Additionally, the project is not located in the same localized drainage basin as the property across the street, so it should not exacerbate any existing drainage issues in that area. As Jarrod indicated below, please direct any existing drainage complaints to his attention, and if any unforeseen issues present themselves from this project, we can address them at that time. Noted from the callers most of them had concerns from the stormwater runo? created from the backyard w/ Pool and Patio at 1142 Linden Lane. One of the neighbors that called lived at 1154 Linden Lane and mentioned a City Engineer came out to their property and told them to install a rock garden to help with the drainage. They mentioned after all the rain we had in the last few weeks; their backyard was under water. The applicant seeks the following development standards variance approval for a garage addition on a corner lot: Docket No. PZ-2025-00068 V UDO Section 2.08 Minimum 20-ft rear yard setback required; 15-ft requested. The 0.48-acre site is located at 863 Carey Rd (Cool Creek North, Lot 160). It is zoned R- 1/Residence. Filed by Brianna Cushman and Lance Cleland, Rise Builders LLC., on behalf of Zechariah & Kristyn Smith, owners. Several neighbors have called in, already, voicing concerns about drainage in the immediate area, and one called in about the property to the north (across the street) having drainage issues. Also, building permit B-2025-00207 - 863 Carey Rd: Residential Building - Addition and Remodel is in review in ProjectDox, and Willie’s only review comment was regarding BPW approval for the new/additional curb cut. We want to make sure that this project has been thoroughly reviewed from a grading and drainage standpoint, so that we can confidently add a note to the BZA Dept. Report that the Engineering Dept. has no concerns (and maybe that they will also investigate the drainage complaints). Is it safe for us to include that comment? Please let us know by the morning of Wed., April 23 (since the BZA Dept. Report will be finalized and distributed that afternoon). Thank you! The filing deadline for the April 28 BZA Hearing Officer meeting, has passed, but as we discussed, if you can submit your online application by today, we will accept and put your item on the April 28 meeting agenda. The deadline for your published public notice must be emailed to the Current in Carmel no later than NOON, Friday, April 4. Your building permit B-2025-00207 for 863 Carey Road was flagged for the proposed garage addition encroaching into the rear yard setback (eastern property line, corner lot). If you cannot amend your plans to move the addition structure out of the 20-ft setback, then a Development Standards Variance would be needed for rear yard setback. Your variance request will be the following: UDO Section 2.08: Minimum 20-ft rear yard setback required; 15-ft% requested. Also noted in your building permit, the current attached garage will be converted into living space and that the existing driveway will be removed. Since the existing garage will be converted to living space, it will not be counted towards the combined sq. ft. of the GFA of a private garage and/or Accessory Bldg. Planning Staff can be supportive of having your item heard by a BZA Hearing Officer, rather than the full 5- member Board of Zoning Appeals if you have Cool Creek North HOA approval, and the Carmel Engineering Department and Board of Public Works (BPW) doesn’t have any issues with your additional curb cut on Linden Lane. Please work with Caleb Warner of the Engineering Dept. Also, as we discussed, please provide us with a letter/email of support from the direct neighbor to the east at 1171 Hemlock Street – Thomas & Alecia Larkin. Hearing Officer Variance items have a lesser filing fee, a more compressed timeline, and are more likely to be approved. Attached is a Handout about the Board of Zoning Appeals (BZA) Hearing Officer Development Standards Variance process that contains all the instructions, checklist, public notice templates, affidavits, etc. Staff is here to help you go through this Variance process. With variances, you have to prove a practical difficulty or hardship as to why you cannot comply with the Carmel UDO. BZA meetings occur on every 4th Monday of the month.
