation plan. 2. The Dept of Engineering has no issues. Road right-of-way dedication is required. 3. DOCS needs a response to its review comments: a. Show/label the front, rear, and side yard setbacks on the plat. b. Show/label the 40-ft 1;2 road r/w along Rohrer Rd c. Please place the zoning classification on the plat: R-IIResidence. d. Please add Docket No. 07110025 P P & 07 J J 0026 SW to the plat. e. Per the Alternative Transportation Plan, please show/label the IO-ft multiuse ashpalt path within the R1W. Construction of this path is required or monies can be contributed to the non-reverting thoroughfare fund. Please contact David Littlejohn for more info. f. Show/label all easements, such as utility and ingress/egress. g. Show/label pins at each lot corner and show/label concrete monuments at the 4 outer corners of the whole subdivision. h. Provide floodplain statement on plat. I. Please provide a filled out/notarized affidavit of notice of public hearing (see application). J. Provide the notarized Affidavit of the Public Notice Sign Placement; see application. The Department of Community Services recommends the Commission send this item to the February 5 Subdivision Committee meeting for further review and to allow time to resolve all outstanding issues. Or, if comfortable with the plat, the Commission can suspend its rules and vote to approve these items, only after all comments and concerns are addressed.
