FINDINGS OF FACT - DEVELOPMENT STANDARDS VARIANCE 1. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because: the siqn will be located 5 feet behind the line of the 96th Street riqht-of-wav line extended, which would exclude the unused riQht-of-wav. A Consent to Encroach has been approved bv the Carmel Board of Public Works and Safety. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the siqn is small of size and small of heiQht and is arChitecturally compatible with the USTA buildinq. 3. The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: the occupants of the buildinq need identification on 96th Street for visitors who have identified their presence from 1-465. This qround siqn is necessary to quide the travellinQ public to the correct buildinq access point on 961h Street in a safe manner. DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Development Standards Variance Docket No. OB02ot.>()b is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. day of Ap{'; t ,2008.
