I have reviewed the revised drawings submitted on December 28, 2007 and offer the following comments: The comments from the Alternative Transportation review have been satisfactorily addressed. It is critical that this office be made aware of all modification made On the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans indicating all revisions. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, Special Studies or other committee meetings. This shall include all pipes,-structures, swales, ditches and ponds, which are pertinent features to the proper drainage of the subdivision. This responsibility of the developer shall not, however, include problems which are created subsequent to the completion of the subdivision improvements by the improper grading by individual builders or structures and improper grading installed or accomplished by individual homeowners_ H is the intent oftrus agreement that the developer shall 'specifically provide such sub-surface drains, or storm sewers or ditches, as areTequired to properly rectify any drainage-problem or sub-surface water problem which was not contemplated in the original approved subdivision design, including, but not restricted tu, disposal of sub-surface water from footing drains of individual lots. ROAD IMPROVEMENTS: The typical agreement for existing contiguous Hamilton County Roads which arc substandard, with Hamilton County is: The developer will put in 12-inch stune base to the required width of the road, and grade the shoulders to a minimum of6 feet width and construct proper side-ditches, or, provide storm sewer and curbs. This will be the black top grade during construction of subdivision. Then the county will come in and cut our 3 inches and put in 3 inches binder asphalt after which the developer will be responsible for I inch of asphalt topping. This is being done as joint projects between county and developer. An agreement shall be executed, in writing, between the developer and Hamilton county specifically detailing the exact work to be accomplished by the developer and that to be accomplished by the County, and ,shall also state the road or roads or portions thereof which are included. Construction plans were stamped approved by Carmel on July 27, 2007. Our records don't indicate ever having received any comments on the secondary plat. We would now like to move fODvard with acceptance and recording ofthe plat. Included 'Nith this letter are a copy of the original secondary plat application and a copy of the plat itself. We offer the following comments: GENERAL INFORMATION 1. These comments represent the Department of Engineering's fIrSt review of the construction plans for, this project. 2. We request that all responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. 5. Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Works and Safety approvals and any other governing agency approvals (if required) are obtained. d. AU off.site easements necessary to install utilities to serve the development are secured. e. Digital tiles have been submitted. f. Water and Sanitary Sewer availability fees have been paid. 6. The Department reserves the right to provide additional comments based upon subsequent reviews. 7. An approved Stonn Water Management Permit is required prior to commencing any earth distur~mg activity. 8. An approved right.of-way permit is required prior to commencing any work in the public right-of-way. 9. lfit will be necessary to relocate existing utility poles, they must be relocated to within one foot of the proposed right-of-way. Costs for such relocations are to be borne by the developer. 10. The Department requires that the construction drawings be developed in accordance with the City of Carmel digital submission standards and that all required submittals for primary plat, secondary plat, and construction drawings be made. Please contact the City GIS Department for the requirements. 11. Iurisdictions: a. The project site is located within current City of Carmel Corporate Limits. b. Streets and Right of Way - City of Carmel c. Water - City of Carmel Utilities d. Sanitary Sewers - City of Carmel Utilities e. StormSewerslDrainage - City of Carmel. f. Legal Drains - Hamilton County Surveyor's Office. 12. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for fmal approval. b. This office will require a minimum of five-sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and will be signed by the City Engineer and Director of Carmel Utilities. The Owner will receive one-set which is to be maintained on the construction site at all times. Cannel Utilities will receive two- sets, the City's Public Works Inspector will receive one-set and one-set will be maintained in the Engineering Department. If additional approved sets are desired, maximum of two-additional sets will be approved provided that the additional sets are submitted with the required five-sets. 13. Carmel Utilities will provide a separate review of water and sanitary sewer issues. If you have not already done so, please provide the construction plans to their office for review. 14. Carmel Utilities does subscribe to "Holey Maley" who should be contacted directly for all water main and sanitary sewer main locations. 