The property is located within the Windsor Grove II subdivision and is zoned S1/Residence, where STRR is not a permitted use by right. In accordance with UDO Section 2.03, a Special Exception is required for this use. Statement of Variance Request This application seeks a Special Exception to permit short-term rental use at this single- family home, enabling limited, regulated rental activity in a manner that aligns with the residential character of the neighborhood. Approval of this request will allow the homeowner to operate in full compliance with the City of Carmel’s STRR program. Statement of Support The property at 10470 Roxley Bend will be used responsibly for short-term stays by vetted guests, with no alterations to the home's structure or exterior. The STRR will be operated in accordance with city guidelines, including occupancy limits, parking compliance, and community standards. Granting this Special Exception will not adversely impact neighboring properties, and the homeowner is committed to maintaining the peace, safety, and residential integrity of the community. Public notice requirements have been fulfilled, including certified mailings to all adjoining neighbors and installation of the public hearing sign in accordance with BZA rules. Could you kindly confirm: 1. Whether long-term rentals (31+ days) are permitted within the HOA 2. Whether short-term rentals (30 days or less) are allowed, restricted, or prohibited 3. The approval of this Special Exception will not negatively affect surrounding property values because: The subject property will continue to operate as a well-maintained, single-family residence, with no alterations to its exterior or footprint. The home will be professionally managed by ZenWave Luxe Living, with strict guest screening, hospitality-grade upkeep, and compliance with Carmel’s STRR regulations. With limited occupancy, quiet hours, and no shared use, the rental model ensures neighborhood character and property values remain protected. 2. This Special Exception will be compatible with existing land uses in the neighborhood because: The property will maintain its residential appearance and function, with no commercial signage, on-site employees, or exterior modifications. As a single-family home in a residential subdivision, the use mirrors neighboring homes and will not alter land use patterns. Short-term guests will have private access and follow community guidelines established through ZenWave’s management policies, creating minimal disruption and preserving compatibility. 3. Vehicular and pedestrian traffic in and around the premises will not be substantially affected by this Special Exception because: Guest use will involve typical single-family vehicle volume, often fewer than permanent residents might generate. Rentals are not event-based, and guest limits will reflect typical household size. There will be no increased foot traffic or street congestion, and all parking will occur in the driveway, not on public streets. The use will remain quiet, temporary, and discreet. DECISION __ __Yes ____No: The Board has reviewed the requirements of UDO Section 5.73 as they relate to this Special Exception, and does not find that those criteria prevent the granting of the Special Exception. IT IS THEREFORE the decision of the Carmel Board of Zoning Appeals that Special Exception Docket No. _________________ SE is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof.
