IN 46033 RE: CITY CODE VIOLATION — TRASH AND DEBRIS Dear Sir i Madam: This letter is being provided to inform you that an inquiry was made to the Department of Community Services regarding a possible City Code Violation at 11 Lakeview Ct., in the City of Carmel, a property listed under your ownership. An inspection revealed that the concern appears to be valid and that the property is in violation of the Carmel City Code, §6-77(k), which construes the following conditions to be public health nuisances: (k) Any accumulation of junk, rubbish (to include trash bags in front), scrap metal, automotive parts, building materials, machinery, dead trees, or parts thereof, upon any premises in a residential area. Please bring the condition of this property into compliance with the Carmel City Code by May 30, 2008. Failure to resolve the violation(s) by the specified deadline will result in further enforcement action by the City of Carmel, to include City abatement of both issues (to which property owner is billed). I am attaching a photo demonstrating various violations of city ordinances. I believe my neighbors on the other side of this address (Ellen & Anthony Roberts at 10 Lakeview Court) have also either called or e-mailed to complain. Here are our complaints in case you can't read the notations I made on the photo. 1. He has 1-2 cars parked along the curb everyday with their rear ends sticking out into the court. This blocks access to our trash service, mail service, and is an inconvenience to neighbors as we have to be extra careful not to hit the cars when pulling into & out of our driveways. Also they frequently have small children playing in the street without supervision (as evidenced by the bikes in the picture.) The cars block visibility of the children & I am afraid they will get hit by a car someday. 2. It is obvious that parking in this manner is a regular habit when you notice that they have gone so far as to put a railroad tie parking barrier along the curb in that location. 3. Did I mention there is also a fire hydrant there? 4. They have planted 3 trees (I believe apple) on the grassy area between the sidewalk and the street. I am sure this is not legal and certainly is not in the best interests of the city or neighborhood. 5. The trash bags visible in the picture contain leaves & have been there since last fall. 6. He put the large boulders visible in the picture there after he was told by the city last year to move his gutter drainage line back 25' from the sidewalk. He moved the gutter drainage back about T from the sidewalk and then hid it with these boulders. The gutter line is still essentially draining on the sidewalk. The area was practically an ice rink last winter. 7. The property is weedy and generally unkempt. Please let me know if I need to address my complaints to a different department.
