RESOLUTION CC 04-07-25-01-A As Amended RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA ALLOWING EMERGENCY WAIVER OF APPLICABLE PERMIT FEES RELATED TO THE EMERGENCY WEATHER EVENT Synopsis: This resolution provides authority to City officials to waive applicable fees collected through the Department of Community Services for residential and commercial properties where the work is connected to damage caused by the Emergency Weather Event that is the subject of Executive Order SF-2025-03. WHEREAS, on or around April 2, 2025, the City of Carmel, Indiana, (“City”) was impacted by an emergency weather event, including excessive rain, wind damage, downed power lines and trees, and public, residential, and commercial structure damage, as well as life safety issues (“Emergency Weather Event”); and WHEREAS, on April 3, 2025, under Indiana Code Section 10-14-3-29, as a result of the Emergency Weather Event, Mayor Sue Finkam issued a Local Disaster Emergency Declaration under Executive Orders SF- 2025-02 and SF-2025-03; and WHEREAS, the Common Council of the City of Carmel, Indiana, (“Common Council”) at its April 3, 2025 Special Emergency Meeting, took emergency action by allocating up to Two Hundred and Fifty Thousand Dollars ($250,000) to the City and Fifty Thousand Dollars ($50,000.00) to Carmel Clay Department of Parks and Recreation to assist with the cost of emergency disaster relief from the Emergency Weather Event; and WHEREAS, significant work to restore residential and commercial structures throughout the City will be required; and WHEREAS, the City has certain building, planning, and engineering permit fees for work performed on residential and commercial property under Carmel City Code and the Unified Development Ordinance; and WHEREAS, the Common Council desires to provide authority for the City officials to waive any applicable building, planning, and engineering permit fees, for both residential and commercial properties, when the permit is associated with repairs resulting from the Emergency Weather Event; and NOW THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF CARMEL, INDIANA AS FOLLOWS: Section 1. The foregoing Recitals are incorporated herein by this reference. Section 2. The Common Council hereby provides authority for the City officials to waive any applicable permit, inspection, review, etc. fees for both residential and commercial properties when the permit is related to repairs required as a result of the Emergency Weather Event and only when the applicant provides sufficient evidence, as determined by the City official, to support such a determination. Applications must be submitted no later than one (1) year from the date of execution of this Resolution. Section 3. Any decision to waive fees under this Resolution shall be at the sole discretion of the City official and shall in no way provide the applicant with any right(s) to receive the waiver and/or challenge the decision of the City official. Should an applicant be denied the waiver of a fee, the applicant can reapply provided they have new information that is relevant to fee waiver request. The authority to waive fees for any applicable permit, inspection, review, etc. fees for both residential and commercial properties shall in no way alter the necessity for an applicant to apply for said permit, inspection, review, etc. as otherwise required by the Carmel City Code and the Unified Development Ordinance. Section 5. This Resolution shall take effect immediately upon its passage by the Council and approval of the Mayor.