15. I am including copies of the following with this correspondence: a. Subdivision Project Approval Procedures b. Perfonnance Release Procedure c. Subdivision Building Permits d. Permit Data, Contacts, etc. e. Water Fees f. Decorative Street Sign standards g. Schedule for Board of Public Works and Safety meetings. BOARD OF PUBLIC WORKS AND SAFETY 16. Please use the Engineering Department deadlines for submissions to the Board. 17. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the Board of Zoning Appeals (if applicable) aDd completion of review by the Technical Advisory Committee. All written requests to be placed on tbe Board's agenda must include tbe appropriate Docket Number and tbedate (or dates) of approval by the Plan Commission and/or tbe Board of Zoning Appeals (if applicable). 18. Water Availability and Sanitary Sewer Availability approval from the Board is based upon the total number oftownhome units and number of bedrooms per unit. Reference item #35- 39 below for a more detailed explanation. 19. If a community swimming pool, community clubhouse or community bathhouse is planned for this development; additional Water and Sanitary Sewer Availability approval from the Board will be required. 20. If an entryway irrigation system or other community irrigation systems are planned for this development, additional Water Availability approval from the Board will be required. 21. Commercial Curb Cut Approval- This approval will be required for the 136th Street entrance and possibly for the Lark Drive connection, depending on what is planned at that location. Provide a letter to this office requesting BPWS Commercial Curb Cut approval. Provide an 8 Y:z x. Section 2 - Project Review #1 Page 3 ofS 22. Temporary Construction Entrance approval if the location is at a site other than the location of the proposed permanent entrance to the development. Submission requirements are the same as for commercial curb cut. 23. The installation ofanypermanent, privately owned and/or maintained improvement (signs, decorative street signs,walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of CarmeL The Board of Public Works and Safety executes such agreements. The City Engineer may approve irrigation system agreements. 24. Secondary Plat approval if applicable. a. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 25. Dedication of Right of Way if not platted. 26. Any open pavement cuts of dedicated streets. 27. A consent-to-encroach is required for nay private, permanent improvement located within platted right-of-way or easement. Please contact the Department of Engineering to review. BONDING REQUIREMENTS 28. Upon initial review, it appears performance guarantees shall be provided for the following: a. Streets (base, binder and surface must be.bonded together) b. Curb & Gutters c. Water Mains d. Sanitary Sewers e. Street Signs. f. Storm SewersIDrainage g. Monuments and Markers h. Interior Sidewalks (builders lot right of way sidewalks). i. Exterior Sidewalks (common areafperimeter road right of way sidewalks/asphalt paths). j. Right of Way Improvements may be bonded separately. This could include acceleration/deceleration lanes, passing blister, pavement widening" thermoplastic striping, stone shoulders, curbs, etc. if applicable. k. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. 29. The amoWlt of the Performance Guarantee is based upon a certified Engineer's Estimate for 100% of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs~ pipe sizes and materials, etc. 30. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the Performance amoWlt for Streets and Curbs and 10% of the Performance amount for all other improvements. 31. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 32. Please reference the enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 33. Any work in the dedicated right of way of 136th Street and/or Lark Drive will require an approved Right of Way Permit and a License & Permit Bond. 34. Discharges of dredged or fill material into waters of the United States must be mimmized or avoided to the maximum extent practicable at the project site (i.e. on-site). The pennittee shall provide a mitigatioI1lmonitoring plan for any activity where the adverse impact on special aquatic sites exceeds 0.10 acre (4,356 sq. fl.) or is determined to be more than minimal impact. In detennining the minimal Impact threshold, the Districts will consider the direct and secondary impacts of th e fill or work and any mitigation measures. A wetland deiineation report is also required. NOTE An important element of an)' mitigation plan for projects in or near mearns, other open waters 3l1d wetlands is the requirement for vegetated buffers Therefore, a]] mitigation plans should include a minimum 50-foot wide buffer between the edge of the project site and the waters and/or wetlands to be affected Ul11ess a lesser distance has been specifically approved under the RGP. 2. The permittee shalL if mitigation isrequired, develop the mitigation site concurrently WIth site construction. This will assure that aquatic functions are not lost for long periods of tIme which could adversely affect water qualiry and wildlife 3. The permittee shalJ ensure that sedimentation and soil erosion control measures are inplace prior to any construction activity. This shall include the installation of straw bale barriers, silt fencing and/or other approved methods to control sedimentation and erosion. 