I must be in DC this evening for a meeting an regret that I will miss tonight's subcommittee meeting. I did
review the agenda and offer the following:
1. Woodhall. Thanks for a "gate" proposal on my very first case back! I don't have a copy of the
submission, so really cannot comment on the specifics. Angie and Ramona, please forward one. I
would note, however, that the department has identified several significant issues for discussion. I also
urge caution anytime a petitioner is proposing several waivers, as is the case here. Andy standards
exist for a reason, and its policy must be considered carefully when a waiver is requested. That is
ounded when multiple waiver requests.
2. Dapper: ee no concerns beyond those identified in the committee report.

I have printed and looked over the primary plat, but it does not really fulfill the requirements of 26.04 (bufferyard
requirements). Could you provide a plan that shows the LB and TPE, and some digital photographs of the existing
vegetation? That, along with the method of preservation on the plans, might be sufficient to fulfill the requirement.

I have spoken with the City Forester, and below is what is requested to comply with the bufferyard ordinance: At the very
least, please provide the Department with photographic documentation of the existihg tree buffers along the property lines
and a written statement/paragraph that the trees will be preserved, as is. This, along with the revised plat which shows the
tree preservations areas & landscape buffer, will meet the buffer yard standards of chapter 26.04 of the zoning ordinance,
where no additional subdivision waivers or variance requests for landscaping will be required.

As we discussed in your office, Matt's interpretation of Chapter 26.04 seems accurate, and I just need a plan that would
show that. Or if the existing vegetation is going to be preserved (preferred by the City) to fulfill the bufferyard
requirements, a plan showing the vegetation (with a section showing digital pictures of the area) should be submitted.
The landscape plans should mirror the engineered site plans so utility, drainage, and any other easement information can
be checked for conflicts and adherence to the City's codes and ordinances. I will be glad to send out review comments as
soon as I receive such plans.

hi malt - the bufferyard determiniation written below seems accurate. i am working with scott brewer to see if this project
only requires a CONCEPTUAL landscape plan or an Actual landscape plan with an actual plant count and species
legend. i prefer to leave this determiniation to Scott.

If you have a moment, would you mind looking at the dapper plat? If we were to comply with the City's buffer yard
standards, how would they be applied to the Dapper pial. Scot is asking us to provide buffer yards. I am not sure I agree
that they should be required in this instance, but I am just interested in how you think they would apply. Here is what our
engineer came up with:

" According to Zoning for our site and its adjoiner's, all the properties involved are zoned R1, which leads me to believe that
they also fall under the classification of a Single Family Development.
Rohrer Road is considered a Collector Street.
The Buffer Yard restrictions and requirements are as follows.
The North, West and South lines are a situation 8, as described on page 4 of Chapter 26.
The West line is the Rear of the property, where as the North and South are the sides.
The East line is a situation C and is the Front of the property.
The North and South lines require a 5' minimum buffer yard with 3 shade trees, 3 Ornamental trees, and 15 shrubs*.
The West line requires a 10' minimum buffer yard with 3 shade trees, 3 Ornamental trees, and 15 shrubs*.
The East line requires a 10' minimum buffer yard with 3 shade trees, 4 Ornamental trees, and 21 shrubs*.
*Evergreen trees may be substituted for shrubs, where as 1 Evergreen = 3 shrubs.
