The Department is agreeable to the commitments outlined below.
There is still an outstanding issue related to obtaining permission from the property
owner to the west to relocate the existing curb cut due to the fact that the curb cut ~s
at a location approved by the BPW. The proposed curb cut does not align with the existing
curb cut. Ersal has been in contact with the property owner to discuss this very issue;
however they do not have it resolved.
Engineering will support approval of the project tonight conditioned upon the petitioner
formalizing the commitments below as well as the petitioner providing a commitment to
resolve any issues related to property access to the satisfaction of the Department of
Engineering prior to obtaining final approval of the construction plans for the project.

Good morning Gary,
In reply to your email, there are 2 interrelated matters; namely, the access easement
for the property to the south (the "Southern Land") and (ii) the opposing road cut on the
west side of Old Meridian (the "West Cut"). Regarding these, our resolutions are as
follows:
I-Regarding the easement for the Southern Land, our filed plans identify a proposed future
drive by others and an access easement. If and when the Southern Land is developed, the
owner of the Southern Land, at its expense, can (i) install another paved lane on
Keystone's land and (ii) connect to the Southern Land. This may require the owner of the
Southern Land to relocate utilities, and move the ground sign, etc..., but the ability to
connect is identified on the filed plans.
2-Regarding the West Cut, Keystone agrees, at its expense, to move the existing west cut
to the south, so that the centerline of Keystone's cut (on the east side of Old Meridian)
aligns with the West Cut. Then, if and when the Southern Land develops and another
entrance lane is added, the developer of the southern land may be required, in the DOE's
discretion, to again relocate the west cut a little further south so that the centerline
of the 2 opposing cuts continues to align.

Thank you for indicating the proposed ingress/egress easement to the property to the
south. The conditions outlined below are acceptable and as we have discussed in the past.
As it relates to the West Cut, I believe what has been outlined below is only half of the
issue. The ather half of the issue raised by Mike is related to the fact that the existing
curb cuts are located as approved by the BPW. What conversations have taken place between
the property owner to the west related to the curb cuts? Provided that Keystone is willing
to bear the cost to reconstruct the drive, is the property owner still agreeable to a
shift in the alignment?

Hi Angie and Christine,
As you know, on 4/1 the Special Studies Committee returned us to Plan Commission with a favorable
recommendation. In this regard, because plan revisions were nominal and there was very little additional information, at
the conclusion of the Committee meeting it was suggested that we need not reproduce the brochures reviewed by the
Plan Commission in March but, instead, that we email the minor changes. To this end, I have attached:
1-An illustration of the bike rack;
2-An illustration of the wall sconce light fixture;
3- The greater detail of the sunscreen requested by the Department;
4- The landscape plan revised only to (i) include more landscaping around the dry detention area and (ii) relocate utilities
in the utility easement away from landscaping; and,
5-A rendering of the landscape plan revised to better correspond to 4 above.
All of the above were previously filed but not included in the Plan Commission's informational brochures. Also, the full-
sized, revised landscape plan was previously filed and has been reviewed by Scott Brewer.

Per our conversation earlier this week, we have updated the attached Old Meridian landscape plan and structural
soil limits on the grading plan for your review and approval. The following are items that have been updated.
Items addressed on Landscape plan.
1. Showed limits of structural soil on engineering and landscape plans.
2. Moved water line closer to parking lot and moved perimeter trees closer to PL.
3. Updated missing label on parking island oak trees and added label to show plane trees in parking island.
4. (2) oak trees along parking edge where future building is located have been shifted to end islands. Center
oak tree has changed to planetTee and remained in the center island.
5. Shifted location of zelkova trees away from utilities at entrance towards the property line.
Once you have reviewed the plans, if you could send me an e-mail confirming the landscape plan meets the
conditions for approval, it would be greatly appreciated. I would be happy to meet with you and/or discuss the
plans over the phone if there are any questions or comments we need to address.

comments over the phone.

4. Try to avoid the utility lines that run along the south perimeter with tree planting.

Dear Bill:
I called today, but you were not in, and I will not be in tomorrow, so I thought I would send an email on some review
comments on this site. I thought that after our last meeting, I would have seen revised plans, but I have not yet. Unless
you send them to me directly, I do not get a copy.
1. On the landscape plans (or at least in the packet) there needs to be graphic standard planting details. You may
use Carmel's ( attached ), or you may provide your own, as long as they have the same information.
2. For the rear bufferyard, it is preferred to preserve the existing trees as you are doing, just show the bufferyards as
being fenced off with tree protection fencing graphically.
3. Species notes: I would prefer to have the red oaks on the perimeter of the parking lot, instead of in the islands
where they could take advantage of the "unlimited" soil volumes. For parking lot islands, you should use a more urban
tolerant species, like London plane tree instead of oaks or maples, unless you are going to use structural soils or the
equivalent under the pavement.
4. Structural soils or Deep Root's Silva-Cell product should be used under the sidewalk or street pavement in front of
the building to increase the rooting soil volumes of the ginkgos along the street. I have attached information of these.

Hi everyone
Thanks you for the helpful meeting and the follow-up letter. I had some questions on the variances:
1- The exterior of our awnings will be canvas or some other non-metallic finish. Consequently, I do not think that we need
a developmental standards variance (UDVS") from 20G.04.01.J prohibiting metal and aluminum awnings. Please confirm.
No, you would not need a variance for the awnings.
2-The buildings may have a sunscreen for the upper stoty tenants, which will be be painted metal and, as such, will not
have a reflective surface. Please confirm that this will not require a DSV.
Depending on the design, the sunscreens may be considered awnings, and thus would need a variance.
3-When the awning is included in the length of the building, then the building occupies more than 70% of the street
frontage. In light of this, please confirm that a from DSV 20G.05.04C.1 is not required.
How much does the building itself occupy? The awnings would not really be considered as part of the building, since they
aren't structural, but if the building is close to the required minimum without them, it would be a minor deviation, although
you still would need a variance.
4 In the drawings last reviewed with you, one pole light, located within 90' of the closest boundary line of the
adjacent residential use, exceeded 15'. We will reduce to 15' the height of this pole light. Please confirm that this
replacement eliminates the need for a DSV from 20G.04.04.C.