4. The permittee shalJ ensure that areas disturbed by any construction activity, including channel banks, are immediately stabilized and revegetated with a combination of grasses, legumes and shrubs compatible to the affected area. 5. The permittee shalJ ensure that all jn~stream construction activity is not performed during periods of high stream fiow or during the fish spawning season between April I through June 30 without first comacting the IDNR, Division of Fish and Wi]dIife for their expertise on impacts to the fishery resource. Additionally, the discharge of dredged and/or fill material in known waterfowl breeding areas must be avoided to the maximum extent practicable. 6. The permittee wilJ ensure that the activity authorized will not disrupt movement of those aquatic species indigenous to the warerbody. including those species which normally migrate through the area unless the activity's specifIc purpose is to impound water. 7 Tne pennittee shall ensure that all construction equipment is refueled and maintained on an upland site away from existing streams, rirainageways and wetland areas Heavy equipment working in wetlands must be placed on mats, OT other measures taken to minimize soil disturbance. 8. The pennittee must provide a copy oftne site specifIc State Section 401 WQC before the Corps will authorize a project under the RGP. 9. The permittee must comply with any case specific special conditions added by the Corps or by the State Section 401 wQe The conditions imposed in the State Section 40 I WQC are also conditions of this RGP. 10. The permittee shall assure that no activity authorized by the R GP may cause more thm1 a millimal adverse effect on navigation. II. The permittee shall ensure proper maintenance of any structure or fill authorized by this RGP, including maintenance 10 ensure public safety. 12. The permittee shall not perform any work within any Wild and Scenic Rivers or in any river officially designated as a "study river" for possible inclusion in the system, unless the appropriate Federal agency, with direct management responsibility for such rIver, has determmed in writing that the proposed activity authorized by the RGP wiII not adversely affect the Wild and Scenic River designation or study status. Information on Wild 3l1d Scenic Rivers may be obtained from the appropnate Federal Land Management agency in the area (e.g. U.S. Forest Service, Bureau of Land Management or the U.S. Fish and Wildlife Service). 13. The perminee shall not perform any work under the RGP whi eh is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. The permittee shall notify the District Engineer if any listed species or critical habitat might be affected or is in the vicinity of the proj eet, and shalJ not begin work under the RGP until notified by the District Engineer that the requirements of the Endangered Species A.ct have been satisfied and that the activity is authorized. Authorization of aD activity under the RGP does not authorize the "lake" ofa threatened or endangered species as defined under the Federal Endangered Species Act. in the absence of separakauthorization (e.g., an ESA Section 10 Penuit. a Biological Opinion with "incidental take" provisions, etc.) from the U. S. Fish and Wildlife Service or the National Marine Fisheries Service, both lethal and non-lethal "takes" of protected species are ill violation of the Endangered Species Act. 14. The permittee shall not perform any activity under the RGP which may affect historic properties listed, or eligible for listing, lI\ the National Register ofHiswric Places until the District Engineer has complied with the provisions of 33 CFR Part 325, Appenriix C. The permittee must notify the District Engineer if the activity authorized by the RGP may affect any historic properties listed, determined to be eligible or which the permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shall notbegiD construction until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence ofhisroric resources can be obtained from the lndiana Department of Natural Resources, Division of Historic Preservation and Archaeology. If the permittee discovers any previously unknown historic or archaeological remains whileaccomplishmg the activity authorized by the RGP, work mllst be immediately stopped and this office nnmediately notified of what you have found. The District will initiate the Federal, Tribal and State coordination required to determine if the remains warrant a recovery effort or ifthe site is eligible ror listing in the National Register of Historic Places. 15. The permittee shall not perform any work under the RGP where the discharge of dredged andior fiU material would occur in the proximity of a public water supply intake except where the activity is for the repair of the public water supply structure or adjacent bank stabilization 16. No activity, including srructures and work in navigable waters of the United States or discharges or dredged or fill material may consist of unsuitable materials (e.g. trash, debris, car bodies, asphalt, etc.) and that materials used for construction or-discharge must be free from toxic pollutants in toxic amounts. 