MONDAY, APRIL 22, 2024
(V) 3710 Brian Place, Alexander Pool Pergola Variance.
The applicant seeks the following development standards variance approval:
3. Docket No. PZ-2024-00043 V UDO Section 5.02 (B) Minimum 35-ft front yard building
setback required for this Corner Lot, 23-ft requested.
The site is located at 3710 Brian Pl. (Woodland Springs subdivision, Lot 250). It is zoned S2/Residence.

General Info:
• The Petitioner seeks approval for a pool pergola to be placed forward of the front setback of the house.
• Related pending building permit is B-2024-00248
• The site is a Corner Lot with two street frontages, hence two front yards.
• The existing swimming pool was installed in 2017.
• The site is located in Woodland Springs subdivision, and HOA (Homeowners Association) approval has
been granted.
• Surrounding this site are single family residential homes.
• Please see the Petitioner’s info packet for more detail on the variance request.
Variance Requested:
Accessory Building Setback -
• The UDO requires that Accessory Buildings on a corner lot shall not be erected forward of any building or in
any required minimum front yard.
• The required minimum front yard setback for this lot is 35 feet, and 23 feet is proposed. This is a 12 foot
variance, or a 32% change.
• There are tall arborvitae shrubs that are planted along the sidewalk along Dona Drive, along the northwest
corner of the lot which can aid in screening the structure from view.
• The open air pool pergola structure will be made of wooden posts and a slanted roof. It will be around 13 feet
tall. The sloped roof will be made of black shingles or black standing metal seam. The wooden posts will be
white in color or will be a natural wood color.
Remaining Review Comments:
• The Petitioner addressed all planning/zoning review comments.
Final Comments:
• The Planning Dept. supports the variance request. The pergola will be placed in a way to provide shade to
users of the pool in the afternoon hours, and the existing landscaping along the street will aid in screening it
from view.
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and
with adoption of the Findings of Fact submitted by the Petitioner.
