By-Laws and Covenants and to enable the formation
of a functional community by sharing information. Th is is a
Neighborhood Crime Watch Community. Please report any
suspicious activity to the police at 571-2580 or 911. Know your
neighbors and be observant.
Th e neighborhood maintains the sign on the 126th Street en-
trance.

Neighborhood Bylaws
Article I Name
Th e name of this not-for-profi t organization shall be the Brookshire Pines Neighbor-
hood Association, Incorporated.
Article II Purpose
Th e purpose of this not-for-profi t organization shall be to combine the individual tal-
ents of the homeowners into a collective strength for the benefi t of the entire neighbor-
hood.
Article III Membership
Th e membership of the organization shall consist of any and all homeowners in the area
within the boundaries listed hereaft er who desire to aid in our purpose and who pay the
required dues.
Article IV Boundaries
Th e boundaries of this not-for-profi t organization shall be the area shown on the map
attached to these Bylaws as Article XIII.
Article V Meetings
Th e regular meeting shall be held in March of each year. Special meetings may be called
by the offi cers. Members of the Association will be notifi ed at least fourteen (14) days in
advance of any and all meetings by a bona-fi de public and / or written notice executed
in good faith.
Article VI Quorum
A quorum for the transaction of the association business shall consist of those in good
standing and present at the offi cial meeting.
Article VII Offi cers
Section 1 Th e offi cers of this organization shall be elected from the membe
ship of the organization. Th e offi cers shall consist of a President,
Vice-President, Secretary and Treasurer.
Section 2 Th e duties of these offi cers shall generally be as follows:
Th e President shall preside at all regular and special meetings and
shall appoint all committees and chairman thereof, subject to the
approval of the offi cers.
Th e Vice-President shall assume the duties of the President in the
absence of the President. He shall also be the liaison with the Area
Representatives for the dissemination of the association business.
Th e Secretary shall keep minutes of the meetings of this organiza
tion.

Th e Treasurer shall have charge of all funds of the organization and
deposit same in the bank designated by the offi cers. Th e Treasurer
shall maintain a record of all receipts and disbursements and report
same at each regular meeting of the organization. Th e offi cers shall
have authority to carry on Association business and maintenance of
the Association property. Expenditures that will exceed $500 in a
fi scal year or that may require a special assessment shall fi rst be sub
mitted to Association members for their vote, with a two-thirds vote
of those present and voting required.
Section 3 Elections shall be held at the March meeting of each year. Th e terms
of offi cers shall run from April 1 to March 31 of each year. No per
son may hold the same offi ce for more than two (2) consecutive years
unless unopposed in the regular March meeting. Offi cers may, if
necessary, be replaced by a two-thirds (2/3) majority vote of the
members present and voting.
Article VIII Nominations
Nominations of Offi cers shall be from the fl oor at the March meeting. No person shall
nominate a member of the Association for an offi ce without that member’s consent. Any
member nominated shall be asked to affi rm that prior consent was given
Article IX Voting
Each owner-resident member household shall have one vote in elections and all other
Association business. Absentee voting will not be permitted, but proxies may be appoint-
ed. Elections shall be by show of hands, in the event of a tie vote the President will cast
the deciding vote
Article X Dues
Membership dues shall be $10.00 per household per year. Dues shall be payable by
March 1 of each year.
Article XI Amendments
Th ese By-Laws may be amended by the membership at a regular or special meeting pro-
viding the membership have been notifi ed at least thirty (30) Days prior to the meeting
of what the proposed amendments are. Th e By-Laws may be amended with a two-thirds
(2/3) vote of the members present and voting.
Article XII Board of Directors
Th e membership may, if desired, elect, appoint, or otherwise designate a Board of Direc-
tors and defi ne what their purpose and duties shall be.