17. The permittee shall, to the maximum extent practicable, design the project to maintain pre-consrruction downstream flow conditions. Furthermore, the work must not permanently restrict or impede the passage of normal or expected high flows (unless the primary purpose is to impound water) and thatthe structure or discharge of fill must withstand expected high flows, The project must provide, to the maximum extent practicable, for retaining excess flows from the site and for establishing flow rates from the site similar to pre-construction conditions. 18. The permittee shall ensure that if the activity appr9ved by the RGP includes impoundment of water, measures will be taken to mmimize adverse effects on the aquatic ecosystem caused by the accelerated passage of water and/or the restriction of flO\v. 19. The permittee shall ensure that all temporary fills, authorized under the RGP, be removed in their entirety and the affected areas returned to pre-construction elevation. 20. Representatives from the Corps of Engineers and/or IDEM may inspect any authorized activity or mitigation site at any time deemed necessary to ensure compliance with the terms and condltions of the RGP, Section 401 wQe, and applicable laws. 21. All work authorized by this RGP must be completed by the expiration date of this RGP or 1 year after the date of the Corps authorization ietteL whichever occurs later. Tfyou find you need mOre time to complete the authorized activity, submit your request for a time extension to this office for consideration at least 3 months before the expiration date. 22. The permittee after completion of work under the RGP shall submit a signed certification,letter regarding the completed work and reqllired mitigation, if applicable. The certifICation letter will include a statement that the work was done in accordance with the RGP authorization including compliance with all general and special conditions and completion of mitigation work. 40 I WQC GENERi\.L CONDITIONS The following conditions shall apply to any person whose project qualifies under the RGP or any NWP aoproved under this cenification: I. The person shall deposit any dredged material in a contained upland disposal area to prevent sediment run-off to any waterbody. The person shall dispose of all dredged and excavated material according to the requirements of329 lAC 10, governing Solid Waste Land Disposal Facilities. The person's project informaTion may be forwarded to the IDEM Office of Land Quality, Industria! Waste Section for revie'A'. Sampling may be required to determine ifthe dredged sediment is contaminated. Failure to properly dispose of contaminated sediment may result in enforcement action. 2. The person shall instaJJ erosion control methods prior to any soil disturbance to prevent soil from leaving the construction site. Appropriate erosion control methods include, bm are Dot limited to, straw bale barriers, silt fencmg, erosion cono-oJ blankets, phased construction sequencing, and earthen berms. The person shall moniwr and maintain erosion control STrUctures and devices regularly, especially after rai.n events, until all soils disturbed by construction activities have been permanently stabilized. 3 The person shall clearly mark the constructjon hmits shown in the attached plans at the project site during construction. 4. The permittee shall allow the commissioner or an authorized representative of the commissioner (including an authorized contractor), upon thepresemation of credentials: (1) to enter upon the permittee's property; (2) to have. access to and copy at reasonable times any records that must be kept LInder the conditions ofthis certiticarion: (3) to inspect, at reasonable times, any monitoring or operational equipment or method; colleCTion. treatment, pollution managernem or discharge facility or device; practices required by this certification: and any wetland mitigation site; and (4) sample or monitor any discharge of pollutants or any mitigation site 5. This granting of Section 40 I Water Quality Certification does not relieve the recipient of the certification from the responsibility of obtaining any other permits or authorizations that may be required for this projector related activities from IDEM or any other agency or person. This certification does not: (1) authorize impacts or activities outside the scope of this certification; (2) authorize any injury to persons or private property or invasion of other private rights, or any infringement of federal, state or local laws or regulations; (3) convey any property rights of any sort, or any exclusive privileges; (4) preempt any dmy TO obtain federal, state or local permits or authorizations required by law for the execution of the project or related activnies; or (5) authorize changes in the plan design detailed in the application N\VP/RGP SPECIFIC CONDITIONS: The following conditions apply to Regional General Permit Nc. 1 and Nationwide Permits 3, 12,27, and 37: An activity that qualities for a Corps of Engineers Regional General Permit or Nationwide Permits 3, 12 (Parts ii, iii, and JV ONLY), 27, or 37 is authorized pursuant to this Section 401 Water Quality Certification (WQe) if: The activity will impact one-tenth (0.1) of anacrc or less of Waters of the United StaTes I, including wetlands, special aquatic sites, creeks, ditches, streams, rivers, deep water areas, or open