The applicant seeks the following development standards variance approval: 5. Docket No. PZ-2024-00050 V UDO Section 5.09 (Fence and Wall Standards) Maximum 6' tall fence along side/rear property line allowed, 8' requested. (Also, minimum 25% visibility required; 0% visibility requested.) The site is located at 837 Bridle Ct. (Hunter’s Creek Village, Lot 45.) It is zoned R1/Residence. Filed by Stephen & Abigail Zisk, owners. General Info: • The site currently has a 6-ft tall fence in the back yard, and the owner seeks to replace it. • The Petitioner seeks approval for an 8-ft tall fence in the backyard, when only 6-ft is allowed. • The site is located in Hunter’s Creek Village Subdivision; and there is no HOA (Homeowners Association) involved. • Surrounding this site are single family residential homes. • Pending fence permit is F-2024-00082. • Please see the Petitioner’s info packet for more detail on the variance request. Variance Requested: Fence Height - • The UDO allows for a maximum 6-ft tall fence along the side/rear property lines, and an 8-ft tall fence is requested. (This is a 2-ft variance, or a 33% change.) • There is a slight slope on the land, so the house sits a little higher in elevation than the back yard area and rear property line areas. The lot contains some slope, with an 868-ft elevation along the front property line, sloping down to 864-ft elevation at the back corner. The house is situated on an 869-ft elevation. • The proposed fence will be an 8-ft tall wooden privacy fence. Remaining Review Comments: • The Petitioner addressed all planning/zoning review comments. Final Comments: • Due to the grade change in the back yard, the Planning Dept. supports the variance request. Findings of Fact: • Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet. Recommendation: • The Dept. of Community Services (DOCS) recommends positive consideration of this variance request, and with adoption of the Findings of Fact submitted by the Petitioner.
