Jason - I do not think there is a separate BPW review/approval fee. (I have copied dick hill on this email and he
can let you know.)
I am pretty sure that there is only a replat application filing fee.
There is also a fee for recording the final, approved document at the recorder's office in Noblesville.

The neighbor would not give back that part of the sliver where his retaining wall is located. So, we are only
getting back the 2 foot by 5 foot strip suggested in your option #1. The neighbor will retain ownership of the rest
of the sliver all the way back to the rear lot line. We just get 50 feet on the roadway.

Here is a strange thought: Since the sliver of land that was split off illegally and will now be added back to
the original lot, does it need a replat application at all? It could be interpreted that since the land will soon
be shown as what was originally platted/approved, that it does not need a replat; it would only need a new
survey of the land to show that it does indeed correlate with the originally- platted lot #83. Your thoughts
on this???? (You are essentially bringing it back into compliance.)

We are going with the first option you mentioned below and we will take title to 50 foot of frontage from the
sellers at closing hopefully this Friday morning, December 21 st Their neighbor is going to deed back a
small strip near the road but not the entire strip deeded back in 1999. We are !)Ianning to go through the
replat process post-closing and want to make sure the expected costylreinCTude on our closing
statement. Rick with Hahn Surveying will be putting together the r plat survey and is providing us his
costs. Is there a Board of Public Works review fee in addition to e $277.507 Do s your fee include
recording costs? Let me know if you are aware of any other cas s. Thanks.

Good afternoon, Jason:
Regarding the prior sell off of land (which was not legal from a planningfzoning standpoint):
Technically, the two lots, 83 and 84, should have been replatted, so that their common lot line would
be shifted to the east. But also, some land should have been left near the road right of way to keep
lot 83 legal in its lot width at the road right of way. The easiest way, planning-wise, to remedy the
issue af the less than 50-ft lot width at the road right of way is to hire an engineer/land survey to
replat lots 83 & 84 This will re~uir. al,you buy some land back from the neighbor to the east, but
only enough to make it so you h. . e 50-ft\Of road frontage along cool creek court. So, it mig ht be
something crazy like a 5 ft by ft piece of and. The replat process is all administrative in
review/approval. The filing feelis $277.50. he application is online at

20200IJldf This can be finali edjD"about 2-3 weeks. Board of Public works would have to sign off
on the new plat which will then et recorded.
If you cannot buy back a small area of land, then the next way to remedy the issue is to seek a
subdivision waiver reguest from the plan commission. The subdivision control ordinance, chapter
6.05.01 requires that each lot has a minimum lot width of 50ft at the road right of way.