water areas; and The activity will impact 300 linear reet or less of stream channel or shoreline, excluding the activities described in Condition 3 of this WQC Fill must conform to the existing contour oftht: shoreline or bank and shall not exceed one cubic yard per linear foot. Fill shall not project into any so-earn or open body of water. For any project involving bridge constrUction or maintenance, the limits of bank impact are measured from the centerline of the bridge to a maximum projection of 150 linear feet upstream and downstream; and The activity is part of a single and complete project. All aCTiviTies that exceed the above impact thresholds require an individual Section 401 wQe from IDEM and are not authorized under this WQe. No stream channel relocation, stream piping, or stream channelization activity is authorized under this WQe. Channelization includes any activity that alters a stream channel either by dredgmg., excavating, or bank armoring in order to straighten. deepen, or otherwise alter the now path and velocity of water traveling within the channel. Stream pipmg for the purpose of creating a crossing is permitted, but may nm exceed 150 feet in order to qualify under this condition. Any activity involving fill that is associated with additional impacts to Waters of the United States, such as dredging, excavation, damming, or creation of in-channel ponds, is not authorized under this WQe. No activity is authonzed under this WQC if it is to be conducted on or in any of the state.' s waters that have been deslgnated by tbe Water Pollution Control Board as:salmonid waters (cold water streams), Outstanding Smte and/or National Resource Waters, and Exceptional Use waters. (see Attachment #1). Additionall)', no actlvity is authorized under this wQe if it is to be conducted on or in (a) any wetland adjacent to, or (b) any tributary within a two river mile reacn upstream from the outlet to, such designated waters. No activity is authorized under this wQe where state endangered, threatened, or rare species are documented on a pemanent or seasonal. basis wlthin a 1!1-mile radius of the proposed project site by the Indiana Natural Heritage Data Center. No activity is authorized under this Section 40 i \Vater Quality Certification if it is to occur in any critical Wetland or critical special aquatic Site listed on Attachment #2. The IDEM Notification Form shall be completed, signed, and provided to IDEM by the permittee at least 45 working days prior to tbe proposed waterbody impact for all activities in which an individual Section 40 I wQe is norrequired. NOTE A Notification Form is not required when the proposed activity meets all of the terms of the Special Conditions outlined in tIns letter. Al] dredged and excavated material must be disposed of according to the requirements of 329 lAC 10, governing Solid Waste Land Disposal Facilities. All discharges ofretum water from disposal facilities into waters of the state are subject to NPDES and other water quality requirements set forth in 327 lAC 5 and 327 LA.C 2. All permittees must compiy with all other applicable provisions of state law, including the provisions of 327 lAC 15-5 and 327 lAC 15-6. IDEM will evaluate the cumula,ive effects of this General Permit annually. If at any time IDEM determines that the General Permit does not comply with Indiana Water Qualiry Standards on a cumuiative basis, IDEM will revoke or modify the Section 401 Water Quality Certification. In order to verify th'lt a given projecr will qualify under the terms and conditions of this certification, IDEM may' require additionalinforrnationfrom the applicant. The .Department would also expect that the existing sight distance issue .associated with the location of the entrance to the development be constructed. by the petitioner and thcrt these costs. woulcl be' exclusiVe of the commitment (cannot credit against the commitment), The Department will work with the petitioner on an acceptable solution to the sight distance issue at the next stage of approval. As it relates to Item NO.2 of the items requested at tl1e last meeting, a proper' path to.the west should include construction of a pedestrian crossing of Little (061 Creek. Construction of such a bridge would result in a level of commitment/participation from the developer that is subst~ntialiy higher than commitments/participation Rrovided by recent, similar development-s when considering the. request for roadway improvements and remedying the existing sight distance issue. Tha Department suggests that the petitioner extend the existing culvert as necessary to facilitate the construction of the path acros.s' the frontage. The path may need to be angled out towards the road as it approaches the slightly widened culvert. Construction of the path from the proposed en:trance to the west property line is included in the requested commitment above. Therefore, construction of the multi-lIse path across the frontage as well as extension of the pipe culvert may be credited against the above requested commitment. In any approvals by the plan Commission, the Department requests that such approvals be conditional upon incorporating, Items 16, 24, 25, 27 and 34 of a letter dated January 17, 2086 from Engineering to the petitioner into the final construction drawings.
