1. The approval will not be injurious to the public health, safety, morals and general welfare of the
community because:
The proposed will not cause pollution, unsanitary conditions, traffic congestion or impair damage
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because:
The proposed accessory dwelling will enhance the appearance of the property. The location of
the dwelling will not interfere with the surrounding properties. The site is surrounded by trees and
all trees will remain on the perimeter
3. The need for the variance arises from some condition peculiar to the property involved because:
The property was purchased by Mr. and Mrs. Andrews. Ed Hart, the father of Mrs. Andrews would
like to build an accessory dwelling on his daughters property. Since this parcel is over 5 acres,
there is plenty of room for an accessory dwelling so the family members can be close to each
other.
4. The strict application of the terms of the Zoning Ordinance will constitute an unnecessary
hardship if applied to the property for which the variance is sought because:
This site is zoned S-1 which allows for a single family home. This site is over 5 acres and an
accessory dwelling fits nicely on the southeast portion of the property. There is an existing
residence and septic field and the southeast corner of the site is the best location for this
dwelling.
5. The approval will not interfere substantially with the Comprehensive Plan because:
The Comprehensive Plan shows this parcel as part of the West Neighborhoods. This area is for
suburban style living on larger lots. Adding an accessory dwelling will not change the acreage of
the parcel.
DECISION
IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Use Variance Docket
No. _______________________ is granted, subject to any conditions stated in the minutes of this Board,
which are incorporated herein by reference and made a part hereof.
