AND CITY CODE VIOLATION— NO VALID PERMIT Dear Sir or Madam: This letter is being provided to inform you that this Department has some concerns regarding the condition of the property, as well as the safety of the structure located upon the property at 11075 Pennsylvania Street, a property listed under your ownership. On February 19, 2008, a simple site visit was performed, which revealed that a structure on the site has been constructed behind the main building, without the issuance of a valid building permit, the review and approval of site drawings and building plans, and completed and passed inspections. Please be advised that Section 29.04.02 of the Cannel/Clay Zoning Ordinance, as well as Section 7-9(a) of the Carmel City Code refer to the necessity of acquiring the required building permits: 9 7-9 Application for Permits and Builder Information. (a) It shall be unlawful for any person or entity to construct, alter, repair, remove or demolish any building or structure, or to commence construction or the alteration of real estate, without first filing a written application with the Director and obtaining an improvement location permit or other appropriate permit regarding same, unless the submission ofsame is expressly excused by applicable law. Please respond by filing the proper permit application and supporting documentation for the existing structure or completely removing the structure no later than April 18, 2008. The failure to provide such information or remove the structure will result in further action by the City of Carmel. If you have any questions regarding this matter, please contact me at 571-2476. This is a temporary structure that we constructed for the convenience of our staff who smoke. We were unaware that it would require the permit stipulated in your letter. As this is merely a considerate thing to do for our staff, we will not pursue application for a permit but rather will remove the structure completely.
