CARMEL BOARD OF ZONING APPEALS HEARING OFFICER
DEPARTMENT REPORT
MONDAY, APRIL 28, 2025
(V) Smith Garage Addition Setback Variance.
The applicant seeks the following variance approval for a garage addition on a corner lot:
9. Docket No. PZ-2025-00068 V UDO Section 2.08 Minimum 20-ft rear yard setback
required; 15-ft requested. The 0.48-acre site is located at 863 Carey Rd (Cool Creek North, Lot 160). It is
zoned R-1/Residence. Filed by Brianna Cushman and Lance Cleland, Rise Builders LLC., on behalf of
Zechariah & Kristyn Smith, owners.
General Info:
• The Petitioner seeks approval to add a garage addition and driveway to the east side of the house, as well as
convert the existing west garage area into living space and remove that west driveway.
• The proposed garage addition will encroach into the rear building setback (along the east property line), and
so BZA variance approval is requested.
• The site is in Cool Creek North subdivision; however, it was stated that an active HOA (Homeowner’s
Association) does not exist.
• The proposed garage addition will not encroach into any drainage or utility easements.
• The site is a Corner Lot with two front yards and two street frontages – Carey Rd. and Linden Ln.
• Surrounding this site are single family residential dwellings.

Variance Requested: Rear Setback -
• The UDO requires a minimum 20-ft rear yard building setback, and 15-ft is requested. This is a variance of 5
feet, or a 25% change.
• The exterior colors and materials of the addition will complement the existing house.
• The east side of the garage addition, facing toward the adjacent neighbor, will not have any windows.
Remaining Review Comments:
• All Planning/Zoning comments have been addressed.
Final Comments:
• The Planning Dept. supports the variance request, since the Engineering Dept. has no concerns.
• The Carmel Engineering Dept. and Board of Public Works (BPW) have no issues with the additional
driveway curb cut on Linden Ln. That request has been approved by the Carmel Engineering Dept., and a
Right-of-Way permit (RW-2025-00140) has been issued with the condition that additional sidewalk panels
along Carey Rd. that were identified by the inspector as trip hazards are to be replaced as part of the project.
• The Carmel Engineering Dept. also reviewed the grading/drainage plan for the project and have no concerns.
The plans for the project adequately demonstrated that the drainage from the project area would be conveyed
in an acceptable manor. Additionally, the project is not located in the same localized drainage basin as the
property (north) across the street, so it should not exacerbate any existing drainage issues in that area. (Any
existing drainage complaints should be directed to the Carmel Engineering Dept. (Jarrod Huff), and if any
unforeseen issues present themselves from this project, they can be addressed.)
Findings of Fact:
• Please refer to the Petitioner’s Findings of Facts included in their BZA Info Packet.
Recommendation:
• The Dept. of Community Services (DOCS) recommends positive consideration of the variance request, with
the adoption of the Findings of Facts submitted by the Petitioner.