Neighborhood Covenants
1. Th is subdivision shall be known and designated as BROOKSHIRE PINES, a subdivision
in Hamilton County, Indiana. All streets and alleys shown and not heretofore dedicated,
are hereby dedicated to the public.
2. Front and side yard building setback lines are hereby established as shown on this plat,
between which line and the property lines of the street, there shall be erected or main-
tained no building or structure.
3. Th ere are strips of ground as shown on this plat and marked Drainage and utility
Easement, reserved for the use of public utilities for the installation of water and sewer
mains, poles, ducts, lines and wires, subject at all times to the proper authorities and to
the easement herein reserved. No permanent subdivision shall take their titles subject to
the rights of the public utilities.
4. Lots 187, 188, 189, 190, 191, 193, 194, 195 196 and 197 have areas shown on this plat
and marked Drainage and Utility Easement, reserved for the use of public utilities as pro-
vided above and for the temporary storage of storm water. No fences or other structures
are to be erected or maintained upon said easements and no fi lling or grading shall be
done in said areas without specifi c prior approval by the Carmel Plan Commission.
5. All lots in this subdivision are reserved for residential use, and no building other than
a one family residence or structure or facility accessory in use thereto shall be erected
thereon.
6. Not more than one building shall be erected or used for residential purposes on any lot
in this subdivision.
7. Th e ground fl oor area of the main structure, exclusive of one-story open porches and
garages, shall be not less than fourteen hundred (1400) square feet in the case of a one-sto-
ry structure, nor less than one thousand (1000) square feet in the case of a multiple story
structure, provided no structure of more than one story shall have less than an aggregate
of one thousand eight hundred (1800) square feet of fi nished and livable fl oor area. All
garages shall be attached to the residence dwelling and be a minimum of two car size.
8. No trailer, tent, shack, attached shed, basement, garage barn or other outbuilding or
temporary structure shall be used for temporary or permanent residence on any lot in this
subdivision. An attached garage, tool shed or detached storage building erected or used
as an accessory to a residence in this subdivision shall be of a permanent type of construc-
tion and conform to the general architecture and appearance of such residence.
9. No fence shall be erected in this subdivision between the building lines and the proper-
ty lines of the streets as shown on the within plat, except with approval of the Brookshire
Pines Neighborhood Assn. which fences shall not exceed 42 inches in height and shall be
of a decorative nature.

Neighborhood Covenants
10. No building, structure or accessory building shall be erected closer to the side of any
lot than 10 feet; however, any proposed construction closer than 15 feet to the side of
any lot must be approved by Brookshire Pines Neighborhood Assn. Where buildings
are erected on more than one single lot this restriction shall apply to the side lines of the
extreme boundaries of the multiple lots.
11. No structure in this subdivision, without special approval from Brookshire Pines
Neighborhood Assn., shall exceed 2-1/2 stories or 25 feet in height measured from fi nish
grade to the underside of eave line, and no structure other than an open porch shall be
erected between the building line as designated on the plat and the property line of the
street.
12. No boat, trailer, or camper of any kind (including but not in limitation thereof, house
trailers, camping trailers or boat trailers), or any disabled vehicles shall be kept or parked
upon any lot except within a garage or other approved structure.
13. Lots 187, 194, 195, 220, 221, 222, and 253 shall gain access from interior streets only.
Driveways onto Gray Road or 126th Street will not be permitted, and the buildings on
said lots shall face interior streets.
14. No building shall be erected, placed or altered on any building plot in this subdivision
until the building plans specifi cations and plot plan showing the location of such building
have been approved as to conformity and harmony of external design with existing struc-
tures herein, and fi nished ground elevation by Brookshire Pines Neighborhood Assn.,
owners of the herein described real estate, or by their duly authorized representative. If
the Brookshire Pines Neighborhood Assn. fails to act upon any plans submitted to it for
its approval within a period of fi ft een (15) days from the submission date of the same, the
owner may proceed then with the building according to the plans as approved. Neither
the Brookshire Pines Neighborhood Assn. nor the designated representative shall be enti-
tled to any compensation for services performed pursuant to this covenant.
15. In the event storm water drainage from any lot or lots fl ow across another lot, provi-
sion shall be made to permit such drainage to continue, without restriction or reduction,
across the downstream lot and into the natural drainage channel or course, even though
no specifi c drainage easement for such fl ow of water is provided on said plot.
16. Sump pump effl uent lines shall be connected directly to the tile or storm sewer adja-
cent to each lot.
17. No animals, livestock, or poultry of any description shall be raised, bred, or kept on
any lot, except that dogs, cats or other household pets may be kept, provided that they are
not kept, bred, or maintained for commercial purposes.
18. All garages opening to the street shall have automatic door controls.
19. No lot in this subdivision shall be used or maintained as a dumping ground for rub-
bish, trash, garbage, or other waste and such matter shall not be kept, except in sanitary
containers. Trash shall not be burned, except in suitable incinerators.

Neighborhood Covenants
20. It shall be the duty of the owner of each lot in the subdivision to keep the grass on
the lot properly cut and to keep the lot free from weeds and trash and otherwise neat and
attractive in appearance. Should any owner fail to do so then Brookshire Pines Neighbor-
hood Assn. may take such action as it deems appropriate in order to make the lot neat and
attractive and the owner shall upon demand reimburse Brookshire Pines Neighborhood
Assn. for the expense incurred in so doing.
21. Th e foregoing covenants, (or restrictions) are to run with the land and shall be binding
on all parties and all persons claiming under them for a period of 25 years from the
date of this plat, at which time said covenants, (or restrictions), shall be automatically
extended for successive periods of ten (10) years unless changed by vote of a majority of
then owners of the buildings covered by these covenants, (or restrictions), in whole or in
part. Invalidation of any one of the foregoing covenants (or restrictions), or judgments or
court order shall in no way eff ect any of the other covenants (or restrictions), which shall
remain in full force and eff ect.
