Kent Broach was the Hearing Officer. Department of Cormnunity Services Staff in attendance was Rachel Boone. D. Public Hearing: 1 d. Clarian HealthN elocity Sports Performance Building - Sign age The applicant seeks the following development standards variance approval: Docket No. 08020007 V Section 25.07.02-10 (b) Number of signs The site is located at 1402 Chase Ct. and is zoned M-3. Filed by Charlie Frankenberger of Nelson and Frankenberger. Present for the Petitioner: Jim Shinaver, Nelson and Frankenberger, Molly Powell, Velocity Sports Performance, and Lynn Wininger Smith, Director of Business Development Clarian Health. An aerial photograph was shown. Velocity Sports Performance currently occupies the building, providing sports training to its clients. They obtained a Use Variance for this business at this location in 2006. Currently the only sign on the site is the Velocity Sports Performance sign on the northern elevation of the building facing toward Carmel Drive. The building in front of this one and some of the landscaping partially screen the sign. In 1997 the previous owner, Line Systems, obtained a sign variance to permit their sign to be on the northern elevation. As part of that sign variance approval, they made a commitment that would limit the number of signs to one. When Velocity Sports took over operation at the site, they replaced the old sign. Clarian Health Partners has entered into a relationship with Velocity Sports. They will be sharing space in the building, providing human motion services. This relationship will benefit both companies as well as the people in the community for both rehab and sports performance. In order to identify Clarian' s presence, they want to construct a ground sign on the property. A site plan was shown with the location of the building and the ground sign. A rendering of the proposed sign was shown for location and scale. In order to identify Clarian's presence in the building, a sign variance is needed for the additional sign on the property. They would also need a modification of the prior zoning cormnitnlent fronl 1997. In talking with Staff, he had provided a type of certification that could be used to record the commitnlent with the County Recorder, if this request is approved. It would show how the prior commitment was varied. It would then pemlit only two signs on the site; the existing wall sign and the additional ground sign. Traffic does move quickly along Carmel Drive and they are hoping to provide notice to travelers so they can see the location and have enough time to maneuver their car to the Chase Court entrance. Members of the public were invited to speak in favor or opposition to the petition; no one appeared. LJ The Public Hearing was closed. Miss Boone gave the Departnlent Report. As stated by the Petitioner, this site was permitted only one sign per a previous commitnlent. They only have one street frontage, so they were only allowed one sign. The Department recommended positive consideration of the request because the 32 square feet Carmel Board of Zoning Appeals Hearing Officer March 24, 2008 signage requested is significantly less than the permitted 60 square footage for the size of the building ::.J'. and the distance from the right-of-way. Ms. Powell stated it will be illuminated by small spot lights. Miss Boone stated it would be four feet tall and eight feet wide. Mr. Broach wondered why they had made the commitment. Miss Boone and Mr. Shinaver did not know. Mr. Shinaver had looked at the prior file. All he could find were the minutes of the meeting that did not shed much light as to why they made the commitment. He thought maybe some of the thought process at the time involved not knowing how this area was going to develop out. Maybe they were trying to be cautious and conservative. This stretch of Carmel Drive and Chase Court has changed a lot over the years.
