COUNCIL CHAMBERS/CITY HALL/ONE CIVIC SQUARE MEMBLRS PRESENT: Mayor James Brainard, Council President Richard L. Sharp, Council Members W. Eric Seidensticker, John V. Accetturo, Joseph C. Griffiths, Luci Snyder, Ronald E. Carter, Kevin Rider and Deputy Clerk- Treasurer Lois Fine. Clcrk-Treasurer Diana L. Cordrav was not in attendance. Mayor Brainard opened the meeting at 6:03 p.m. Father Mel Bennett, Senior Associate Pastor, St. Elizabeth Selon Catholic Church, pronounced the Invocation. Mayor Brainard led the Pledge of Allegiance. 1 RECOGNITION OF CrrY EMPLOYEES AND OUTSTANDING CITIZENS: There were none. APPROVAL OF MINUTES: Councilor Griffiths made a motion to approve the Minutes of the May 5, 2008 Regular Meeting.. Councilor Rider seconded. There was no Council discussion. Council President Sharp called for the question. Minutes were approved 7-0. RECOGNITION OF PERSONS WliO WISH "rO ADDRESS THE COUNCIL: Jennifer Dzwonar, Borshoff, presented a US 31 Design Report to the Council. Steve Fleming ofRW Armstrong made a presentation to the Council. Also in attendance was Gary Pence, Project Management Engineer, Indiana Department of Transportation. There was brief Council discussion. Mayor Brainard addressed the Council. COUNCIL MAYORAL AND CLERK-TREASURER COMMENTS/OBSERVATIONS: There were none. ACTION ON MAYORAL VETOES: There were none. CLAIMS: 1 Councilor Griffiths made a motion to approve claims in the amount.of S2,371,110.62. Councilor Snyder seconded. There was no Council discussion. Claims were approved 7-0. COMMITTEE REPORTS: Council President Sharp reported that the Finance, Administration and Rules Committee had not met. The next meeting will be held on Thursday, May 29, 2008. Council President Sharp reported that the Land Use, Annexation and Economic Development Committee had not met. Councilor Carter reported that the Parks, Recreation and Arts Committee met and discussed the Monon Center, and the hiring of a Revenue Facilities Manager. They also discussed accrual accounting for the Motion Center. A note has been sent to the Clerk-Treasurer's office asking for a report to be given to the Council. Council President Sharp reported that the Utilities, Transportation and Public Safety Committee had not met. Councilor Seidensticker informed the Council they did not meet due to the fact there was no quor un. They were to discuss Ordinance D-1893-08, D-1894-08 and D-1896-08. Councilor Seidensticker requested that Council President Sharp remove these items from the Committee and vote on them this evening. 1 OLD BUSINESS Council President Sharp announced the Fifth Reading, of Ordinance D-1887-08 As Amended; An Ordinance of the Common Council of the City of Cannel, Indiana, Issuing City of Carmel, Indiana Waterworks Revenue Bonds of 2008, in one or More Series, in an Original Principal Amount not to Exceed Eighty Five Million Dollars (S85,000,000); Sponsor: Councilor Snyder. Councilor Snyder addressed the Council and made a motion to Withdraw this item. There were no objections. Council President Sharp requested that the Finance, Administration and Rules Committee, along with the Director of the Human Resources Department, prepare a thorough analysis of the Council's total compensation prior to the end of this year. This comparison should include cities in the State of Indiana and throughout comparable cities in the Midwest. There was brief Council discussion. Councilor Carter seconded. Councilor Seidensticker asked that the motion to approve and the motion to second be withdrawn because there is an amendment that needs to be discussed. Council President Sharp asked for withdrawal of the motion and the second on Ordinance D-1896-08: Councilor Griffiths withdrew his motion. Councilor Carter withdrew his second. Councilor Seidensticker made a motion to present Amended Version l - 5/19/08 by amending line 23 (change 4:00 a.nr. EST to 6:00 a.m. EST). Councilor Rider seconded. There was no Council discussion. Council President Sharp called for the question. The motion was approved 7-0. Councilor Rider made a motion to approve Ordinance D-1896-08 As Amended. Councilor Seidensticker seconded. There was no Council discussion. Council President Sharp called for the question. Council President Sharp addressed the Council and clarified the procedure for withdrawing an ordinance. PUBLIC BEARINGS Council President Sharp announced the First Reading of'Ordinance Z-518-08; An Ordinance of the Common Council of the City of Carmel, Indiana, Rezoning the West Park Annex from the S-1 /Residence District Classification to the P- I/Parks & Recreation District Classification (40 acres of land west of West Park - 116°i Street). Councilor Griffiths made a motion to move this item into business. Councilor Seidensticker seconded. Councilor Rider referred to Mark Westermeier, Director, Cannel Clay Parks and Recreation, to present this item to Council. There was brief Council discussion. Council President Sharp opened the Public Hearing at 6:48 p.m. Seeing no one who wished to speak, Council President Sharp closed the Public Hearing at 6:49 p.m. Councilor Rider made a motion to suspend the rules and not send this item to committee and vote this evening. Council President Sharp referred Ordinance Z-518-08 to the Land Use, Annexation and Economic Development Committee for further review and consideration. 1 NEW BUSINESS There was none. 3 OTHER BUSINESS a. Council President Sharp requested that Deputy Clerk-Treasurer Lois Fine prepare a letter to Baker Hill Corporation and Oxford BioSignals and inform them that they are non- compliant. ANNOUNCEMENTS Councilor Seidensticker addressed the Mayor regarding a request to provide an explanation of why the 2006 Road Bond bid was over budget. Mayor Brainard stated that Mike McBride would provide the Council with an explanation at the next meeting. Councilor Carter reminded the Council and the citizens of Cannel that the Farmer's Market will open on May 31, 2008.
