(I have copied dick hill on this email and he can let you know.) I am pretty sure that there is only a replat application filing fee. There is also a fee for recording the final, approved document at the recorder's office in Noblesville. So, we are only getting back the 2 foot by 5 foot strip suggested in your option #1. The neighbor will retain ownership of the rest of the sliver all the way back to the rear lot line. It could be interpreted that since the land will soon be shown as what was originally platted/approved, that it does not need a replat; it would only need a new survey of the land to show that it does indeed correlate with the originally- platted lot #83. Your thoughts on this???? (You are essentially bringing it back into compliance.) Subject: lot 83 in clay creek north, section 3 Good afternoon, Jason: Regarding the prior sell off of land (which was not legal from a planningfzoning standpoint): Technically, the two lots, 83 and 84, should have been replatted, so that their common lot line would be shifted to the east. But also, some land should have been left near the road right of way to keep lot 83 legal in its lot width at the road right of way. The easiest way, planning-wise, to remedy the issue af the less than 50-ft lot width at the road right of way is to hire an engineer/land survey to replat lots 83 & 84 This will re~uir. al,you buy some land back from the neighbor to the east, but only enough to make it so you h. . e 50-ft\Of road frontage along cool creek court. Board of Public works would have to sign off on the new plat which will then et recorded. If you cannot buy back a small area of land, then the next way to remedy the issue is to seek a subdivision waiver reguest from the plan commission.
